Abstract

This study aims to: 1) explore the practice of the besampu ceremony tradition for newborns in the Kantu' Sanggau community; and 2) examine the maslahah mursalah related to the besampu ceremony tradition for newborns in the Kantu' Sanggau community. This research employed a qualitative method with a field study design. Primary data were collected through interviews, observations, and documentations. Secondary data were obtained from documents owned by the community members who performed the besampu tradition. Data collection methods included interviews, documentations, and observations. Data analysis techniques involved data reduction, data presentation, and conclusion formulation. Data validity was verified through member checks on all data and information. Based on the analysis, the researcher concluded that: 1) The besampu tradition is a ceremony involving the smoking of a child with a fragrant aroma, aiming for the child to have a better life. 2) The besampu tradition falls under the category of tahsiniyyah maslahah mursalah, as a complement that if not fulfilled, will not cause difficulties, but there is a traditional belief that gives rise to syncretism.

Abstract

This research aims to find out the management at Samudera Indah Beach and study it based on the Fatwa of the National Sharia Council-Majelis Ulama Indonesia No. 108/DSN-MUI/X/2016 concerning Guidelines for Tourism Operations Based on Sharia Principles. Based on the results of observations and interviews, researchers found that: 1) The form of management at Samudera Indah Beach has facilities provided by the manager such as gazebo facilities, halls, parking lots, prayer rooms, lodging/villas, places to relax on the coast, camping sites, public toilets, bathrooms, rinse rooms, canteens, landfills, directions, and lakes for children. For security management, the manager has conducted socialization related to security for visitors, provided parking attendants to guard visitors' vehicles, provided supervisors on the shoreline, loudspeakers to provide appeals when the weather is bad, and a return post for goods if they find items that do not belong to them. 2) The management of Samudera Indah Beach according to the Fatwa of the National Sharia Council-Majelis Ulama Indonesia No. 108/DSN-MUI/X/2016 concerning Guidelines for the Implementation of Tourism Based on Sharia Principles shows the existence of relevant norms and irrelevant norms and norms that have not been fulfilled at Samuderea Indah Beach, Bengkayang Regency. The transaction or contract is in accordance with the provisions of the ijarah contract in the MUI Fatwa.

Abstract

This study aims to provide understanding and legal counseling regarding child abuse in Singkawang City, West Kalimantan, with a focus on bullying, sexual violence, and child marriage. The counseling activity was carried out by the Faculty of Sharia at IAIN Pontianak at MAN Kota Singkawang and SMAN 2 Kota Singkawang in 2023. The implementation method consisted of three stages: preparation and administrative processes, field activities, and reporting the results. The delivery of the material was conducted through an interactive model and dialogue, interspersed with clips from the film A Silent Voice and reflections on the song Satu Satu. The results of the activity showed that participants gained an understanding of perpetrators, victims, and witnesses in cases of child abuse, as well as appropriate prevention and reporting mechanisms. Feedback from participants revealed that bullying and sexual violence are relevant issues in the school environment, with the main focus on prevention starting from oneself and the importance of building a healthy, equal, and inclusive friendship environment.

Abstract

This research aims to examine: 1) The practice of the Antar Pakatan tradition in the wedding ceremonies of the Sambas Malay community in Sepadu Village, and 2) the ‘urf-based legal analysis of the custom of Antar Pakatan in the wedding ceremonies of the Sambas Malay community in Sepadu Village.The study employs a qualitative research method with field research and a normative-empirical approach. The data sources consist of primary and secondary sources: 1) primary sources include religious leaders, community members who marry off their children using the tradition, and other involved parties; 2) secondary sources include books, journals, and articles related to the study. Data collection techniques used are observation, interviews, and documentation. Data analysis applies the Miles and Huberman technique, which involves data reduction, data presentation, and drawing conclusions. Based on the analysis conducted, the researcher concludes that: 1) The Antar Pakatan tradition requires invitees to a wedding to bring one live chicken or poultry and a sack of rice as gifts for the hosting family. Besides serving as gifts, Antar Pakatan also helps alleviate the financial burden of wedding expenses. 2) The Antar Pakatan tradition can be categorized as ‘urf since it fulfills the requirements for customs or traditions to be recognized as ‘urf.

Abstract

This research aims to examine the influence of intellectual capital on the financial performance of banking companies (ROA) in both the current and the future years. Applying the Pulic model of Value Added Intellectual Coefficients (VAIC), this study attempts to examine the correlation between the efficiency of VAIC in terms of three major resources (physical assets, human capital, and structural capital) and the financial performance of the company's Return on Assets (ROA). The research samples are taken from 29 annual reports of banking companies listed in the Indonesia Stock Exchange in 2014-2015, and the data are analyzed through multiple linear regression method. The results of the study show that the intellectual capital measured by VAIC influences the banking financial performance. The components of intellectual capital that significantly affect the financial performance are Value Added of Human Capital (VAHU) and Value Added of Capital Employed (VACA); whereas, Structural Value Added (STVA) has no significant effect on the banking financial performance.Keywords: Intellectual capital; Financial performance.

Abstract

The objectives of this study are: 1) To understand the practice of the paddy seed gantang system carried out by the community of Sungai Nilam Village; and 2) To determine the legal status of the paddy seed gantang system in Sungai Nilam Village from the perspective of Imam Syafi’i’s Al-Umm. The research method used was field research with a descriptive-qualitative approach. This study used primary data sources in the form of in-depth interviews. Secondary data sources were translations of Imam Syafi'i's Kitab Al-Umm. Data collection techniques were carried out through structured interviews and document studies. Data validity techniques used source and technique triangulation. Data analysis techniques consisted of data collection, data reduction, data presentation, and conclusion drawing. The results showed that: 1) the practice of the paddy seed gantang system is a tradition passed down from generation to generation that reflects the values of mutual cooperation, carried out through the exchange of similar goods using the same measure, even though there is an imbalance in the quality of the goods; 2) from the perspective of the Book of Al-Umm by Imam Syafi'i, it is in accordance with the provisions of muqayadhah, but does not fully meet the requirements due to differences in the quality of goods. However, this practice remains relevant to the principles of muamalah in Islam, which emphasizes justice.

Abstract

This article examines the socio-legal construction of shellfish trading practices that utilize traditional measuring tools within the Muslim coastal community of Tempurukan Village, Ketapang, West Kalimantan. The study is motivated by the limited scholarly attention given to how traditional measurement systems in coastal economies interact with Islamic law, particularly in commercial practices that do not employ standardized metrological instruments. Adopting a socio-legal approach, the field research applies Peter L. Berger and Thomas Luckmann’s social construction theory to analyze the dynamics of these practices. Data were collected through structured interviews with nine informants, participant observation, and documentation of transactional processes. The findings reveal that the community uses cupak (coconut-shell measures) and ringkat (plastic containers) as traditional measuring devices, socially regarded as equivalent to one kilogram. This non-standard measurement system is grounded in inherited tradition, social trust, and practical efficiency, and is considered valid within Islamic law because it fulfills the principle of tarāḍin (mutual consent) and falls under the category of ʿurf ṣaḥīḥ (sound custom). Through the processes of externalization, objectivation, and internalization, the cupak has evolved into a socio-legal instrument that negotiates customary norms, economic rationality, and Islamic ethical values. The article argues that this socially constructed system produces a form of justice rooted in local wisdom that transcends the precision-oriented logic of modern metrology, reflecting a distinctive pattern of local Islamic legal reasoning within the coastal Muslim community. [Artikel ini menganalisis konstruksi sosio-legal praktik jual beli kerang dengan menggunakan alat ukur tradisional pada masyarakat muslim pesisir di Desa Tempurukan, Kabupaten Ketapang, Kalimantan Barat. Penelitian ini berangkat dari minimnya perhatian akademik terhadap bagaimana sistem ukur tradisional dalam ekonomi pesisir berinteraksi dengan hukum Islam, khususnya dalam praktik jual beli yang tidak menggunakan alat metrologi standar. Penelitian lapangan ini menggunakan pendekatan sosio-legal dan dianalisis dengan teori konstruksi sosial Peter L. Berger dan Thomas Luckmann. Data diperoleh melalui wawancara terstruktur terhadap sembilan informan, observasi partisipan, dan dokumentasi proses transaksi. Hasil penelitian ini menemukan bahwa masyarakat muslim pesisir menggunakan cupak (batok kelapa) dan ringkat (wadah plastik) sebagai alat ukur yang secara sosial dianggap setara dengan satu kilogram. Sistem ukur non-standar ini dilandasi tradisi turun-temurun, kepercayaan sosial, dan efisiensi praktis, serta dipandang sah secara fikih Islam karena memenuhi prinsip tarāḍin (kerelaan bersama) dan termasuk dalam kategori ʿurf ṣaḥīḥ (kebiasan yang baik). Melalui proses eksternalisasi, objektivasi, dan internalisasi, cupak berkembang menjadi instrumen sosio-legal yang menegosiasikan nilai adat, rasionalitas ekonomi, dan etika Islam. Artikel ini berargumen bahwa konstruksi sosial tersebut menghasilkan bentuk keadilan berbasis kearifan lokal yang melampaui logika presisi metrologi modern serta merefleksikan pola penalaran fikih lokal yang khas dalam masyarakat muslim pesisir.]
