Abstract

Penerapan hukum adat dalam pengelolaan sumber daya alam telah menjadi subjek penting dalam upaya pembangunan berkelanjutan. Peluang yang kiranya sangat berkaitan dengan penerapan hukum adat mencakup peningkatan pelestarian lingkungan, pemeliharaan keanekaragaman hayati, dan pemberdayaan masyarakat lokal. Hukum adat juga memberikan landasan bagi praktik-praktik pengelolaan yang berkelanjutan, memungkinkan adaptasi terhadap perubahan lingkungan, dan mempromosikan ketahanan lokal. Namun, penerapan hukum adat juga dihadapkan pada sejumlah tantangan. Sehingga penelitian ini bertujuan untuk mengetahui bagaimana seharusnya masyarakat adat mendapatkan perlindungan hak terhadap tantangan utama sulitnya mendapatkan pengakuan dan perlindungan hukum terhadap Hutan Adat sebagai sumber daya alam di Kalimantan Tengah menurut perspektif hukum adat. Menurut hasil penelitian, konflik kepentingan antara masyarakat adat dan pihak-pihak lainnya seperti pemerintah, serta ketidaksesuaian dengan kerangka hukum nasional menjadi pemicu permasalahan antara Masyarakat adat dan pemerintah. Dalam konteks pembangunan berkelanjutan, pemerintah seharusnya memegang kepentingan untuk memperkuat pengakuan dan perlindungan hukum terhadap hukum adat, serta memperkuat keterkaitan antara hukum adat dan hukum formal. Langkah-langkah tersebut dapat menciptakan kerangka kerja yang inklusif dan berkelanjutan bagi pengelolaan sumber daya alam, yang menghargai pengetahuan lokal, mendorong partisipasi masyarakat, dan memperkuat resiliensi ekosistem dalam rangka pengelolaan dan pemanfaatn hutan adat sebagai Upaya Pembangunan Berkelanjutan.

Abstract

This study examines legal issues related to the recycling system of mobile phone numbers implemented by telecommunications service providers, which has the potential to harm consumers. The primary issue is the violation of consumer rights under Law Number 8 of 1999 concerning Consumer Protection, particularly regarding the incomplete deletion of the previous owner's personal data during the number recycling process. The aim of this research is to analyze the impact of the implementation of the mobile phone number recycling system on consumers and to assess the extent to which this system fails to comply with the Consumer Protection Law, resulting in losses for consumers, especially concerning privacy and data security. This study employs a normative juridical method, utilizing an analytical approach to legislation, with a focus on the Consumer Protection Law. The research also includes case studies related to consumer rights violations resulting from the inadequacies of the mobile phone number recycling system. The research findings indicate that the recycling system for mobile phone numbers has not been implemented in accordance with applicable regulations. Personal data from previous number owners is not completely deleted, allowing such data to remain accessible to the new users. As a result, new consumers face significant privacy risks, such as the potential misuse of their data. This situation leads to both material and immaterial losses for consumers, particularly in terms of security and comfort in using telecommunication services.

Abstract

The escalation of violence among vulnerable child groups highlights the pivotal role of knowledge in addressing adversities. This study aims to utilize a Community Service Activity as external educational support to enhance teenagers' comprehension of dating violence and its legal aspects. Legal seminars engaged 88 adolescents from public and private schools in Palangka Raya city. Employing a pretest-posttest design, the intervention proved effective. Results showed a notable 63.63% improvement in adolescents' awareness of legal implications and understanding of potential criminal sanctions. However, marginal progress of 4.5% was observed in refining the definition aspect, indicating a basic understanding of unacceptable behaviors in dating relationships. The success of this initiative is evident in significantly enhancing adolescents' understanding of dating violence and its legal implications. These findings stress the need for tailored educational interventions to strengthen adolescents' legal awareness regarding dating violence. Implications suggest nuanced strategies to fortify understanding of legal protections within relationships, fostering safer environments for vulnerable groups.

Abstract

Partisipasi publik merupakan pilar utama dalam sistem hukum tata negara Indonesia dan bagian dari hak konstitusional warga negara yang dijamin UUD 1945. Namun dalam praktik, proses legislasi masih berlangsung secara tertutup dan minim pelibatan masyarakat, yang mencerminkan krisis partisipasi publik. Penelitian ini bertujuan untuk menganalisis konsep partisipasi publik sebagai hak konstitusional, meninjau realitas implementasinya dalam pembentukan undang-undang, serta mengkaji dampaknya terhadap legitimasi hukum. Dengan pendekatan yuridis normatif dan studi kasus, penelitian menemukan bahwa partisipasi publik masih bersifat simbolik dan prosedural, tanpa menjamin aspirasi masyarakat dipertimbangkan secara substantif. Krisis ini berdampak pada melemahnya legitimasi hukum, munculnya resistensi sosial, dan turunnya kepercayaan publik. Oleh karena itu, perlu reformulasi sistem legislasi yang menjamin partisipasi bermakna melalui mekanisme transparansi dan perlindungan konstitusional yang lebih kuat.

Abstract

The development of Artificial Intelligence (AI) has significantly impacted structural transformation and the dynamics of social control within society. AI not only changes how individuals interact with the world but also influences various sectors such as the economy, education, and government. Large-scale automation and data processing enable greater efficiency but also present complex social challenges, including technological access inequality, job displacement, and ethical and privacy concerns. This study aimed to analyze the implications of artificial intelligence (AI) on the structural transformation and dynamics of social control in society. This article discusses how AI has become a catalyst for social change, affecting human interaction patterns, job structures, and the legal regulations needed to ensure that technological advancements align with principles of justice and inclusivity. A normative juridical approach is used to analyse the impact of AI on legal and social norms, as well as how regulations can address emerging challenges. The study’s findings indicate that AI holds significant potential to improve human quality of life through efficiency and innovation but may also pose threats if not accompanied by appropriate regulations. Therefore, balanced policies are required to ensure that technological advancements are utilized while protecting human rights, allowing AI to contribute positively to social transformation. This study highlights the need for balanced and ethical regulation of AI. Practically, the findings help policymakers design fair rules to minimize the risks and maximize the benefits of AI for society

Abstract

The utilization of Artificial Intelligence (AI) technology in the Supreme Court represents an innovative step toward modernizing Indonesia’s judicial system. AI offers advantages in efficiently processing legal data, analyzing jurisprudence, and providing legal recommendations to assist judges in decision-making. However, AI implementation in the legal system presents challenges, including regulatory issues, ethical considerations, and AI’s limitations in understanding the humanistic dimensions of legal rulings. This study employs a normative juridical method with a doctrinal approach to analyze the role, benefits, and legal implications of AI usage in Indonesia’s judicial system. The findings indicate that while AI can enhance judicial efficiency, strict regulations are necessary to ensure transparency, accountability, and legal compliance in its application.

Abstract

The postponement of Village Head Elections (Pilkades) in Seruyan Regency has caused significant legal, governance, and socio-political issues. This study analyzes the legal basis for the postponement based on Seruyan Regency Regulation No. 1 of 2016 (Perda) and its alignment with national laws, including Law No. 6 of 2014, Government Regulation No. 43 of 2014, Minister of Home Affairs Regulation No. 72 of 2020, and Law No. 3 of 2024. While Perda Seruyan No. 1 of 2016 adheres to democratic principles, it lacks specific provisions regarding postponements due to national political agendas and the extension of temporary village head terms. This gap has led to constitutional rights violations, weakened legitimacy of Acting Village Heads, stagnated village development, and potential social conflicts. This study recommends revising Perda Seruyan No. 1 of 2016 to incorporate postponement provisions, allocating Pilkades budgets in the Regional Budget (APBD), and enhancing transparency and public participation to ensure legal, transparent, and accountable Pilkades implementation, ultimately maintaining social, political, and governmental stability at the village level.

Abstract

In the Indonesian civil law system, the plaintiff’s ability to withdraw a lawsuit before the defendant responds is a key procedural aspect regulated by Article 271 of the Reglement op de Burgerlijke Rechtsvordering (Rv). This analysis explores the application of this rule in Determination Number 203/PDT.G/2022/PN PLK at the Palangka Raya District Court, where the plaintiff, Porwanto, withdrew a lawsuit for unlawful acts against three defendants before their response. The court approved the withdrawal, ordered the plaintiff to pay court costs of Rp2,160,000, and removed the case from the register. This case reflects the balance between plaintiff autonomy and judicial efficiency, yet it raises concerns about potential procedural abuse. This study underscores the need for strict oversight to ensure such flexibility does not compromise fairness for all parties involved.

Abstract

The development of digital technology has driven transformation in various fields, including the administration system and legal proof through documents. One significant innovation is the implementation of electronic stamps (e-stamps) as an alternative to physical stamps based on Law No. 10 of 2020 on Stamp Duty. E-stamps offer efficiency, ease of access, and the potential to prevent document forgery. However, its application in authentic deeds made by Notaries and Land Deed Officials (PPAT) raises legal questions, particularly concerning its validity and legal certainty. Article 1868 of the Civil Code (KUH Perdata) stipulates that authentic deeds must be made by or before a public official in accordance with the form specified by law. Meanwhile, the Notary Position Law has not explicitly accommodated the use of e-stamps. This research uses a normative approach with doctrinal and legislative methods to analyze the compatibility of e-stamp usage in authentic deeds. The study's findings show that although substantively e-stamps are valid as a tool for collecting duties, there is a legal gap in the technical regulations concerning their use in notarial and PPAT deeds. This gap creates legal uncertainty that may affect the evidentiary power of authentic deeds in court. Therefore, there is a need for more harmonious regulations and clear technical guidelines so that the digital transformation in notarial practices can be effectively implemented without reducing legal certainty.

Abstract

This study examines the legal protection afforded to workers who experience delayed wage payments without the imposition of penalties on employers, as regulated under Law No. 13 of 2003 on Manpower and Government Regulation No. 36 of 2021 on Wages. The delayed payment of wages constitutes a violation of workers’ rights and may give rise to industrial relations disputes if not addressed effectively. The prevailing legal framework obliges employers—whether through intent or negligence—who delay wage payments to pay a penalty amounting to 5% per day from the fourth to the eighth day of delay, followed by 1% for each subsequent day, up to a maximum of 50% of the wages due. However, many workers are either unaware of their legal entitlements or reluctant to report such violations due to pressure exerted by employers. Using an empirical juridical research method and a qualitative approach involving interviews and field observations, this study aims to: (1) explore the legal protection mechanisms available to affected workers, and (2) identify the obstacles to enforcing sanctions against employers who fail to pay the prescribed penalties for delayed wages
