Abstract

Cryptocurrencies have grown rapidly and are used in various cross-border transactions. The negative impact of cryptocurrencies includes the misuse of crimes, especially in funding the weapons of mass destruction (WMD) proliferation. This article examines how cryptocurrency can be utilized in WMD proliferation funding and the challenges faced in overcoming this problem. The method used is a normative research method with a conceptual approach. The research found that cryptocurrency characteristics such as high anonymity and cross-border transactions make it easier for WMD proliferation funding perpetrators to hide funding traces. The lack of transparency in the blockchain adds to the difficulty in tracking WMD proliferation funds. The suggestion from this research is that there is a need for stronger international cooperation and a financial system that can detect and prevent the spread of nuclear material.

Abstract

This study aims to find out and analyze first, the implementation of the principle of forming laws and regulations in law number 13 of 2022 concerning the formation of laws and regulations and secondly, the implementation of public participation in the discussion process of law number 13 of 2022 concerning the formation of laws and regulations -invitation. This study uses normative legal research methods with statutory and conceptual approaches. The results of the research conclude that, first, based on the principles of forming laws and regulations, that Law no. 13/2022 only fulfills some of the principles of the formation of laws and regulations as stipulated in Article 5 of Law no. 12/2011 considering that the formation of Law no. 13/2022 seems in a hurry to accommodate the Constitutional Court Decision Number: 91/PUU-XVIII/2020. Second, related to the involvement of public participation in the formation of Law no. 13/2022, the authors conclude that public participation is still minimal, bearing in mind that the transparency of the DPR and the Government in forming laws is only limited to openness of legislation in disseminating information on draft laws without any clarity from the results of public consultations held by the Expertise Body of the Secretariat General of the DPR RI.

Abstract

Penelitian ini dilatar belakangi oleh berlakunya Peraturan Pemerintah (PP) Nomor 26 Tahun 2023 tentang Pengelolaan Hasil Sedimentasi Laut di mana ketika PP tersebut berlaku, keberlakuannya dinilai rapuh karena tidak merujuk pada peraturan perundang-undangan yang lebih tinggi seperti Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan (UU No. 12/2011), di mana banyak masyarakat pesisir tidak dimintakan pertimbangan pada saat proses penyusunan PP tersebut. Penelitian ini bertujuan untuk mengetahui dan menganalisis pertama, pembentukan Peraturan Pemerintah Nomor 26 Tahun 2023 tentang Pengelolaan Hasil Sedimentasi di Laut menurut UU No.12/2011. Kedua, batas maritim wilayah Indonesia yang perlu dipertimbangkan mengingat hasil sedimentasi melintasi batas negara. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menyimpulkan bahwa, pertama, UU No. 12/2011 hanya memenuhi sebagian asas dari pembentukan peraturan perundang-undangan dan tidak memenuhi partisipasi masyarakat yang bermakna karena masyarakat terdampak sama sekali tidak dilibatkan dalam pembentukan PP No. 26/2023. Kedua, Singapura tidak bisa melakukan klaim wilayah hasil reklamasi yang telah dilakukannya karena berdasarkan Pasal 60 ayat (8) UNCLOS 1982, pulau buatan, instalasi, dan bangunan tidak mempunyai status pulau, sehingga tidak memiliki laut teritorialnya sendiri, bahkan kehadirannya juga tidak mempengaruhi penetapan batas laut teritorial, zona ekonomi eksklusif atau landas kontinen.

Abstract

Penelitian ini bermula pasca pemberlakuan undang-undang nomor 11 tahun 2020 tentang cipta kerja atau yang biasa dikenal sebagai omnibus law dikaitkan dengan dampak yang ditimbulkan terhadap usaha mikro kecil dan menengah (umkm). Permasalahan yang akan dikaji dalam penelitian ini adalah bagaimanakah perlindungan hukum terhadap usaha mikro kecil dan menengah pasca pemberlakuan undang-undang nomor 11 tahun 2020 tentang Cipta Kerja. Metode yang digunakan oleh penulis pada penelitian ini adalah penelitian yuridis normatif. Adapun hasil penelitian menunjukan bahwa permasalahan umum yang dihadapi oleh UMKM, yaitu hal-hal yang berkaitan dengan hukum dan utang piutang terhadap mitra. Selanjutnya perlindungan terhadap UMKM sudah diatur dengan baik melalui UU Cipta Kerja dan PP Nomor 7 Tahun 2021 khususnya terkait perlindungan hukum karena saat ini pemerintah pusat dan pemerintah daerah telah memberikan perhatian lebih dalam hal pembiayaan kepada UMKM yang meminta layanan bantuan dan pendampingan hukum seperti penyuluhan hukum, konsultasi hukum, mediasi, dan pendampingan di luar pengadilan.

Abstract

Indonesia filed a lawsuit with the European Union at the World Trade Organization due to the EU imposing anti-dumping import duties on stainless steel products from Indonesia. The EU argued that the anti-dumping import duties were imposed because the EU suspected that Indonesian steel exporting companies received preferential financing from Chinese banks. This research is intended to examine the form of dumping regulation and the imposition of anti-dumping import duties according to the 1994 General Agreement on Tariffs and Trade and the anti-dumping import duty policy implemented by the European Union on stainless steel from Indonesia. The research method used is normative juridical. Based on this research, it is known that dumping as competition in the form of price in the form of price discrimination or selling below normal prices is something that often occurs in international trade, the European Union's action in imposing anti-dumping import duties on stainless cold rolled steel products from Indonesia is certainly contrary to anti-dumping agreement, where one of the conditions is that there is a loss due to the presence of dumped goods, but in this study there was no such loss because Indonesia's steel market share in the European Union is still low and the imposition of anti-dumping import duties is inappropriate due to the assessment of imports Indonesian steel market share combined with the market share value of steel imports from India.

Abstract

The ban on bauxite exports shows the government’s consistency in encouraging downstream mining products, by processing bauxite domestically, added value can be enjoyed and has the potential to increase state revenue, but on the other hand there are international obligations that need to be followed by Indonesia related to the ban on exports of mining products. This article aims to analyze Indonesia's bauxite export ban policy according to international trade law and its impact on Indonesia - the European Union Comprehensive Economic Partnership Agreement (IEU-CEPA). To compile this article, normative research was conducted, where secondary data was obtained through literature examination. Then, a conceptual approach was used to conduct a qualitative descriptive analysis of literature sources relevant to the research subject. The results of this study indicate that Indonesia will most likely fail to prove that the bauxite export ban that has been implemented is justified according to the General Agreement on Tariffs and Trade 1994 (GATT 1994), one of the reasons is because the Indonesian government does not provide alternative policies related to the bauxite export ban and also the initial purpose of the bauxite export ban was because the government wanted to encourage domestic bauxite processing and refining, this is also evidenced by the absence of restrictions on domestic production and consumption, and also Indonesia must be prepared to face the latest lawsuits from the European Union or other countries considering that Indonesia is believed to have violated several articles in the GATT and the IEU-CEPA negotiations.
