Abstract

Proof of ownership of a plot of land is proven by the existence of a certificate and physical control so that if these two things are destroyed, the legal relationship between the owner and the land ends. There are several causes for the end of a person's land rights, one of which is that the land object has been destroyed due to a natural disaster. Because the term "destroyed land" is used in Article 27 of the UUPA, which refers to the abolition of land rights, the state is unable to provide legal protection for destroyed land, which results in a legal void. A normative legal research approach with a statutory approach was used for the study. The result of this study is a discussion of the form of legal protection by the National Land Agency regarding the reownership of land rights whose land has been lost due to natural disasters. Land rights holders can submit a report to the land service emergency response posts to report complaints of lost or damaged certificates due to natural disasters, and then the Land Office will conduct field research as the basis for issuing a replacement certificate.

Abstract

This research was conducted with the aim of exploring the rights and obligations of grantors in revoking a grant, the legal impact on grant recipients who experience grant revocation, and analyzing the compatibility of Decision No. 33/Pdt.G/2019/PN.Pms of the Pematangsiantar District Court with the prevailing laws and regulations. This research used a normative legal approach and was descriptive in nature. The data collection methods used were library research and document analysis. Data analysis was conducted using qualitative analysis methods. The results of the research indicate that grantors have several rights based on Article 1669, Article 1671, and Article 1672 of the Civil Code and Article 212 of the Islamic Inheritance Law (KHI). Grantors also have the right to revoke their grant if the grant recipient fails to fulfill the obligations stipulated in the grant deed or other conditions specified in Article 1688 of the Civil Code. The legal impact on grant recipients who experience grant revocation is the return of the granted object to its original state before the agreement was made, as regulated by Article 1691 of the Civil Code. However, according to Article 212 of the KHI, a grant cannot be revoked, except in the case of a grant from a parent to their child, and this must be supported by a legally binding court decision. Based on the analysis of Decision No. 33/Pdt.G/2019/PN.Pms of the Pematangsiantar District Court, it can be concluded that the decision is in accordance with the prevailing laws and regulations.

Abstract

Dalam penelitian ini dibahas bagaimana penandatanganan kontrak secara elektronik semakin populer di era digital saat ini. Legalitas dan keberlakuan perjanjian yang ditandatangani secara online masih diperdebatkan. untuk menyelidiki apakah (1) Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan UU ITE (Undang-Undang Informasi dan Transaksi Elektronik) dapat digunakan untuk mendukung pelaksanaan penandatanganan perjanjian digital, (2) bagaimana konsumen memandang perlindungan dan kepastian hukum dalam perjanjian elektronik, (3) dan apakah notaris dapat memasukkan tanda tangan digital ke dalam akta autentik. Dalam studi masalah semacam ini, metode yuridis normatif digunakan untuk menganalisis data sekunder seperti undang-undang, peraturan, dan dokumen hukum lainnya serta temuan penelitian, kajian, dan referensi lain yang relevan dengan masalah. Tanda tangan digital perjanjian diizinkan oleh kedua undang-undang. UU ITE mengatur tanda tangan elektronik yang sama-sama dapat dipercaya seperti tanda tangan konvensional. KUH Perdata juga memungkinkan para pihak untuk memilih struktur perjanjian, termasuk yang elektronik. menunjukkan upaya sungguh-sungguh pemerintah untuk melindungi konsumen dalam transaksi elektronik, selain fakta bahwa tanda tangan digital memberikan kekuatan hukum untuk kontrak elektronik. Hal ini mengindikasikan upaya tulus pemerintah untuk melindungi konsumen dalam transaksi elektronik.

Abstract

Terdapat beberapa aturan yang berlaku di Indonesia mengenai pengangkatan anak, diantaranya adalah hukum nasional Indonesia, hukum Islam, dan hukum adat. Pada hukum adat Bali, anak yang diangkat melalui upacara widi widana memiliki kedudukan yang sama dengan anak kandung, anak angkat tersebut berhak mendapatkan warisan. Penelitian ini menggunakan metode Hukum Empiris, metode Hukum Empris merupakan suatu metode penilitian hukum yang menggunakan fakta-fakta empiris yang diambil dari perilaku manusia, baik perilaku verbal yang didapat dari wawancara maupun perilaku nyata yang dilakukan melalui pengamatan langsung. Hasil penelitian ini menunjukan bahwa terdapat anak yang kehilangan haknya untuk mendapatkan warisan diantaranya adalah anak yang ninggal kedaton sehingga meninggalkan tanggung jawab karena kawin ke luar, diangkat anak, dianggap durhaka dan dipecat kedudukannya sebagai anak oleh orang tuanya (pegat mapianak), sengaja meninggalkan tanggung jawab keluarga dan masyarakat (ngutang kawitan) tanpa diketahui alamatnya (ngumbang), dan pindah agama.

Abstract

Perjanjian perkawinan memegang peranan penting dalam mengatur pembagian harta bersama antara suami dan istri jika terjadi perceraian atau kematian, sebagaimana diatur dalam Pasal 29 Undang-Undang Nomor 1 Tahun 1974. Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 memperluas cakupan perjanjian perkawinan, yaitu dibuat saat masih dalam ikatan perkawinan, dengan tujuan untuk melindungi hak-hak suami istri dan menghindari kerugian bagi pihak ketiga. Penelitian ini merupakan studi pustaka yang dilakukan dengan cara membaca buku-buku, naskah, dokumen, jurnal, dan sumber-sumber terkait lainnya. Dalam menganalisis perjanjian perkawinan pasca putusan Mahkamah Konstitusi, peneliti menggunakan pendekatan perundang-undangan dan pendekatan historis. Analisis diawali dengan menggunakan peraturan perundang-undangan sebagai landasan utama, dengan mempertimbangkan karakteristiknya yang komprehensif dan sistematis. Tujuan penelitian ini adalah untuk memahami secara mendalam makna hukum perjanjian perkawinan dari perspektif hukum Islam dan hukum positif di Indonesia, serta untuk mengkaji perlindungan hukum bagi pihak ketiga akibat adanya perjanjian pasca perkawinan. Perkawinan sebagai ikatan lahir batin antara seorang pria dan seorang wanita merupakan landasan untuk membentuk keluarga bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Namun, menghadapi dinamika kompleksitas perkawinan dan kemungkinan perubahan di masa mendatang, pasangan suami istri membutuhkan kepastian yang jelas mengenai hak dan kewajibannya. Dalam konteks ini, perjanjian perkawinan menjadi instrumen yang menjamin kejelasan dan perlindungan hukum bagi pasangan suami istri, memastikan adanya aturan yang jelas tentang bagaimana aset dan kewajiban akan diatur dalam berbagai situasi. Diharapkan hasil penelitian ini dapat membantu pasangan suami istri untuk membuat perjanjian perkawinan di hadapan notaris dengan mempertimbangkan keterlibatan pihak ketiga dalam pemisahan harta bersama sebagaimana tercantum dalam akta perjanjian perkawinan.

Abstract

In the era of electronic technology advancement, the concept of cyber notary has challenged the traditional legal framework in making authentic deeds digitally. Updating legal regulations is crucial to ensure that Notary actions in the electronic sphere remain authentic in accordance with the times. Enforcing the validity of legal documents in the electronic context faces challenges, especially in terms of proving their validity and legitimacy in court. In court, legal regulations regulate the procedures for disclosing relevant facts, with valid evidence and special procedures playing an important role. The government has enacted regulations related to Electronic Information and Transactions, although security and regulatory issues are still a concern. The implementation of cyber notary in Indonesia faces a series of problems including the lack of comprehensive regulations, data security challenges, and technological and infrastructure readiness. However, the amendments to Law Number 2 of 2014 concerning the Position of Notary and Law Number 1 of 2024 concerning the amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions provide an important legal basis. Notaries in the provisions of Indonesian civil law have guidelines in the practice of authentic deeds, which are recognized as binding legal evidence and/or can be directly implemented without going through a court and are the final decision that binds all parties to follow it. However, the challenges in facing the implementation of cyber notary in Indonesia, including the lack of specific regulations, data security issues, technological readiness, and social and cultural constraints require joint efforts from the government, related institutions, and the community to create clear regulations, improve data security, and increase public awareness of the benefits and procedures of cyber notary. By overcoming these problems, it is hoped that it can increase the trust and effectiveness of the cyber notary system in Indonesia.

Abstract

Technological advances are increasingly developing every year, bringing impacts to all aspects, especially in the field of notary. One of them is the concept of Cyber Notary which uses electronic media in every act, while the field of notary has not regulated this, therefore this condition requires further research. The problem taken in this study is whether the deed remains an authentic deed if using the Cyber Notary concept based on the Notary Law and the Electronic Information and Technology Law and solutions to deal with digital developments for Notaries when making deeds. This study uses descriptive Normative Law Research. The results of this study indicate that according to Law Number 2 of 2014 concerning the Notary, basically the concept cannot be applied because based on Article 16 paragraph 1 letter m it stipulates that after the deed is read in front of the parties, witnesses and Notary, the deed is signed at that time, therefore in this case it is necessary to have harmonization between the Notary Law and the Law on Information and Electronic Transactions.

Abstract

In the context of marriage in Indonesia, the term "Prenuptial Agreement" is recognized as an important legal instrument that regulates the rights and obligations between husband and wife before a marriage takes place. This instrument is designed to protect the individual economic interests of each spouse by specifically arranging both premarital assets and assets acquired during the marriage. This study aims to analyze the legal framework regarding prenuptial agreements in Indonesia and its role in post-marital life, particularly concerning asset division, dispute resolution, and protection of the economic rights of spouses. It also assesses the extent to which the current legal framework is adequate in addressing increasingly complex social and economic changes, and how the implementation of prenuptial agreements is applied in Indonesia. This study examines the relevant legal provisions through a normative juridical research method. The findings show that prenuptial agreements have legitimate legal force and are recognized by the state. These agreements provide legal security for couples in terms of asset distribution and financial obligations and can minimize potential disputes in the future. Additionally, prenuptial agreements serve as a preventive instrument that protects each party's financial interests. Substantively, the effectiveness of prenuptial agreements is influenced by clear and fair provisions concerning the rights and obligations of the spouses. Structurally, the agreement must be drafted and executed in compliance with applicable legal requirements. With a well-structured prenuptial agreement, couples can obtain optimal legal protection, thereby minimizing the potential for conflicts regarding economic rights within marriage.

Abstract

This article aims to provide an objective explanation of the legal protection afforded to buyers who intend to transfer rights to land that is jointly owned without the wife's consent. In 2012, the late Haryanto sold the land to PT. Makmur Persada Indonesia conducted the transaction as recorded in Sale and Purchase Deed No. 53/2012, prepared by Notary/Land Deed Maker Hj. Hasnawati Juweni Shande. In 2017, Sherly initiated legal action asserting that the deed for the land sold by the deceased Haryanto reflected joint ownership resulting from his marriage to Sherly; yet, the relevant sale and purchase transaction occurred without Sherly's involvement despite her rights to the property. Normative research was conducted utilising a statutory, conceptual, and case approach. The research specifically analysed secondary data, comprising primary and secondary legal materials, which was analysed descriptively. In relation to Sherly's lawsuit, the Serang District Court issued decision Number 39/Pdt. Srg, which resulted in the rejection of the plaintiff's application. Subsequently, the plaintiff lodged an appeal against the Serang Court's decision. In 2018, Decision Number 39/Pdt/2018/PT BTN of the Banten High Court upheld the Serang District Court's decision to reject the applicant's claim entirely. The Supreme Court confirmed this judgement in 2019 with Judicial Review Decision Number 227K/Pdt/2019, thus dismissing the plaintiff's lawsuit. Thus, it seems that the verdict of dismissing the plaintiff's application safeguards the buyer.

Abstract

The transfer of receivables (cession) in mortgage loan agreements without prior notice to the debtor has led to legal uncertainty and poses a risk of harm to debtors acting in good faith. This study aims to analyze the legal standing of debtors in cases of cession conducted without notification, as well as to identify forms of legal protection available to such debtors. The research adopts a normative juridical approach, relying on the analysis of statutory regulations and a case study of the Tangerang District Court Decision No. 1238/Pdt.G/2022/PNTng. The findings indicate that although Article 613 of the Indonesian Civil Code requires notification to the debtor in the event of cession, the absence of sanctions for creditors who fail to comply allows the practice of transferring receivables without debtor notification to persist. As a result, debtors are often exposed to the risks of double payment or being considered in default by the new creditor. This research recommends strengthening regulations concerning the mandatory notification of cession and encouraging the active role of financial authorities in ensuring transparency and protection for debtors. The implications of this study underscore the need for legal reform to establish a fairer and more legally certain system for the transfer of receivables.
