Abstract

Community Service Activities that will be carried out by the Lecturer Team of the Dharma Andalas University Law Study Program will be accomplished in the form of law counseling related to Online Loans. This is intended to socialize to the public about legal online loans and vice versa. It is because the illegal online loans are very widespread and disturbing to the public because debt collectors who collect loans terrorize their victims. Law counseling was provided in one of the sub-districts in Padang City due to the large number of complaints from the people who were caught in online loans where the relevant task force received 8,991 complaints related to illegal loan until October 2023, so that the public needed to be given an understanding regarding to loan money, both legal and illegal, and the impacts from the perspective of law. This service is carried out by using a lecture method with laptop and LCD Projector in Padang City, particularly at the house of one of the residents in Unand Housing Complex, Padang Besi Village, Lubuk Kilangan District, Padang City. To measure their understanding, the participants were asked questions in the form of question-and-answer games.

Abstract

The Faculty of Law at Dharma Andalas University will conduct a community service activity in the form of a legal education campaign focusing on "Stop Bullying" to create a bullying-free school environment. This campaign aims to raise awareness about bullying, which is a repetitive aggressive behavior intended to harm or weaken individuals who are physically or mentally weaker. Bullying can occur physically, verbally, socially, or even online. According to data from the Indonesian Child Protection Commission (KPAI) and the Federation of Indonesian Teachers' Unions (FSGI), bullying cases in schools are on the rise, underscoring the urgency for preventive measures. The campaign will be conducted through lectures using laptops and projectors at several schools in Pesisir Selatan. This program aims to help school communities better understand and take preventive actions against bullying, thereby fostering a safe and conducive learning environment for students.

Abstract

Banyaknya terdapat pencurian data pribadi dalam melakukan transaksi elektronik. Hal ini disebakan karena kurangnya keamanan dari aplikasi E-commerce yang menggunakan data pribadi sebagai syarat pembuatan akun dari aplikasi tersebut Namun, semakin banyaknya kejahatan pencurian alamat pribadi yang dilaksanakan dari orang yang tidak diberi izin untuk mengakses alamat pemakai dan keamanan dari sebuah platform (aplikasi) yang kurang kuat. Oleh karena itu banyak dari para konsumen pengguna E-commerce yang menjadi korban dari kejahatan pecurian data ini. Akibat dari kejahatan ini, para konsumen pengguna aplikasi E-commerce ini mengalami kerugian terhadap tindakan pencurian tersebut. Penelitian ini meggunakan metode yuridis normatif. Dan sifat penelitian mengacu pada penelitian kualitatif-deskriptif. Jenis penelitian kualitatif-deskriptif ini dipilih karena lebih tepat untuk menjelaskan tentang bentuk perlindungan hukum terhadap konsumen dan pertanggungjawaban E-commerce atas pencurian data pribadi. Kesimpulan yang dapat penulis simpulkan adalah bentuk pertahanan hukum terhadap konsumen yang mengalami pemberatan adalah dengan bentuk pertahanan hukum preventif dan represif. Dan pertanggungjawaban E-commerce terhadap konsumen dapat dilakukan dengan cara litigasi yang fungsi dan kewenangannya meliputi menangani dan menyelesaikan perselisihan konsumen melalui jalur hukum.

Abstract

Penelitian ini bertujuan untuk menggambarkan dan memahami pertama,   bagaimana mekanisme pendirian Badan Usaha Milik Nagari (BUMNag) di Nagari Cupak, kecamatan Gunung Talang Kabupaten Solok kedua, bagaimakah peranan Badan Usaha Milik Nagari (BUMNag) dalam peningkatan kesejahteran masyarakat Nagari Cupak Kecamatan Gunug Talang Kabupaten Solok.Penelitian ini memakai metode penelitian yuridis empiris untuk melihat bagaimana mekanisme pendirian BUMnag di Nagari Cupak kecamatan Gunung Talang Kabupaten Solok. Berdasarkan hasil penelitian ini ditemukan Pertama, mekanisme pendirian Badan Usaha Milik Nagari (BUMNag) yang bernama Badan Usaha Milik Nagari Usali di Nagari Cupak Kecamatan Gunung Talang Kabupaten Solok dibentuk melalui musyawarah Nagari dengan dihadiri tokoh-tokoh masyarakat.   BUMNag Usali Cupak telah berperan dalam pemberdayaan masyarakat   dan peningkatan kualitas perokonomian di Nagari Cupak melalui unit usaha pertama Konveksi, keduA Agen BNI/PPOB BNI dan yang ketiga adalah Tabungan Bajapuik atau simpan pinjam. Kegiatan yang ini yang telah memberikan dampak terhadap peningkatan ekonomi masyarakat.

Abstract

Indonesia is in the development stage in all areas, including facilities and infrastructure in the form of construction and rehabilitation of roads, bridges, public housing, office buildings and public facilities. Meanwhile, development in the spiritual sector includes government development in the fields of education, religion, social, culture and politics. The government always strives for development to be carried out in an optimal manner, whether with short-term, medium-term or long-term development.  The desire for a residence is a person's (personal) achievement where it is a personal priority for each individual, some people may consider that the quality of a human's life is incomplete if they do not have a residence or private residence. In this way, a residence or house is not just a place to shelter, but everyone wants their residence/home to have elements of comfort and security, various public and social facilities and adequate facilities and infrastructure. What is an obstacle for every individual here is the limitation in getting ideal housing? Thus, the discussion regarding housing/settlement is of concern to both parties, not just to the dominance of the individual. The parties involved in this include consumers (debtors), developers (developers) and the bank as creditor.

Abstract

Kabupaten Kepulauan Mentawai memiliki risiko tinggi terhadap berbagai bencana alam, termasuk gempa bumi, tsunami, banjir, tanah longsor, gelombang ekstrim, dan kekeringan. Kondisi ini menuntut strategi mitigasi yang adaptif dan berkelanjutan. Pengabdian masyarakat ini bertujuan mendampingi pemerintah desa dan masyarakat dalam mengintegrasikan Pengurangan Risiko Bencana (PRB) dan Adaptasi Perubahan Iklim (API) ke dalam dokumen perencanaan desa (RPJMDes dan RKPDes). Metode yang digunakan berbasis partisipatif, meliputi sosialisasi, pelatihan, pemetaan risiko, penyusunan Rencana Aksi Komunitas (RAK), dan fasilitasi integrasi ke dokumen perencanaan. Hasil menunjukkan peningkatan pemahaman masyarakat terhadap potensi risiko, kemampuan menyusun rencana mitigasi dan adaptasi sesuai kondisi lokal, serta penguatan kapasitas desa menghadapi bencana. Temuan ini menegaskan pentingnya integrasi PRB dan API untuk membangun desa yang tangguh, adaptif, dan berkelanjutan.

Abstract

This article analyzes the setting of very high interest rates on information technology-based lending and borrowing services by the Indonesian Funding Fintech Association (AFPI). AFPI was given self-regulating authority by the OJK (Financial Services Authority) to determine loan interest rates which caused disproportionate positions between borrowers and lenders. This research aims to answer problems in terms of the substance of fintech peer to peer lending regulations in Indonesia, so a comprehensive analysis is needed from the perspective of statutory regulations and conceptually so that legal protection can be achieved for the public, especially borrowers. The results of this research show that the unequal position of the parties in fintech agreements is due to a lack of understanding of the principle of complete freedom of contract. The application of the principle of freedom of contract in fintech can be said to be not optimal and still applies artificially due to the urgent interests of borrowers who are in a weak position where urgent needs are forced to agree to agreements with high interest rates. It is necessary to limit the principle of freedom of contract because it has an impact on injustice and in the public interest it is necessary to break through public law into civil law. Apart from that, it is necessary to strengthen the Pancasila economic system again because it is in accordance with the identity of the Indonesian nation. Apart from that, the law must be a determinant of the economy, not as an instrument to support the economic system, thus causing the economy to be more determinant over the law.

Abstract

The position of witnesses is very important in the trial process because witnesses provide proof of the guilt of the suspect and defendant based on what they saw and experienced. A justice collaborator is a person who is a witness to a criminal act and collaborates with the main perpetrator. If one of the perpetrators of a particular criminal act admits what was done but is not the main perpetrator of the action, they provide information as a witness in the criminal trial. The problems that will be discussed in this research are what is the position of Justice Collaborator in Indonesian criminal law, what is the urgency of Richard Eliezer as Justice Collaborator in the criminal case of the shooting of Joshua Hutabarat (analysis of decision Number: 789/Pid.B/ 2022/PN. Jkt.Sel ). In carrying out this research the author used a method that can answer the problem formulation in this research, namely qualitative with a normative juridical approach. In several cases, the judge handling the Justice Collaborator referred to the Supreme Court Circular No. 04 of 2011 concerning handling Justice Collaborators in certain criminal cases, or SEMA No. 04 of 2011. Protection Regulations carry out protective actions and cooperate with justice. Whistleblowers cannot be prosecuted criminally or civilly for reports or statements made, made, or have been made. However, witnesses cannot be acquitted of criminal charges in the same case if their guilt is clearly proven in court. Because of his testimony, the judge was able to reduce the sentence. The Justice Collaborator is currently regulated by law. The Justice Collaborator is essential to organizing an orderly system of justice and providing effective enforcement and protection for those who are or will be witnesses. It also plays an important role in preventing criminal activity by achieving goals, fostering trust, fostering respect, and encouraging legal cooperation. Supreme Court Circular No. 4 (SEMA) of 2011 states that the government must be involved in investigating cases of witnesses and victims, emphasizing that the idea of justice collaborators is based on the belief that people who are punished for their actions can be used to ensure justice in criminal cases.

Abstract

The dominance of foreign digital platforms in the application ecosystem within Indonesia poses significant implications for the sovereignty of the Indonesian state; the utilization of such foreign digital technologies results in the inadvertent surrender and delegation of citizen data to foreign entities for monitoring and processing purposes. This phenomenon has elicited concern among legal scholars, as the usage of foreign applications signifies the applicability of the legal frameworks from the countries of origin of these applications. This raises critical questions regarding the sovereignty of the Indonesian state, particularly concerning its ability to exert control over data and cyberspace in the context of global platforms. The methodological approach employed in this investigation is grounded in normative legal research, utilizing a conceptual framework that examines relevant legal statutes. The aggregation and distribution of personal data constitutes an infringement upon individual privacy rights, as the right to privacy inherently encompasses the prerogative to determine the provision of personal information. The strategic policies and initiatives undertaken by the Indonesian government to bolster national digital sovereignty can be realized through several measures: the implementation of comprehensive personal data protection standards to enhance national digital sovereignty, the establishment of an independent authority for personal data protection, the fortification of cybersecurity measures to mitigate data security risks, and the jurisdictional enforcement of cyberspace law towards achieving digital economic sovereignty. There exists a pressing need for extensive regulatory frameworks to safeguard personal data as an integral component of human rights. A balance must be struck in the management of personal data processing, ensuring the protection of rights and fostering awareness among data subjects, thereby facilitating the development of a secure digital economic ecosystem that offers legal certainty for enterprises and enhances consumer confidence. Furthermore, the establishment of equitable international personal data protection regulations is essential to support the advancement of the digital economy through arrangements governing cross-border data flow.

Abstract

Domestic neglect is a serious offense that harms family members who depend on the abuser to meet their basic needs. Law Number 23 of 2004 concerning the Elimination of Domestic Violence (UU PKDRT) regulates this action in Indonesian criminal law. To uphold justice and provide protection to victims, judges must apply the law against perpetrators of domestic neglect. In this article, we focus on the judicial process, the imposition of prison sentences, and the impact of the judge's decision on family neglect from a criminal law perspective. The judge examines evidence and witness statements thoroughly during the trial process to ensure that all elements of the criminal act of neglect are met. The aim of imposing a prison sentence is to punish the perpetrator, protect the victim from threats, and uphold justice. However, imposing a prison sentence can also have negative impacts on victims, including economic, psychological and social pressure. To reduce these negative effects, mitigation measures are needed which include economic assistance, psychological support, child protection, education and public awareness, as well as rehabilitation of perpetrators. To do this, governments, local communities and non-governmental organizations (NGOs) must work together. As a result, judges can take effective legal action against perpetrators of domestic neglect, providing justice, and ensuring that victims are protected and rehabilitated as best as possible.
