Abstract

Drug abuse constitutes a critical issue that impacts not only individuals but also society at large. As a criminal offense categorized as an extraordinary crime, its resolution requires a legal approach that goes beyond merely punitive measures. This study examines the role of the Karawang District Prosecutor's Office in implementing a restorative justice approach toward drug offenders, based on the Regulation of the Attorney General Number 15 of 2020 and the Guidelines of the Attorney General Number 18 of 2021. A juridical-empirical approachwas employedto analyze theactual legal practices inthe field, with datacollectedthrough interviews andlegal documents. The findings indicate that although restorative justice has begun to be implemented, its application in drug abuse cases remains very limited and faces several challenges, including lengthy procedures, inter-agency coordination issues, time constraints, and a lack of public understanding. This study highlights the crucial role of prosecutors as dominus litis in directing cases towardrehabilitation, as well as the need to strengthen institutional synergy and public education to achieve a more humane and solution- oriented form of justice. The case study of the Karawang District Prosecutor’s Office demonstrates that restorative justice holds significant potential as an alternative mechanism for resolving cases in a more equitable and recovery-focused manner.

Abstract

Rape is an act of sexual violence that forces someone into sexual relations, including those between a husband and wife. According to records from the Federation of Indonesian Teachers' Unions (FSGI), from the beginning of the year until May 2023, 31.08% of sexual violence cases against minors involved teachers. This study, using Normative Juridical research, examines the criminal liability of teachers who rape students and the judicial considerations in Decision Number: 156/Pid.Sus/2020/PN.Pkb. Findings indicate that teachers violating Article 81 paragraphs (1) and (3) are subject to criminal sanctions, including a minimum prison sentence of 5 years and a maximum of 15 years, as well as a fine of IDR 5,000,000,000.00 (five billion rupiah). Additionally, one-third of the principal penalty may be added. In the referenced case, Decision Number: 156/Pid.Sus/2020/PN.Pkb, the defendant received a sentence of 6 years in prison and a fine of IDR 10,000,000.00 (ten million rupiah). Failure to pay the fine would result in an additional 3-month prison term. Given the damage to the reputation of teachers, the panel of judges should have the authority to impose further punitive measures, such as publicizing the perpetrator's identity through print and social media. It is hoped that such measures will create a deterrent effect, discouraging similar offenses in the future.

Abstract

Perkembangan industri menimbulkan masalah serius berupa pencemaran limbah Bahan Berbahaya dan Beracun yang mengancam ekosistem dan kesehatan masyarakat. Penelitian ini bertujuan mengkaji penegakan hukum terhadap korporasi pencemar limbah Bahan Berbahaya dan Beracun berdasarkan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, dengan fokus pada penerapan prinsip strict liability. Metode yang digunakan adalah yuridis normatif melalui kajian peraturan perundang-undangan, literatur hukum, dan analisis kasus pencemaran limbah medis di Desa Karangligar, Karawang. Hasil penelitian menunjukkan bahwa Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup bersama Peraturan Pemerintah No. 101 Tahun 2014 telah menyediakan dasar hukum yang kuat melalui prinsip polluter pays dan strict liability, dimana korporasi wajib menanggung biaya pemulihan tanpa perlu dibuktikan unsur kesalahan. Namun, implementasi di lapangan masih lemah. Penegakan hukum lebih sering terbatas pada sanksi administratif berupa peringatan atau perbaikan, sementara aspek pidana cenderung dianggap sebagai ultimum remedium. Kasus RS Bayukarta dan RS Hermina membuktikan lemahnya pengawasan, karena meski terbukti lalai mengelola limbah medis, sanksi yang dijatuhkan tidak menimbulkan efek jera. Penelitian ini menyimpulkan dan menegaskan pentingnya penerapan prinsip strict liability secara konsisten untuk mempercepat proses hukum, menghindari kendala pembuktian, serta memberikan efek jera kepada korporasi. Strategi penegakan hukum yang lebih tegas, terintegrasi, dan berkeadilan diperlukan agar perlindungan lingkungan dan hak masyarakat dapat terjamin.

Abstract

Pelayanan publik merupakan kewajiban negara dalam memenuhi hak-hak masyarakat sebagaimana diatur dalam Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik. Penelitian ini bertujuan untuk menganalisis penerapan standar pelayanan publik berdasarkan UU tersebut serta upaya Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu (DPMPTSP) Kabupaten Karawang dalam pemenuhan hak kelompok rentan. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan deskriptif-analitis melalui kajian peraturan perundang-undangan, dokumen hukum, serta data sekunder yang relevan. Hasil penelitian menunjukkan bahwa standar pelayanan publik mencakup berbagai aspek seperti persyaratan, prosedur, waktu, biaya, produk layanan, sarana prasarana, pengaduan, hingga pelayanan khusus bagi kelompok rentan.  Kesimpulan dari penelitian ini adalah setiap lembaga penyelenggara pelayanan publik wajib mempunyai standar pelayanan yang tercantum dalam UU NO 25/2009 pada Bab V pasal 22. Adapun upaya DPMPTSP Kab Karawang dalam pemenuhan hak kelompok rentan adalah menyediakan fiture khusus kelompok rentan dengan keluarnya program SiPadi Cepat ( Siap Pelayanan Datangi Cetak Ditempat) sehingga prisip dasar pelayanan yang dicita citakan dapat tercapai, guna mewujudkan asas keadilan, kesetaraan, dan peningkatan kesejahteraan masyarakat.

Abstract

This study examines the legal liability of Shopee as a marketplace platform operator under Regulation of the Minister of Trade Number 31 of 2023, and evaluates the extent to which Law Number 8 of 1999 on Consumer Protection (UUPK) delivers genuine legal certainty for consumers harmed by product description violations. A normative juridical method is employed, combining statutory, conceptual, and case approaches. The study finds that Shopee's liability mechanism under Article 30 of Permendag No. 31 of 2023 is structurally incomplete: enforcement depends solely on opaque algorithmic moderation without independent oversight, and the Regulation imposes no direct liability on the platform for harm its system failed to prevent. As a PPMSE controlling fees, escrow, and dispute resolution, Shopee qualifies as a business actor under Article 1(3) of the UUPK and cannot claim immunity as a neutral intermediary. Legal certainty remains formally guaranteed but practically unrealised: Shopee's unboxing video requirement violates Article 22's reversed burden of proof and Article 18's prohibition on unfair standard clauses, while BPSK is structurally inaccessible to ordinary online consumers. The study recommends extending the reversed burden of proof to civil dispute proceedings, prohibiting platform-imposed evidentiary barriers, and mandating transparent reporting on internal dispute resolution outcomes.

Abstract

The neuroprotective potential of compounds from Nicotiana tabacum L. against Alzheimer’s disease was evaluated using network pharmacology, molecular docking, and ADME profiling. 25 compounds were screened, and the intersection of predicted targets with Alzheimer’s disease associated proteins yielded 90 overlapping proteins. Network topology using Degree prioritized three hub targets, IL-1β (Degree: 37), GSK3β (Degree: 25), and AChE (Degree: 19). Docking in YASARA against IL-1β (5R8Q), GSK3β (5K5N), and AChE (4EY7) produced binding energy ranges of -6.673 to -8.680, -9.769 to -10.614, and -10.349 to -12.275 kcal/mol, respectively. The β-amyrin ranked best among test ligands for IL-1β at -6.885 kcal/mol and for GSK3β at -10.178 kcal/mol, while citrostadienol ranked best for AChE at -10.881 kcal/mol. Dual-target profiles supported 28-Isofucosterol for GSK3β and AchE, and gramisterol for IL-1β and AChE. BOILED Egg analysis supported BBB-oriented prioritization of candidates with TPSA <79 Ų, while highly lipophilic sterol-type leads indicate formulation-dependent developability. Overall, Nicotiana tabacum L. provides non-nicotine sterol and triterpenoid scaffolds as multi-target chemotypes spanning inflammation, kinase signaling, and cholinergic dysfunction in Alzheimer’s disease.
