Abstract

The existence and authority of the executive, legislative and judicial institutions are regulated in the 1945 Constitution of the Republic of Indonesia, then regulated in more detail in the law, except for the President. There is no law on presidential institutions yet, so there is concern that the President will exceed or abuse his authority in carrying out his duties. This research discusses the importance of regulating presidential institutions in strengthening the presidential system. The research approach was normative juridical; examining legal rules or regulations as a building system related to a legal event. The data used were secondary data in the forms of primary and secondary legal materials. Based on the results of the analysis, it is concluded that: 1) the regulation of presidential institutions is only found in the Constitution. There is no description of the position and division of authority between the President and Vice President and other positions in the presidential institution. 2) The position of the Vice President is as assistant to the President, and the Vice President replaces the President when the President dies, resigns, is dismissed, or is unable to carry out his obligations during his term of office. 3) Regulation of presidential institutions in strengthening the presidential government system is very urgent to prevent arbitrary actions by the President and to provide clarity on the authority of positions within the presidential realm so that they can carry out their duties well in supporting the President as head of state and head of government. With clear arrangements, each person has responsibilities, and there will be no overlapping of authority.

Abstract

ABSTRACTIndonesia, as an agricultural country, encourages customary law community units, particularly in Puncak Jaya Regency, to register their land as proof of customary land ownership. This research aims to assess the ability to implement the land registration system by comparing statutory regulations with the realities in the field. The method used is sociological juridical. The results show that the implementation of Customary Land Rights Registration by the Land Office of Puncak Jaya Regency, Central Papua Province, has not been carried out in accordance with the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency of the Republic of Indonesia Number 14 of 2024, as evidenced by various barriers, constraints, and the proposed solutions revealed in the research findings.Keywords: Land Registration; Customary RightsABSTRAKNegara Indonesia sebagai negara agraris menghimbau kepada kesatuan/kelompok masyarakat hukum adat, khususnya di Kabupaten Puncak Jaya, untuk mendaftarkan tanahnya sebagai bukti penguasaan tanah hak ulayat. Tujuan penelitian ini adalah untuk mengukur kemampuan pelaksanaan sistem pendaftaran tanah antara pengimplementasian peraturan perundang-undangan dengan kenyataan di lapangan. Metode penelitian yang digunakan adalah yuridis sosiologis. Hasil penelitian menerangkan bahwa pelaksanaan pendaftaran tanah hak ulayat masyarakat hukum adat di Kantor Pertanahan Kabupaten Puncak Jaya, Provinsi Papua Tengah, implementasinya belum sepenuhnya sesuai dengan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 14 Tahun 2024, sebagaimana tergambar dalam hambatan, kendala, dan solusi berdasarkan hasil penelitian yang ada.Kata Kunci: Pendaftaran Tanah; Hak Ulayat

Abstract

Penelitian ini dilatarbelakangi oleh meningkatnya permohonan dispensasi nikah di Indonesia setelah revisi Undang-Undang Perkawinan yang menetapkan batas usia minimal menikah menjadi 19 tahun. Tujuan penelitian ini adalah meninjau aspek yuridis dari permohonan dispensasi nikah melalui studi kasus Putusan Pengadilan Agama Purwodadi No. 133/Pdt.P/2025/PA.Pwd. Metode yang digunakan adalah pendekatan yuridis normatif dan yuridis empiris dengan spesifikasi deskriptif analitis. Data penelitian diperoleh melalui studi kepustakaan dan studi dokumen yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pertimbangan hakim dalam mengabulkan permohonan dispensasi nikah telah mengacu pada ketentuan Pasal 7 ayat (2) Undang-Undang Nomor 1 Tahun 1974 jo. Undang-Undang Nomor 16 Tahun 2019 serta Peraturan Mahkamah Agung Nomor 5 Tahun 2019, dengan menitikberatkan pada prinsip perlindungan anak dan kepentingan terbaik bagi anak (best interest of the child). Kesimpulan penelitian ini menegaskan bahwa meskipun permohonan dikabulkan, hakim tetap mensyaratkan adanya pendampingan dari keluarga dan lembaga terkait guna memastikan perlindungan hak-hak anak pasca pernikahan.Kata Kunci: Tinjauan Yuridis, Dispensasi Nikah, Perlindungan Anak.

Abstract

Nusa Tenggara Barat (NTB) memiliki kawasan hutan seluas 1.069.997,78 dengan potensi HHBK cukup berlimpah. Dan Desa Pakuan merupakan salah satu desa di Kecamatan Narmada yang memiliki Hutan Konservasi yaitu Kawasan Taman Hutan Raya Nuraksa yang memiliki luas 3,155 Ha yang terdiri dari enam Blok termasuk Blok Tradisional yang merupakan Blok yang dimanfaatkan oleh petani sekitar. Penelitian ini bertujuan untuk mengkaji tentang besaran kontribusi Hasil Hutan Bukan Kayu (HHBK) terhadap pendapatan petani di Kawasan Taman Hutan Raya (Tahura) Nuraksa, Desa Pakuan, Kecamatan Narmada, Kabupaten Lombok Barat. Penelitian ini dilakukan menggunakan metode analisis deskriptif. Penentuan daerah sampel dilakukan dengan purposive sampling sedangkan teknik pengambilan sampel dilakukan secara purposive random sampling dengan melibatkan 31 responden dari sembilan Kelompok Tani Hutan (KTH) yang beroperasi di sekitar kawasan hutan. Hasil penelitian menunjukkan total pendapatan petani dari memanfaatkan HHBK di Tahura Nuraksa sebesar 541.944.009 per tahun. Diketahui bahwa HHBK memberikan kontribusi signifikan terhadap pendapatan petani, dengan komoditas utama seperti pisang, kopi, kakao, kemiri, dan durian dengan tingkat kontribusi sebesar 71% terhadap pendapatan petani. Dalam memanfaatkan HHBK di Tahura Nuraksa, ada beberapa kendala yang sering dihadapi oleh petani, diantaranya adalah pengetahuan dan keterampilan yang berpengaruh terhadap hasil produksi ,harga yang tidak stabil, dan kondisi lingkungan atau lahan garapan petani. Dengan adanya pohon besar di sekitar lahan garapan secara langsung maupun tidak langsung memengaruhi pertumbuhan dan kualitas hasil tanaman budidaya.

Abstract

The introduction of the Omnibus Law with Law Number 11 of 2020 on Job Creation marked a significant change in Indonesia’s approach to legislation, as this method was previously unfamiliar in the country. Consequently, the law faced legal challenges and was brought before the Constitutional Court (MK) for review. The Court ruled that the legislative process was flawed, highlighting a lack of public involvement and transparency, and found that the omnibus law method did not have a solid legal foundation within Indonesia’s existing legal framework. In response to these concerns, the House of Representatives and the President passed Law Number 13 of 2022, which included guidelines for using the omnibus law method in future legislation. This method is widely used in common law countries, while Indonesia operates under a civil law system rooted in democratic principles. This study focused on examining implications of the omnibus law method through a normative juridical approach, utilizing secondary data and qualitative analysis. The findings show that while this method can streamline the drafting and discussion of laws—saving time and effort—it also has significant downsides. This include a tendency to prioritize practicality over thorough research and limited public engagement, which undermines its democratic nature. Therefore, if Indonesia chooses to continue using the omnibus law method, it is crucial to address these limitations. Specifically, there must be genuine opportunities for public participation that go beyond just empty formalities. Careful and accurate implementation is needed to ensure that the resulting legislation is effective, high quality, and ultimately regarded as beneficial by the community.

Abstract

The authority of the Judicial Commission (KY) to supervise judges is diminishing due to opposition from the Supreme Court judges and constitutional judges. Cases of corruption and bribery involving Supreme Court judges and constitutional judges indicate that external oversight by the KY is crucial to maintaining judges' honor, dignity, and behavior. This research discusses the importance of external supervision in realizing the integrity of judges. The research uses a normative juridical approach, which examines norms or legal rules as a structure of norm systems related to a legal event. The data used are secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Based on the analysis, it is concluded that: 1) Supervision of judges, both internally and externally, is necessary and crucial to prevent them from abusing the freedom or independence given to them. Various cases of bribery and corruption involving judges indicate that without external supervision, there will be a risk of abuse of power. 2) KY, as an external supervisor, also needs to be given authority to select not only Supreme Court judges but judges at all levels of the judiciary within the Supreme Court. 3) KY conducts external monitoring of all judges, including judges to the Supreme Court and constitutional judges, to ensure the integrity of the judiciary. In order to ensure the optimal operation of KY's authority, KY representatives need to be established in provinces and districts/cities since judges are distributed throughout Indonesia both in provinces and districts/cities.

Abstract

Penelitian ini dilakukan pada ketiga pulau kecil yang ada di Bangka Belitung yaitu Pulau Putri, Pulau Panjang dan Pulau Semujur. Tujuan penelitian ini adalah untuk mengetahui keanekaragaman bivalvia dan gastropoda berdasarkan karakteristik masing-masing pulau. Metode yang digunakan adalah metode Purposive sampling dengan teknik transek garis yang dilakukan pengambilan garis tegak lurus terhadap garis pantai. Stasiun terdiri dari 3 stasiun dengan 5 plot pencuplikan yang dibuat kerangka kuadran berukuran 50×50cm2 dengan jumlah total daerah pencuplikan adalah 15 masing-masing pulau. Analisis data menggunakan rumus keanekaragaman Shannon Wiener. Hasil penelitian menunjukkan bahwa parameter fisik dan kimia pada lingkungan ketiga pulau tergolong baik dengan suhu rata-rata 31,9℃, pH 7,395 dan salinitas 4,15%. Keanekaragaman Gastropoda lebih besar daripada keanekaragaman Bivalvia. Hal ini ditunjukkan dengan adanya 21 spesies gastropoda di Pulau Putri, 18 spesies gastropoda di Pulau Panjang, dan 7 spesies gastropoda di Pulau Semujur sedangkan bivalvia 20 spesies di Pulau Putri, 13 spesies di Pulau Panjang, dan 2 spesies di Pulau Semujur. Famili dari kelas Gastropoda yang paling banyak ditemukan adalah Cerithiidae. Berdasarkan parameter yang diukur pada lokasi penelitian dan adanya perbedaan karakteristik dari ketiga pulau menyebabkan adanya perbedaan keanekaragaman gastropoda dan bivalvia, seperti di Pulau Putri yang didominasi oleh rataan terumbu karang yang sangat luas dan rapat dengan substrat berupa pasir, yang mana kondisi tersebut mempengaruhi tingginya keanekaragaman gastropoda dan bivalvia. Adapun di Pulau Panjang di dominasi oleh ekosistem lamun dengan tipe substrat yang lumpur berpasir, keberadaan lamun dapat menjadi sumber nutrisi serta habitat bagi moluska hal tersebut yang menyebabkan tingginya keanekaragaman gastropoda dan bivalvia. Adapun Kondisi lingkungan di Pulau Semujur di dominasi oleh ekosistem lamun dengan substrat berpasir, serta terdapat pemukiman warga, banyaknya aktivitas seperti rekreasi, memancing dan eksplorasi serta pengambilan fauna untuk koleksi pribadi di Pulau tersebut menyebabkan rendahnya keanekaragaman gastropoda dan bivalvia.
