Abstract

The Faculty of Law at Dharma Andalas University will conduct a community service activity in the form of a legal education campaign focusing on "Stop Bullying" to create a bullying-free school environment. This campaign aims to raise awareness about bullying, which is a repetitive aggressive behavior intended to harm or weaken individuals who are physically or mentally weaker. Bullying can occur physically, verbally, socially, or even online. According to data from the Indonesian Child Protection Commission (KPAI) and the Federation of Indonesian Teachers' Unions (FSGI), bullying cases in schools are on the rise, underscoring the urgency for preventive measures. The campaign will be conducted through lectures using laptops and projectors at several schools in Pesisir Selatan. This program aims to help school communities better understand and take preventive actions against bullying, thereby fostering a safe and conducive learning environment for students.

Abstract

The Head of Village’s office work of only six years is considered too short, so elected village heads often do not have enough time to complete development plans in their villages. It is hoped that extending the Village Head's term of office to 9 years will increase the effectiveness of development and community welfare. On the other hand, extending the term of office is considered inconsistent with the spirit of democracy and the principles of the rule of law. This research aims to find out the legal regulations related to the position of village head and the urgency of extending the work of village head from a legal perspective and democratic theory. The author utilizes qualitative research methods with a normative juridical approach to explain the questions asked. The development of policies governing the term of office of village heads in Indonesia reflects changes in the structure of the village government. The discourse on increasing the term of office of village heads to nine years raises profound questions about the balance between leadership stability and the essence of democracy in the context of village government in Indonesia. Extending the term of office of village heads is not in line with the spirit of democracy and can open up space for developing oligarchy at the village level. Limiting power and limiting terms of office are the main principles for preventing abuse and maintaining balance in government.

Abstract

Penyelenggaraan Pemerintah Desa sudah berlangsung hampir sepuluh tahun sejak disahkanya UU Desa dan pemerintahpun sudah mengucurkan Dana Desa sejak tahun 2015, yang terus mengalami peningkatan. Posisi strategis dalam mengelola dana desa dalam jumlah besar mendorong minat warga desa untuk menjadi kepala desa, namun apakah setiap warga desa memiliki kesempatan yang sama untuk menjadi Kepala Desa, sebut saja seseorang PNS, apakah dapat berpartisipasi dalam pilkades, karena akan berpotensi dualisme atau rangkap jabatan jika terpilih. Fokus penelitian ini adalah: Pertama, melihat bagaimana pengaturan hukum tentang kedudukan kepala desa; Kedua, apakah ASN dapat berpartisipasi dalam pemilihan kepala desa. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana pengaturan hukum tentang kedudukan kepala desa dan untuk mengetahui dapatkah ASN dapat berpartisipasi dalam pemilihan kepala desa.

Abstract

The rapid advancement in technology and infomation has transformed human life paradigms, shifting conventional activities into digital realms through various technological devices. However, alongside technological progress, personal data has become increasingly vulnerable to misuse and privacy violations. The protection of personal data is considered a fundamental human right that must be guaranteed and respected. Although the Personal Data Protection Law has been enacted, its implementation faces various challenges such as data theft, fraud, data selling, and leaks managed by the government for public services. Therefore, this research examines how the government manages the protection and utilization of personal data in public services and the participation of the community in personal data protection. To address these questions, the author employs a qualitative writing method with a normative juridical approach. Law Number 27 of 2022 concerning Personal Data Protection provides a robust legal framework to safeguard individual data and ensure legal certainty for data controllers. Satu Data Indonesia plays a role in integrating data to enhance public service efficiency and ensure data security. However, the implementation and improvement of data protection systems are still necessary. Active participation from the government, data controllers, data owners, law enforcement agencies, as well as digital literacy education and regulatory strengthening, are expected to enhance security and public trust in managing personal data in the digital era.

Abstract

Media sosial telah menjadi bagian tak terpisahkan dari kehidupan remaja, termasuk siswa SMP. Meskipun memiliki berbagai manfaat, media sosial juga membawa dampak negatif, seperti penurunan konsentrasi belajar, risiko kecanduan, dan paparan informasi yang tidak sesuai. Penelitian ini bertujuan untuk meningkatkan kesadaran siswa SMP Kartika terhadap dampak media sosial melalui kegiatan sosialisasi yang terstruktur. Metode yang digunakan adalah pendekatan kuantitatif deskriptif dengan melibatkan 100 siswa sebagai sampel. Kegiatan sosialisasi dilakukan melalui ceramah interaktif, diskusi kelompok, dan penyebaran materi edukasi. Hasil penelitian menunjukkan adanya peningkatan pemahaman siswa terhadap dampak media sosial, yang diukur melalui pre-test dan post-test. Rata-rata nilai kesadaran siswa meningkat sebesar 35%. Temuan ini menunjukkan bahwa sosialisasi dapat menjadi strategi efektif dalam meningkatkan kesadaran siswa terkait penggunaan media sosial yang bijak.

Abstract

Kabupaten Kepulauan Mentawai memiliki risiko tinggi terhadap berbagai bencana alam, termasuk gempa bumi, tsunami, banjir, tanah longsor, gelombang ekstrim, dan kekeringan. Kondisi ini menuntut strategi mitigasi yang adaptif dan berkelanjutan. Pengabdian masyarakat ini bertujuan mendampingi pemerintah desa dan masyarakat dalam mengintegrasikan Pengurangan Risiko Bencana (PRB) dan Adaptasi Perubahan Iklim (API) ke dalam dokumen perencanaan desa (RPJMDes dan RKPDes). Metode yang digunakan berbasis partisipatif, meliputi sosialisasi, pelatihan, pemetaan risiko, penyusunan Rencana Aksi Komunitas (RAK), dan fasilitasi integrasi ke dokumen perencanaan. Hasil menunjukkan peningkatan pemahaman masyarakat terhadap potensi risiko, kemampuan menyusun rencana mitigasi dan adaptasi sesuai kondisi lokal, serta penguatan kapasitas desa menghadapi bencana. Temuan ini menegaskan pentingnya integrasi PRB dan API untuk membangun desa yang tangguh, adaptif, dan berkelanjutan.

Abstract

The implementation of democracy in Indonesia is a mandate from the provisions of Article 2 paragraph (1) and Article 6A paragraph (1) of the 1945 Constitution of the Republic of Indonesia, where one of the indicators is general elections. However, the implementation of general elections is often overshadowed by the presence of family members of powerful politicians running for general elections and succeeding, including the elections for president, governor, regent, and others. This condition can trigger much debate and concern about democracy, the quality of elections, and political stability in Indonesia. Nevertheless, the right to elect and to be elected are protected rights and their existence is recognized by the constitution. The limitations of the problem in this paper include: 1) Political dynasty in the perspective of democracy; 2) Political dynasty in the perspective of democracy and citizens' rights in elections in Indonesia. This research used a normative juridical approach by using secondary data in the form of literature studies so that the conclusions are obtained that: a) political dynasty is contrary to democratic principles that emphasize transparency, accountability, and fair participation; b) although the regulations have been set up to protect citizens' rights to elect and be elected, the rise of political dynasty shows incompatibility with democratic principles. It is difficult to avoid political dynasty in a democracy, but efforts are needed to maintain balance and avoid abuse of power by the ruling family.

Abstract

Taxation, as a fundamental component of the system of cooperation, serves as a financial resource to underpin governmental financing and expenditure while also acting as an instrument for the regulation of social and economic policies aimed at promoting equitable welfare. The process of tax collection occasionally engenders inequities for taxpayers; consequently, Law 14 of 2002 instituted the Tax Court as an autonomous judicial entity designated for the adjudication of tax-related disputes. Notwithstanding its establishment, the Tax Court encounters significant challenges, notably the dualism of authority wherein the Supreme Court provides technical guidance. At the same time, the Ministry of Finance oversees organizational, administrative, and financial directives. In the Constitutional Court's Decision (MK) Number 26/PUU-XXI/2023, the regulation pertaining to the oversight of the Tax Court was deemed inconsistent with Article 24, paragraphs (1) and (2) of the 1945 Constitution, prompting the Constitutional Court to impose a deadline of December 31, 2026, for the consolidation of the Tax Court's guidance authority under the auspices of the Supreme Court. Consequently, this research endeavours to scrutinize the role and prospective trajectory of the Tax Court alongside the measures necessary to effectuate the transfer of guidance authority in alignment with constitutional mandates. Hence, the author has entitled this study "Measuring the Role and Future of the Tax Court after the Constitutional Court Decision Number 26/PUU-XXI/2023." The questions posed for investigation are: What is the Role and Position of the Tax Court as delineated by the Tax Court Law, and what is the Role and Future of the Tax Court subsequent to the Constitutional Court Decision (Number 26/PUU-XXI/2023)? To address these inquiries, the author employs a qualitative writing methodology complemented by a normative legal perspective.

Abstract

The controversy surrounding the authenticity of President Joko Widodo's diploma has sparked a legal debate regarding the status of the diploma as personal data or public information. Diplomas contain identity information protected by Law Number 27 of 2022 concerning Personal Data Protection (PDP Law). Still, as documents related to public office, diplomas can also be considered relevant information for the public interest under Law Number 14 of 2008 concerning Public Information Disclosure (KIP Law). This study examines the legal status of diplomas about personal data protection and public information disclosure, employing normative legal research methods. The results indicate that diplomas are considered general personal data under the PDP Law, so their dissemination requires the consent of the owner. However, the KIP Law regulates limited access to diploma information when it relates to public office. Therefore, a balance is needed between protecting individual privacy and ensuring transparency of information in state administration.
