Abstract

The purpose of this study is to analyze the setting of the education right for child labour in workingrelationships. The method used in this study is empirical normative. The results showed that the regulationof the fulfillment of the education right for child labour in the working relationship have not been maximal,because there is still a legal void in the Employment Law and the absence of synchronization of Law No.20 of 2003 on the National Education System, Government Regulation No. 48/2008 on Education Funding.The implementation of the 20% education budget has not been achieved so that uneven education is enjoyed.Therefore, a revision of the rules on the fulfillment of educational rights for child labour in an integrated andharmonious working relationship is required.

Abstract

Considering the importance of community participation in the process of forming local regulations, which are sometimes overlooked by the local government and the Regional House of Representatives, this study was conducted to analyze the forms and implications of community participation in forming the regional parking regulations in Makassar City using an empirical research type. The approaches in this study were the statutory approach, the stratification approach, and the sociological approach. The data analysis used a qualitative method in the form of descriptive analysis. The results of the study showed: 1) the forms of community participation in forming the regional regulations in Makassar City could be divided into three stages. First, community participation in the ante-legislative stage included 1) Research; 2) Discussions, Workshops, and Seminars; 3) Initiative proposals; and 4) Draft Bill. Second, public participation in the legislative stage included 1) Audience; 2) Alternative Draft Bills; 3) input through print media; 4) input via electronic media; 5) demonstrations; and 6) discussions, workshops, and seminars. Third, people's participation in the post-legislative stage included 1) demonstrations, 2) law review, and 3) socialization of the law. The implications for forming regional regulations that do not use participatory principles can be seen from two sides, namely public legal awareness and community legal compliance. The community and parking attendants are aware but disobedient due to several factors, namely accessibility, legal knowledge, understanding of the law, patterns of legal behavior, and factors of the long-standing legal culture of the community. As a result, the effectiveness of forming regional regulations has not been effective because they still need to fulfill the principles of forming laws, namely the principles of efficiency and effectiveness, as well as the principle of openness.

Abstract

Kualitas Pekerja merupakan aspek penting dalam pembangunan berkelanjutan di Indonesia.Negara bertanggung jawab memastikan hak, kesempatan, dan perlindungan tanpa diskriminasi, serta mencegah pelanggaran hak asasi manusia (HAM). Kualitas pekerja sebagai realisasi integral Sustainable Development Goals (SDGs) poin ke-16 sehingga Pekerja Migran Indonesia (PMI) yang berlatar belakang pendidikan SMA/SMK, memerlukan edukasi hukum terkait pelindungan hukum terutama sebelum bekerja sebagai bentuk pengembangan dan peningkatan kualitas sumber daya pekerja. Penelitian ini menggunakan penelitian hukum normatif dengan menggunakan metode deskriptif analitis dengan pendekatan yuridis normatif. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah studi kepustakaan dengan mengumpulkan bahan sekunder dari buku-buku, jurnal, undang-undang dan dokumen-dokumen yang berkaitan dengan penelitian. Pengaturan tata kelola penempatan bagi Calon Pekerja Migran Indonesia (PMI) mencakup proses penempatan yang meliputi rekrutmen melalui agen resmi, pelatihan, pemenuhan dokumen dan persyaratan hukum, serta perlindungan dan pengawasan oleh pemerintah. Perlindungan hukum dalam tata kelola penempatan bagi calon pekerja migran dapat dilakukan melalui edukasi hukum yang bersifat preventif melalui pelatihan, sosialisasi, mentoring agar dapat memaksimalkan kualitas calonPekerja Migran Indonesia.

Abstract

The purposes of this study are: 1. To analyze the effectiveness of the supervisory role of the Notary Supervisory Board based on Central Honorary Council regulation Number 1 of 2017 concerning the Limit of the Reasonable Number of Deeds Per Day (Per.DKP No.1/2017). In addition, the purpose of this study is also to analyze the legal implications for notarial deeds made exceeding the fairness limit as stipulated in Central Honorary Council Regulation Number 1 of 2017 (Per. DKP No.1/2017). Research method. The approach taken by researchers is to use empirical methods. This research was carried out in several cities/regencies in South Sulawesi, namely the Regional Supervisory Board and Regional Supervisory Board of South Sulawesi Province and several Notary Offices whose locations are still under the authority of the Regional Supervisory Council. Furthermore, the samples were taken using the Simple Random Sampling method. The types and sources of data needed in this study were divided into two types of data: primary data, secondary data, and tertiary data. Data collection techniques were library research and field research. Data analysis, namely primary data and secondary data in this study were analyzed qualitatively, namely describing and systematically compiling the data obtained from the interview results, to achieve clarity of the issues discussed. Research result : 1) Based on its position, the Central Ethics Council Regulation Number 1 of 2017 comes with the hope that it can be a complement to the Notary Office Law, even though the limit on the number of making deeds per day is not explicitly stated in it, Article 2 of the Central Honors Council Regulation Number 1 of 2017 indirectly still has a thread related to the enforcement of the Notary Office Law, and 2) With regard to the sanctions given to notaries whose deed exceeds the fairness limit, in fact on the ground the Regional Supervisory Council stated that in fact on the ground they had not received information either within the South Sulawesi region or outside South Sulawesi regarding the imposition of sanctions by the Supervisory Council for making more than 20 deed per day.

Abstract

Masih banyaknya eksploitasi lingkungan saat ini, berdampak pada implikasi penerapan prinsip kelestarian dan keberlanjutan lingkungan. Banyaknya kerusakan lingkungan di Indonesia membutuhkan strategi kebijakan lingkungan pemerintah dan model pengawasan berbasis ecology efektif. Penelitian ini bertujuan untuk mengetahui problematika sistematik pada penegakan hukum lingkungan di Indonesia, serta menganalisis model kebijakan pemerintah dalam upaya pemulihan kerusakan lingkungan. Metode yang digunakan yakni penelitian hukum normatif dengan pendekatan perundang-undangan dan kasus. Penelitian menunjukkan problematika sistematik penegakan hukum lingkungan dipengaruhi efektivitas kelembagaan dibidang lingkungan. Komimten aparat penegak hukum terkait pemulihan kerusakan lingkungan, ketersedian sarana dan prasarana yang memadai, partisipasi masyarakat dalam bentuk pengaduan lingkungan. Strategi pemerintah dalam memulihkan lingkungan melalui penerapan kebijakan komplain hijau melahirkan beberapa aspek yang dirumuskan melalui recovery dalam pengoptimalan pengaduan masyarakat oleh institusi lingkungan, penerapan media pengaduan lingkungan berbasis citizen lawsuit, dan inspeksi pengelolaan pengaduan lingkungan.
