Abstract

The idea of revising the 1945 Constitution is likely to spark debate. Nevertheless, Article 37 of the 1945 Constitution has provided a mechanism for amendment, rather than replacement, of the constitution. The amendments to the 1945 Constitution are now mandatory, as previously decreed by the MPR leadership, which will be continued by the current leadership. This paper examines the role of public participation in the amendment of constitutions in Indonesia and Thailand. The study employs a normative legal research approach, utilizing statutes, conceptual frameworks, and comparative analyses. Data was collected from books, academic journals, relevant laws, and regulations. The results indicate that the forms of public participation in Indonesia and Thailand in the constitution-making and amendment processes are largely similar, including public hearings, working visits, socialization, seminars, workshops, and discussions. However, a notable difference exists in that Indonesia lacks explicit provisions for public participation in its constitutional amendment process, whereas Thailand has established clear regulations. It is recommended that Indonesia clearly regulate public participation as a procedure in its constitution-making and amendment processes.

Abstract

This study aims to determine and analyze the constitutionality of Kalosara custom in mediating disputes between doctors and patients in Konawe Regency. The method in this research uses a sociological juridical approach. The results of this study are The role of the Kalosara as customary law has a broad scope as a legal sub-system in society, as the Kalosara is known to prioritize unity and peace through mediation by means of deliberation and consensus. The Sara Medulu procession carried out by doctors from Konawe Hospital came to the victim with the intermediary of a Tolea as a form of seriousness to settle by custom. Customary settlement with a family atmosphere makes both parties feel defeated by each other. This condition is far more beneficial than legal settlement through the litigation process where there are parties who are won and defeated.

Abstract

Investment has become a new lifestyle for some people, as investment promotions typically entice potential investors with promising returns. In Indonesia, investments are broadly categorized into tangible and financial investments. This study aims to review the licensing system and protection for victims of online robot trading investments in Indonesia, focusing on safeguarding the public as investors. This research aims to provide knowledge so that the public can differentiate between legal and illegal investments, thus encouraging more cautious investment decisions. The method employed in this study is a normative juridical approach involving an analysis of existing laws and regulations, including the Consumer Protection Law, Capital Market Law, and regulations issued by the Financial Services Authority (OJK). A qualitative analysis of the collected data was conducted to assess the extent to which current regulations can protect the public from potential losses arising from investments in robot trading. The research findings indicate that the protection of victims in online robot trading investments in Indonesia needs to be strengthened and adapted to technological and market developments. Stricter and more specific regulations governing the operations of robot trading platforms are necessary. It is advisable for the public to exercise caution when engaging in online investments to avoid becoming victims.

Abstract

This study delves into an examination of how the 1945 Constitution establishes multiple constraints on the President's authority while bolstering the influence of the DPR (People's Consultative Assembly). The research aims to comprehensively analyze the scope of powers granted by the 1945 Constitution to both the President and the DPR. Employing a normative research methodology, this investigation reveals that the 1945 Constitution places specific limitations on the President while strengthening the authority of the DPR through various means. Notably, the Constitution imposes term limits solely on the President, not on the DPR. Although the President participates in the legislative process, certain restrictions apply, and certain powers are granted to the President as the head of state, but they necessitate the involvement of the DPR. In contrast, specific rights exclusively pertain to the DPR in support of its duties, without extending these same rights to the President. Such a scenario underscores the imperative of establishing a constitutional balance of power between the executive authority of the President and the legislative authority of the DPR.

Abstract

The Implementation of the Omnibus Law in Indonesia through Law Number 11 of 2020 on Job Creation represents a significant step in regulatory reform, encompassing various sectors. This law aims to streamline regulations, enhance investment, and create job opportunities. This study seeks to analyze the impact and implications of the Omnibus Law on legislative politics in Indonesia. Using a qualitative approach and various theoretical frameworks from the fields of law, economics, politics, and sociology, this research examines regulatory changes, legislative processes, and the social, economic, and environmental impacts of the Omnibus Law's implementation. The findings indicate that while the Omnibus Law has the potential to improve the investment climate and economic growth, concerns exist regarding the reduction of workers' rights, negative environmental impacts, and the lack of public participation in the legislative process. The implications for legislative politics include changes in the relationship between central and regional governments, as well as political dynamics at the national and local levels. It is crucial for the government to ensure transparent, accountable, and participatory implementation to achieve sustainable development goals and improve the welfare of the Indonesian people.

Abstract

Penelitian ini menganalisis kontrol atas penambangan batuan dari aspek hukum pertambangan, hukum lingkungan dan hukum tata ruang. Hal ini penting karena memiliki pengaruh signifikan dari segi lingkungan maupun sosial kemasyarakatan di Kota Kendari. Tujuan penelitian ini menganalisis penambangan batuan di Kelurahan Nambo Kota Kendari dari tiga aspek peraturan perundang-undangan. Penelitian ini menggunakan jenis penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan. Berdasarkan hasil penelitian yaitu terdapat tiga aspek yang secara eksplisit penambangan batuan di Kelurahan Nambo, Kecamatan Nambo, Kota Kendari tersebut memang tidak mudah jika ada ego sektoral yang mengemuka. Karena ada tiga kompetensi berlaku di pada peristiwa hukum dalam penambangan batuan di Kelurahan Nambo tersebut perizinan sebagai kontrol atas pelaksanaan kegiatan penambangan batuan di Kelurahan Nambo Kota Kendari mencakup tiga kompetensi. Ketika menyangkut perizinan pertambangan batuan ada pada pemerintah provinsi berdasarkan Perpres No.55/2022. Sedangkan ketika menyangkut kewenangan penerbitan perizinan berusaha bidang lingkungan hidup  adalah kompetensi  ada pada Kapala BKPM berdasarkan Permen LHK No. 6/2020. Pada aspek tata ruang maka perizinannya ada pada Pemerintah Kota Kendari berdasarkan Pasal 80 Perda Kdi No.1/2012. Sehingga dibutuhkan adanya koordinasi dari pemerintah pusat kepada Pemerintah Daerah Provinsi Sulawesi Tenggara dan Pemerintah Daerah Kota Kendari dalam hal penertiban penambangan batuan di Kelurahan Nambo Kota Kendari.

Abstract

The digital transformation of bureaucracy has become a strategic agenda for efficient, transparent, and accountable governance. In Indonesia, this transformation was institutionalized through Presidential Regulation No. 95 of 2018 on the Electronic-Based Government System (SPBE). However, digital governance should not be seen merely as a technocratic project. From a constitutional law perspective, digitalization must adhere to the principles of the rule of law, human rights protection, and national sovereignty. This transformation also promotes innovation and strengthens public participation in monitoring and criticizing government policies, thus enhancing democracy. This article critically examines the implementation of digital bureaucracy within the constitutional law framework. The analysis focuses on whether digitalization improves government efficiency or creates challenges related to digital sovereignty, legal accountability, and equal access. Using normative legal research methods, the study analyzes primary sources, such as legislation, alongside secondary sources, including legal doctrine and academic works on constitutional law and digital governance. The findings show that digital bureaucracy can significantly improve public service quality. However, without a strong legal and constitutional framework, digitalization risks being merely an efficiency myth. Indonesia’s reliance on foreign digital infrastructure threatens digital sovereignty and may undermine constitutional guarantees. Therefore, the development of digital bureaucracy should be seen not only as administrative modernization but also as a constitutional mandate, balancing efficiency with constitutional principles, ensuring inclusivity, equal access, and strengthening digital sovereignty through a robust legal foundation and effective oversight
