Abstract

The Constitutional Court’s decision (Number 91/PUU-XVIII/2020) on the Formal Examination of Law Number 11 of 2020, addressing Job Creation and the subsequent enactment of Law Number 13 of 2022, has catalyzed a profound transformation in Indonesia’s legal system. This legal evolution, explored in the context of the Transformation of the Legislative System in Indonesia Based on the Principles of Good Legislation, delves into the political dynamics of legislation leading to numerous Constitutional Court litigations. The quality of law formation is scrutinized in light of the principles of good legislation, emphasizing transparency, participation, effectiveness, and efficiency. The study assesses how the Indonesian parliament executes its legislative function and underscores the imperative for reformulating planning, institutions, and capacity. The article advocates for an expedited authorization of Information and Communication Technology (ICT) as a crucial step toward digitizing legislation in the pursuit of a thoroughly transformed and principled legislative system.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) serve as the economic backbone of communities, with their sustainability influenced by various factors, including adherence to business legality. Among the crucial legal aspects, obtaining halal certification stands out as a pivotal requirement. This certification plays a vital role for business entities, aiming to bolster consumer confidence in the products they offer. The research conducted adopts a mixed-methods approach, combining qualitative and quantitative data collection and analysis. Surveys and direct interviews with service partners reveal significant challenges faced by these partners. These challenges encompass a spectrum from comprehending the importance of halal food products and the processes involved in their production to understanding the intricacies of halal certification and the necessary steps to obtain it. In accordance with the Halal Product Assurance regulations, the implementation of halal certification in Indonesia is mandated to expedite. Notably, by no later than October 17, 2024, all products entering, circulating, and trading in Indonesia must be duly halal-certified. This stringent timeline underscores the urgency for businesses to prioritize obtaining halal certification, positioning it as a critical component of their legal obligations. The significance of halal certificates extends beyond mere compliance, serving as a testament to a business's commitment to meeting the ethical and religious considerations of its diverse consumer base. This study also advocates for the important role of halal certification in sustaining MSMEs as the economic backbone of communities. The findings underscore the need for robust policy-making, emphasizing the urgency of halal certification in accordance with Halal Product Assurance regulations in Indonesia. The research aligns with the advocacy for policies that prioritize the timely implementation of halal certification, recognizing it as a critical component for MSMEs to meet legal obligations and enhance consumer trust.

Abstract

Issuers have an obligation to submit financial reports as stipulated in Law No. 8 of 1995 to the Financial Services Authority by applying the principle of openness. Submission of financial statements is accompanied by publishing the financial statements on the website of a public company or issuer which can be used as a material consideration by investors. This research uses a qualitative approach with a juridical-empirical research type. The data sources used are primary and secondary. The results showed that: 1) The Financial Services Authority as the supervisor of the capital market sector has issued regulations that regulate in detail the procedures and obligations that must be fulfilled by issuers, one of which is through examinations related to reporting obligations to realize the principle of openness and provide protection to investors. 2) overstatement can occur intentionally or unintentionally due to misstatements in the financial statements and administrative sanctions are carried out because the violations that occur are administrative in nature. Supervision by the Financial Services Authority but in some cases still has some weaknesses against overstatement carried out by public companies or issuers under the supervision of the Financial Services Authority. Suggestions given by the author are the issuance of regulations related to overstatement, harmonizing regulations and supervision

Abstract

The online game industry is increasingly widespread and diverse in its practices to attract users, one of which is the use of the gacha system. This article discusses the gacha system in online games and its potential impact on children. Gacha, which involves paying for random in-game items, is often compared to gambling due to its elements of chance and the potential for profit. The system triggers dopamine release, making players feel pleasure, but children are particularly vulnerable to its mechanics. The article highlights the lack of juridical protection in Indonesia against online games that use gacha systems. While the Child Protection Law prohibits the economic exploitation of children, there are no specific regulations addressing gacha systems in online games. The authors identify the potential economic exploitation of children through gacha as a significant problem. They suggest two solutions: promoting traditional games with character-building content for children, and providing education on character development when introducing these games. From a legal perspective, the article calls for concrete protection measures for children playing online games with gacha systems. The research uses a normative juridical approach, employing library research based on literature.

Abstract

The development of green energy is a global priority in facing the challenges of climate change, where green hydrogen has emerged as a renewable energy that can be a sustainable solution. This article discusses the comparison of green hydrogen management in ASEAN countries from an investment law perspective. The main focus of this study is to analyze the regulations, incentives, and legal barriers faced by investors in the green hydrogen sector in various ASEAN member countries. The research method used involves a qualitative approach with a literature study and analysis of laws and regulations related to renewable energy investment. The results of the study show that there are policy disparities among ASEAN countries in supporting green hydrogen investment. Singapore and Malaysia, for example, have adopted more progressive policies, including fiscal incentives and ease of licensing, while other countries still face complex regulatory challenges and lack of supporting infrastructure. This article concludes that harmonization of the investment legal framework in ASEAN is needed to attract more investment in the green hydrogen sector. In addition, strong regional collaboration can accelerate the development of green hydrogen technology and strengthen energy security in the region.

Abstract

This research delves into legal issues surrounding the impact of green investment on cooperation contracts managing idle wells in Indonesia, Malaysia, and Equatorial Guinea. In alignment with green investment principles, the Indonesian Government has implemented various schemes to enhance the effectiveness of exploration and exploitation activities in the oil and gas sector. Presently, efforts to boost oil and gas production involve reactivating idle wells, yet there is a regulatory gap concerning the transfer of this work to cooperation contract contractors. To address this, the study compares how Malaysia and countries in the Guinea Region, adopting green investment practices, manage idle wells. Employing a socio-legal methodology, the research draws on field research, legal sources, articles, journals, and related news. The findings highlight the crucial role of acknowledging the ongoing significance of oil and gas while recognizing the imperative to transition sustainably, exemplified by Indonesia's commitment and the potential application of the Production Sharing Contract (PSC) scheme in shaping the future of non-fossil energy sources in the realm of upstream oil and gas investment.

Abstract

Perkembangan keuangan digital saat ini harus sejalan dengan peningkatan pengetahuan khususnya masyarakat yang berada di daerah. Untuk itu pengabdian ini dilakukan sebagai salah satu upaya memberikan lierasi keuangan digital. Kegiatan pengabdian dilakukan dengan metode ceramah dan diskusi yang sebelumnya telah dilakukan analisis masalah terlebih dahulu agar materi sosialisasi dapat sesuai dengan apa yang dibutuhkan. Hasil yang dicapai pada kegiatan pengabdian kali ini ada meningkatnya pemahaman tentang perkembangan perusahaan pinjaman daring, aturan hukum tentang pinjaman daring dan risiko yang mungkin muncul dari penggunaan pinjaman daring.

Abstract

The social media network has become one of the most favored digital technology platforms for information and entertainment among the public today. However, in social media practices, women often appear as objects that are sexualized or commodified commercially. According to a survey by wearesocial.com and Hootsuite, most internet users in Indonesia fall into the categories of teenagers and young adults. Building upon the results of this survey, community service focuses on the age group of 13 to 18 years old who are currently studying at a Senior High School (SMA). This community service initiative occurs at a Public Senior High School in Semarang City, Central Java. The activity involves the socialization and mentoring of 100 students (50 males and 50 females). This activity influences the perspectives and behaviors of teenagers towards the portrayal of women on social media, leading to an average score change from 39 (before socialization) to an increased average of 89 (after socialization and mentoring), which represents a significant increase.
