Abstract

This study aimed to determine the negotiation model and system of tourism partnership between the local government and the private sector to develop the “Wisata Bahari Lamongan” (WBL). This research used the qualitative method and negotiation theory part of public diplomacy. This research found that the negotiation and collaboration system used was the Public-Private partnership model with a built/operate/transfer (BOT) system. The private sector was allowed to build tourism facilities according to specified specifications. Then, the facility was built and operated by a private party for 25 years. After the period ended, Wisata Bahari Lamongan ownership was transferred to the local government.

Abstract

Abstract How should the protection of privacy and personal data in Indonesia be responsive to anticipate changing trends from the traditional economic era to the digital economic era? Rapidly developing information and communication technology is changing the way people run business and/or carry out transactions. Thus, transactions which are known as "e-transaction", "e-commerce" and "e-business" have emerged. Indonesia is now in the era of the digital economy. This claim is supported by the condition of Indonesian society which makes the internet and cell phones a commodity, and these commodities are used by traders and sellers to signify electronic transactions via the internet network. This requires that the laws governing these activities can follow or even anticipate developments into the Digital Economy Era.

Abstract

Sekaran Village in overcoming the waste problem by forming TPS3R. An alternative to overcome this waste problem is cultivating maggot, which is used as fodder for chickens and catfish. This study aims to examine the effect of consumer perceptions on chicken and catfish purchasing decisions as a result of feeding maggots. The subject of this research is the people of Sekaran Village, with a sample of 100 people. The analysis used in this study uses index transformation analysis and partial t-test using SPSS 23. The analysis results of individual factor index transformation are 70.73%, stimulus factor is 71.58%, attitude is 55.23%, interest is 71.58%, and motivation is 69.46%. Based on the partial t-test analysis results, the individual factor indicator has a value of 6,930 > 1,985. The stimulus factor indicator has a value of 2,804 > 1,985. The attitude indicator is 4,785 >1,985, the interest indicator is 7,320 > 1,985, and the motivations are 6,184 > 1,985. Keywords: consumer perception, decision purchase, maggot BSF, TPS3R

Abstract

Abstract Collaboration between actors is needed for deradicalization programs, not only between institutional (institutional) actors but actors outside institutions need to be involved in the deradicalization process as a form of national resilience. This article discusses the involvement of former terrorist convicts (Napiters) who are members of the Circle of Peace Foundation (YLP) and the TNI (Indonesian National Army) in efforts to deradicalize the process through the TNI Manunggal Pembangunan Desa (TMMD) program. This research was conducted with the object of ex-terrorist convicts by conducting interviews, documentation studies, and observations. The analysis of this research uses a collaborative governance theory approach as an analytical knife with qualitative research methods. Keywords: Actor collaboration, TNI, former terrorist convicts, deradicalization Abstrak Kolaborasi antar aktor diperlukan untuk program deradikalisasi, tidak hanya antar aktor institusional (kelembagaan) tetapi aktor diluar kelembagaan perlu dilibatkan untuk proses deradikalisasi sebagai wujud ketahanan nasional. Tulisan ini membahas tentang pelibatan mantan narapidana teroris (Napiter) yang tergabung dalam Yayasan Lingkar Perdamaian (YLP) dan TNI (Tentara Nasional Indonesia) dalam upaya proses deradikalisasi melalui program TNI Manunggal Membangun Desa (TMMD). Penelitian ini dilakukan dengan obyek mantan narapidana teroris dengan melakukan wawancara, studi dokumentasi dan observasi. Analisa penelitian ini dengan pendekatan teori collaborative governance sebagai pisau analisis dengan metode penelitian kualitatif. Dari penelitian ini ditemukan bahwa sinergitas antara TNI dengan mantan narapidana teroris harus secara terpadu dan terintegrasi untuk proses deradikalisasi melalui program pelaksanaan TMMD sehingga terwujudnya ketahanan nasional. Kata kunci: Kolaborasi aktor, TNI, mantan narapidana teroris, deradikalisasi.

Abstract

ABSTRACT According to Law Number 20 of 2016 concerning Trademarks and Geographical Indications, brand owners must register their brands with the Directorate General of Intellectual Property in order to maintain healthy, fair business competition and obtain legal protection. Based on the background above, the author proposes a problem formulation, namely how is the legal protection for brand rights holders according to Law Number 20 of 2016 concerning Trademarks and Geographical Indications? This research method uses a normative legal research type, with a statute approach. The legal materials used are primary legal materials which include: Law Number 20 of 2016 concerning Trademarks and Geographical Indications and Law Number 8 of 1999 concerning Consumer Protection. From the results of the study, it can be concluded that legal protection of brand rights has been regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The law explains that brands will get their rights to obtain protection and legal certainty on the condition that the brand must be registered first. If an irresponsible party is found using another person's brand without the knowledge and permission of the original owner of the brand, then this is included in brand imitation. The parties who do this can be threatened with criminal or civil charges.

Abstract

ABSTRACT The management of village funds needs to be assisted so that they are used according to the rules. The problem formulation is: What is the Accountability of the Village Head in Using the Village Fund Allocation? Management of Village Fund Allocations is regulated in Law Number 3 of 2024 concerning the Second Amendment to Law Number 6 of 2014 concerning Villages. The realization of the Implementation of Village Fund Allocations is reported in each fiscal year no later than 3 (three) months after the fiscal year ends along with the APBDesa Accountability to the Regent through the Subdistrict Head. Apart from the administration and implementation aspect, there is criminal legal liability in the management of Village Fund Allocations related to misuse of Village Fund Allocations by the Village Head, which can occur because of not following the Budget Plan or because of the Village Head's behavior and lifestyle which causes state losses.

Abstract

ABSTRACT Land disputes in Indonesia, including in Tlogoreto Village, are complex and often protracted problems when resolved through conventional litigation. The lengthy and costly legal process makes alternative approaches, such as Restorative Justice, an increasingly relevant solution. Restorative Justice emphasizes the restoration of relations between the parties to the dispute through dialogue and mutual agreement. In this context, the restorative approach is expected to be able to provide a more effective and harmonious settlement of land disputes in Tlogoreto Village. This study uses a normative juridical method with an analysis of applicable laws and regulations, as well as legal doctrines related to land dispute resolution and the application of Restorative Justice. The Restorative Justice approach in resolving land disputes in Tlogoreto Village focuses on mediation involving all parties to the dispute, as well as community leaders as mediators. This process aims to reach a fair agreement for all parties, by prioritizing the restoration of social relations. The analysis shows that the application of Restorative Justice is more effective in reducing tensions and producing sustainable solutions than resolving disputes through the courts. However, the challenge in applying this method lies in the lack of public understanding of Restorative Justice and the limited formal recognition of the results. Restorative Justice offers an alternative to resolving land disputes that is faster, cheaper, and able to improve relations between the parties to the dispute in Tlogoreto Village. This approach is in line with the principle of restorative justice which focuses on recovery rather than punishment. Although its application has not yet been fully formally recognized in Indonesia's legal system, Restorative Justice can be an important step in land dispute settlement reform, especially at the local level.
