Abstract

This study seeks (1) to explore local government strategies in selecting personnel for strategic positions; (2) studying the role of the RPA (Regional Personnel Agency) in carrying out the Decency and Appropriateness Test of personnel applying for the "Position Auction"; (3) studying the role of the Sekwilda in conducting the fit and proper test; (4) searching for the fit and proper test models according to local characteristics. The agenda for improving Indonesia's public sector becomes a necessity if it is linked to developments and current demands, such as good governance, professionalism, transparency, accountability, ethical and moral enforcement in the delivery of public services (Milakovich and Gordon, 2007 in Nurprojo, 2014). The improvement of the Indonesian bureaucracy through the enactment of the State Civil Apparatus Law is expected to be able to realize a better Indonesian bureaucracy through the performance of professional civil servants based on competence and competition by establishing a merit system in State Civil Apparatus management.  This study uses a qualitative paradigm by relying on researchers as data collectors through in-depth interviews and participatory observation. In-depth interviews were conducted with local elites (Head of the Regional Personnel Agency, Staff of the Regional Personnel Agency, Members of the Regional People's Representative Council, Members of the Selection Committee, Non-Governmental Organizations, the media and intellectuals) who were concerned with local governance. This is done to determine the implementation of the propriety test and due diligence in the context of filling strategic positions in the regions.

Abstract

Scientific work in the field of legal science in Indonesia often differs from the criteria for empirical scientific research at the level of modern science. The results of thesis and dissertation-level scientific research at law faculties have so far emphasized technical-juridical analysis for the needs of legal practice rather than academic research that criticizes and creates new scientific theories in the field of law. Dogmatic legal analysis, it seems, takes precedence over academic legal analysis that allows researchers to fulfill the critical scientific need for the renewal of legal dogmatics by the development of Society. The framework section is usually narrated without construction in the form of a 'theoretical framework' or 'analytical model' which often shows confusion in legal research. Legal dogmatic research focuses on evaluating the structure (language) of law and legal practice, i.e. how far the elements of the article as evaluation indicators are used with the resolution of the particular legal event being studied. Scholarly legal research often uses theory in presenting the framework for its theses and dissertations, and more than one theory is even related to the various narratives and descriptions of the proposed research. In addition, legal researchers present major frameworks in 'grand theory', 'middle-range theory', and applied theory' for research typically conducted in the field of pure science (pure social and human sciences).

Abstract

The Social Construction of the Quality Family Village in Pondok Batu Village, Bilah Hulu Subdistrict, Labuhanbatu Regency is a strategic effort to improve the quality of life in the community through a participatory approach. This study aims to analyze how the community constructs their social reality in the context of the Quality Family Village program, using the social construction theory perspective of Peter L. Berger. The research method employed is qualitative, with data collection through interviews, observations, and documentary studies. The results show that the processes of externalization, objectivation, and internalization are key in building the community's collective awareness of the importance of this program. The community plays an active role in formulating and implementing programs relevant to their needs, thereby creating new norms that support the improvement of quality of life. Furthermore, this study also identifies the challenges faced in the program's implementation, including a lack of understanding and participation from some segments of the community. Therefore, further efforts are needed to enhance the socialization and education about the Quality Family Village program in order to achieve the expected goals.

Abstract

In the relationship between religion and culture, there are institutions that have legitimacy to overshadow both, one of which is religious institutions. Huria Kristen Batak Protestant (HKBP) as one of the religious institutions is seen as a place of spiritual fellowship and cultural fellowship (Batak) that has legitimacy to preserve. This preservation departs from the phenomenon of fading Batak cultural identity among the Young Generation of Batak Christians today in the midst of hybrid culture is an interesting thing to research. This research is a case study using qualitative methods with the aim of explaining the role of HKBP Church in efforts to preserve Batak Cultural Identity Among the Young Generation of Batak Christians with a Case Study of HKBP Cinta Damai Church. The results showed that HKBP became a place of spiritual and cultural communion based on the historical history of the cultural journey of the HKBP Church. However, the mixing of cultures (hybrid) due to the times makes the Batak Christian Young Generation have no interest in their identity besides the parental factor that does not inherit.
