Abstract

The early-stage legal awareness village program is an effort to enhance public legal awareness, particularly in Simpang Naneng Village, Karusen Janang District, East Barito Regency. This program aims to build community understanding of laws and citizens' rights to create an orderly and law-abiding environment. The methods used include legal socialization, group discussions, and practical training. The program's results indicate increased legal awareness and active participation in daily legal compliance. This initiative is expected to serve as a community empowerment model supporting sustainable and equitable village development.

Abstract

Lembaga Perlindungan Saksi dan Korban (LPSK) memiliki peranan yang cukup penting dalam sistem peradilan pidana di Indonesia, terutama dalam memberikan perlindungan terhadap saksi dan korban tindak pidana. LPSK yang diatur dalam UU PSK berfungsi untuk memastikan saksi dan korban dapat memberikan keterangan tanpa rasa takut dan memastikan hak-hak mereka terlindungi. Namun, meskipun telah memiliki kewenangan yang diatur dalam UU tersebut, LPSK menghadapi sejumlah tantangan hukum dalam menjalankan tugasnya. Beberapa kendala utama yang dihadapi LPSK antara lain adalah kurangnya kepastian hukum mengenai perlindungan saksi dan korban, ketidakjelasan kewenangan dalam implementasi putusan hakim, serta kurangnya pengaturan perlindungan terhadap whistleblower dan justice collaborator (JC). Ketidakjelasan dalam kewenangan serta kurangnya pengaturan yang lebih rinci dalam UU PSK menyebabkan kesulitan bagi LPSK dalam memberikan perlindungan yang maksimal. Selain itu, tantangan dalam koordinasi antara lembaga penegak hukum lainnya serta kebutuhan untuk meningkatkan kapasitas kelembagaan LPSK menjadi isu yang perlu segera ditangani. Diperlukan revisi terhadap UU PSK untuk memperjelas kewenangan LPSK, memperkuat perlindungan bagi saksi dan korban, serta memastikan hak-hak dari saksi dan korban terlindungi secara lebih efektif. LPSK harus bekerja lebih intensif dengan lembaga terkait, meningkatkan sumber daya manusia, dan merumuskan kebijakan perlindungan yang lebih terperinci untuk menghadapi tantangannya

Abstract

Sexual violence remains a pressing concern in Indonesia, with thousands of cases reported annually, yet only a fraction proceed to trial due to the withdrawal of reports by victims. This study investigates the factors that influence survivors of sexual violence to withdraw their legal complaints, and the subsequent impact on the legal process, particularly within the jurisdiction of the Central Kalimantan Regional Police. Employing an empirical juridical research method, this study collects data through in-depth interviews with survivors, police officers, and representatives from victim support institutions. The findings reveal that social stigma, fear of retaliation, distrust in the legal system, and insufficient legal or psychological support often lead victims to abandon legal proceedings. Despite the legal framework provided by Law No. 12 of 2022 on Criminal Sexual Violence, procedural barriers such as evidentiary requirements and inconsistent application of victim protection laws persist. The research underscores the need for a stronger integration of legal support mechanisms, survivor-focused policies, and community education to ensure justice. These findings contribute to understanding the real-world limitations of the TPKS Law's implementation and call for systemic reforms to support victims more effectively.

Abstract

Criminal liability against loan collectors who commit murder as a form of forced defense due to threats from borrowers. This study is motivated by the importance of legal protection for individuals who commit acts of self-defense in urgent situations, especially in the context of debt relations. The method used is normative juridical with statutory, conceptual, and comparative approaches. The results of the study show that acts of self-defense and forced defense that exceed the limit (noodweer excess) can be legally justified if they meet the elements of instantaneous attack, against the law, and proportional and forced action. In the case of loan collectors who are actually threatened, as in the case of MZ and AR, self-defense can be a reason for criminal expungement if it is proven that there is no intention to kill and the action is carried out under psychological pressure. Fair law enforcement requires careful analysis of the evidence, the psychological condition of the perpetrator, and the chronology of events so that the rights of perpetrators and victims are protected in a balanced manner.

Abstract

This study aims to analyze the implementation of the Provincial Regulation of Central Kalimantan Number 2 of 2024 concerning the Recognition and Protection of Indigenous Law Communities, particularly regarding the Dayak indigenous communities in Dusun Selatan District. The main focus of this regulation is to provide recognition and protection for the rights of indigenous communities, especially regarding land rights and indigenous culture, which have often been neglected in various development policies. This research uses a empiric juridical approach to assess how this regional regulation can protect these rights and identify the challenges in its implementation on the ground. The findings indicate that although Provincial Regulation Number 2 of 2024 provides a strong legal basis for the recognition of indigenous rights, its implementation still faces many challenges, especially in the legalization of indigenous land rights, outreach to indigenous communities, and the protection of indigenous cultures from the impacts of modernization and development. Therefore, while there are positive steps through this regulation, the protection of indigenous rights still requires more coordinated and effective efforts from all relevant parties to ensure these rights are fully realized

Abstract

Water theft through by-pass on PDAM installations is one of the criminal acts that harm local companies and negatively impact the quality and quantity of clean water distribution. This research aims to analyze law enforcement against the crime of water theft in the PDAM of Palangka Raya City, identify the modus operandi used by the perpetrators, and examine the resulting impacts. The research employs empirical legal methods with a qualitative approach, where data is obtained through field observations, documentation, and interviews with relevant parties. The research findings indicate that the modus of theft is carried out by illegal connections on the distribution pipes before the water meter, so the usage is not recorded and the bill does not appear. This action violates Article 362 and Article 363 of the Indonesian Penal Code, Article 406 of the Penal Code, as well as Article 55 paragraph (1) in conjunction with Article 73 paragraph (1) of Law Number 17 of 2019 concerning Water Resources. Water theft results in financial losses for PDAM. decreased water pressure, service disruptions, and potential contamination. Strict law enforcement and increased legal awareness in the community are needed to prevent the recurrence of these criminal acts.
