Abstract

Dalam tata kelola pemerintahan desa, Perdes sangat krusial karena menjadi dasar hukum bagi pelaksanaan berbagai program dan kegiatan desa.Penjelasan tentang tugas dan wewenang Kepala Desa dan anggota BPD di atas menunjukkan bahwa wewenang penetapan Peraturan Desa ada di Kepala Desa.Tetapi penetapan tersebut hanya bisa dilakukan setelah Rancangan Perdes dibahas dan disepakati bersama BPD.Selain itu, inisiatif untuk mengajukan Perdes tidak hanya berada di tangan Kepala Desa, tetapi juga ada di tangan para anggota BPD. Di sini tampak bahwa Kepala Desa merupakan badan eksekutif di tingkat desa, yang bekerja bersama BPD sebagai badan legislatifnya. Di sini kemampuan teknis untuk membuat Perdes tidak hanya menjadi kebutuhan kepala desa atau perangkat desa yang memiliki tugas terkait, namun juga penting diketahui oleh para anggota BPD. Sayangnya, tidak semua anggota BPD memiliki kemampuan teknis untuk menyusun Perdes.Baik karena alasan tingkat pendidikan, maupun karena alasan latar belakang pendidikan yang tidak terkait dengan hukum. Karena itu, kegiatan pengabdian masyarakat yang bertemakan ?Pelatihan Penyusunan Teknis Peraturan Desa Untuk Aparatur Desa Dan BPD di Kecamatan Mrebet Kabupaten Purblalingga? telah dilaksanakan dalam rangka memberikan pemahaman kepada Aparatur Desa dan BPD dalam membuat Perdes.

Abstract

Character education is an important element in the effort to prepare superior Indonesian human resources, it is of particular concern to be applied especially among students, there is a need for character education because the attitudes and behavior of the people and people of Indonesia now tend to ignore the noble values ​​of Pancasila which are highly respected and should be rooted in everyday attitudes and behaviors, values ​​such as honesty, politeness, togetherness and religious, gradually eroded by foreign cultures that tend to be hedonistic, materialistic, and individualistic, so that the noble character values ​​are ignored in the future if students and young people are not equipped with character education. Law students have their own challenges, especially in the era of globalization. This paper analyzes and illustrates the character strengthening program for law student activists in Semarang State University through several programs, namely public speaking, strengthening student idealism, strengthening advocacy capacitation and human rights assistance and self-motivation. This research is a field research with the object of research as activists of law students who are members of student organizations. This research confirms that the programs for strengthening the character of students experience several obstacles, one of which is the model used and a relatively short time. However, character education for student activists helps students to survive in real life as part of community members.

Abstract

The number of Indonesian migrant workers placed in South Korea in recent years has tended to increase. In 2018 there were 6,921 workers placed in South Korea in various sectors. This number increased from the previous year which only 3,719 people. The placement scheme is carried out through a Government to Government (G to G) cooperation scheme between the two countries through the National Agency for Placement and Protection of Indonesian Workers (BNP2TKI) and South Korea’s Employment Permit System (EPS). The study intends to examine, analyze, and explore more about the policy of placing Indonesian workers in South Korea as well as various legal protections provided by the South Korean government. This research is a collaborative research initiated through the G-to-G program by the Faculty of Law, Universitas Negeri Semarang, and the South Korean government. This research involved the Study Center and Labor Law Clinic of the Faculty of Law of UNNES, the Center for Legal Drafting, Policy and Development at the Faculty of Law of UNNES, Hankuk University of Foreign Studies Hankuk College of Law, and Law Research Institute Hankuk University of Foreign Studies. This research is empirical legal research, where the research was carried out in two countries: Indonesia and South Korea. The purposes of the research are to: (1) to investigate the effectiveness of national and international law instrument on the protection to migrant workers in South Korea, (2) to identify the specific policies on South Korea for Southeast foreign workers as well as Indonesian migrant workers, and (3) to analyze the cooperation both South Korea and Indonesia on sending migrant workers. The research will be carried out for eight months in two countries. Research in Indonesia will be focused on Jakarta (in several labor related institutions), while in South Korea it will focus on the Hankuk University of Foreign Studies, the Indonesian Embassy in South Korea, the Association of Indonesian Workers in South Korea, the South Korean Student Association of Indonesia (Perpika), and Human Resources Development Service of Korea.

Abstract

Abstract

Desa Lerep sebagai salah satu desa wisata yang menjunjung kearifan lokal juga memiliki berbagai permasalahan hukum yang terjadi di lingkup sosial masyarakat. Jika melihat dalam Pasal 26 (4) huruf k Undang-Undang No. 6 Tahun 2014 tentang desa dinyatakan bahwa kepala desa wajib menyelesaikan perselisihan warganya sehingga dibutuhkannya pembentukan suatu lembaga khusus di desa yang berfungsi untuk membantu menyelesaikan segala macam permasalahan yang ada di masyarakat. Lembaga ini selanjutnya akan berfokus pada penyelesaian permasalahan hukum secara mediasi atau musyawarah, sehingga digunakanlah nama Majelis Syuro Desa. Dengan terbentuknya Majelis Syuro Desa diharapkan dapat menjadi wadah agar setiap permasalahan hukum yang terjadi di masyarakat dapat terselesaikan tanpa harus dilanjutkan secara litigasi. Tujuan dari penelitian ini adalah untuk memahami bagaimana pembentukan Majelis Syuro Desa dan memahami sistem kerja Majelis Syuro Desa. Penelitian ini diharapkan dapat memberikan kontribusi pemikiran, sebagai bahan bacaan atau literatur, serta untuk perkembangan hukum kedepannya nanti.

Abstract

Cases of violations of ASN discipline are like an iceberg phenomenon, the number of cases that appear on the surface/reported doesn't seem that many, but of course there are still many uninformed cases, this is a concern in itself. Even though the rules contained in Government Regulation Number 53 of 2010 have been implemented concerning PNS/ASN Discipline, cases of disciplinary violations still occur. One of the reasons for the stipulation of PP No. 53 of 2010 concerning Discipline for Civil Servants as a substitute for PP no. 30 of 1980 concerning the discipline of Civil Servants due to the demands of society for improving the performance and service of civil servants in line with the implementation of bureaucratic reforms. In addition to PP No. 53 of 2010, the State Civil Service Agency (BKN) has also prepared a replacement for PP no. 10 of 1979 concerning the evaluation of the implementation of the work of civil servants, which so far is known as DP3, namely PP No. 46 of 2014.

Abstract

Trademarks play a crucial role in protecting the intellectual property rights of businesses and individuals. However, in rural and remote areas, awareness of trademark infringement and the legal mechanisms to prevent it may be limited. This study explores the use of Participatory Rural Appraisal (PRA) as an innovative approach to legal education in preventing trademark infringement, focusing on the case of Bandungan in Central Java, Indonesia. The research utilizes a mixed-methods approach, combining qualitative and quantitative data collection techniques. Through a series of workshops, surveys, and participatory activities, the study engages with the local community in Bandungan to assess their understanding of trademarks, identify potential infringement issues, and deliver legal education on trademark protection. The findings reveal that the PRA approach effectively enhances the community's awareness of trademark rights and the legal remedies available to prevent infringement. Participants actively participate in discussions, share their experiences, and collaboratively generate strategies to protect local businesses' intellectual property. Moreover, the study identifies specific challenges faced by the community in safeguarding trademarks, such as limited access to legal resources and awareness of the legal system. The research contributes to the field of legal education and rural development by highlighting the potential of PRA as a practical and community-driven method for raising awareness about trademark infringement prevention. It underscores the importance of tailoring legal education programs to the specific needs and contexts of rural communities, ultimately empowering them to protect their intellectual property rights and foster economic development.

Abstract

This paper investigates the role of Pancasila-based legal education through the Street Law model in advocating for social transformation and fostering nationalism among youth in Kenteng Village. As Indonesia strives to strengthen its national identity, particularly among younger generations, integrating Pancasila— the nation’s foundational ideology— into legal education becomes essential. The study outlines a community-driven program that engages university students and local youth in interactive legal workshops, promoting awareness of rights, responsibilities, and civic engagement rooted in Pancasila values. Through participatory methods, the program encourages youth to actively engage in discussions about legal issues and national identity, thereby enhancing their understanding of Indonesian democracy and governance. The findings reveal that this approach not only cultivates a sense of nationalism among participants but also empowers them to become advocates for their communities. Participants reported increased confidence in navigating legal matters and a stronger commitment to civic involvement. This research highlights the importance of advocacy in legal education as a catalyst for social change, demonstrating that the Street Law model can effectively bridge the gap between academic knowledge and practical application in the community. Ultimately, the paper argues for broader implementation of Pancasila-based legal education programs across Indonesia, suggesting that such initiatives can play a vital role in nurturing a generation of informed and engaged citizens dedicated to the ideals of Pancasila.
