Abstract

AbstrakKontrak kerjasama asuransi antara konsumen dengan produsen asuransi pada umumnya menggunakan perjanjian baku (standart contract) yang isinya secara sepihak ditetapkan oleh perusahaan asuransi tanpa melibatkan konsumen, dengan alasan efektivitas serta efisiensi. Penelitian ini bersifat deskriptif analitis, dengan menggunakan pendekatan juridis normatif. Data yang telah terkumpul, baik bahan hukum primer, bahan hokum sekunder maupun bahan hokum tertier diolah dan dibahas dengan menggunakan analisis normativ kualitatif, serta menganalisanya berawal dari premis umum kemudian berakhir pada suatu premis khusus. Hasil penelitian menujukan, produsen asuransi secara seragam memberlakukan kontrak baku dengan beberapa klausul pengecualian (clause exonerasi) pada setiap kontrak pertanggunganya. Seluruh subtansi dari kontrak pertanggungan ditentukan sepihak oleh produsen asuransi yang posisinya lebih kuat dari konsumen, sehingga antara hak dan kewajiban dalam kontrak tidak seimbang, serta cendrung memposisikan pemegang polis pada posisi tawar yang lemah. Selain itu jarang sekali para calon konsumen asuransi terlebih dahulu mempelajari substansi dari kontrak (polis), sehingga tidak mengherankan jika di kemudian hari setelah kontrak berlangsung, banyak sekali terjadisengketa yang bersumber dari ketidak sefahaman atas kontrak pertangungan. Atas dasar inilah, maka perlu adanya suatu penyelesaian sengketa asuransi ini, baik melalui lembaga peradilanformal (litigasi) seperti Pengadilan Umum, dan Pengadilan Agama, maupun melalui lembaga penyelesaian diluar Peradilan formal (Non litigasi), berupa Badan Penyelesaian Sengketa Konsumen (BPSK), seperti Arbitrase, Mediasi, konsiliasi, atau musyawarah mufakat kekeluargaan.Kata Kunci : Perlindungan konsumen, Klausula baku, Asuransi

Abstract

Abstract The School Literacy Movement (GLS) is a massive and structured movement to foster the habits and abilities of students to be able to access, understand, and use something intelligently through various activities, including reading, seeing, listening, writing, speaking and being able to utilize and implement what they know in everyday life. The School Literacy Movement (GLS) is considered effective if students master six basic literacy, namely (1) language literacy, (2) numeracy literacy, (3) scientific literacy, (4) digital literacy, (5) financial literacy, and (6) cultural and civic literacy. The title of the study is "Implementation of the School Literacy Movement (GLS) in the High School Environment of the Heir of Civilization Plus Ciseeng, Ciseeng District, Bogor Regency". This study aims to determine how effective the implementation of the School Literacy Movement Program at SMA Pewaris Civilization Plus Ciseeng; and what positive and negative aspects are contained in the School Literacy Movement Program at SMA Pewaris Civilization Plus Ciseeng. This research is an empirical normative research with a qualitative descriptive analysis approach. The results of the study showed that the implementation of the school literacy movement (GLS) in the Pewaris High School plus Ciseeng Civilization environment was almost entirely going well, although there were still some derivative programs that were not optimal, namely related to financial literacy..

Abstract

Berkembangnya strategi pembelajaran di sekolah menjadi suatu tantangan baru bagi guru atau tenaga pendidik dalam memahaminya. Tanpa adanya kemauan untuk mengembangkan strategi pembelajaran akan menjadi dampak menurunnya kualitas peserta didik di bidang akademik. Strategi pembelajaran afektif merupakan sebuah tantangan baru bagi guru untuk membuat peserta didik mengetahui lebih dalam akan sikap dan nilai-nilai sosial di kelas dan di sekolah. Tujuan penelitian ini adalah untuk mendeskripsikan strategi pembelajaran afektif yang mampu Menanamkan sikap sosial dari peserta didik. Peserta didik diharapkan mampu memiliki sikap sosial yang tinggi di dalam kelas ataupun luar kelas. Metode penelitian ini menggunakan wawancara dan observasi serta dokumentasi. Berdasarkan hasil penelitian dapat disimpulkan bahwa adanya strategi pembelajaran afektif membuat sikap sosial peserta didik berkembang. Peserta didik mulai mampu bekerja sama secara kelompok dan peserta didikmampu memahami nilai-nilai sosial dan norma di sekolah. Keberhasilan ini dapatsecara langsung membentuk karakter peserta didik lebih menghargai guru, dan teman sebayanya.

Abstract

This study examines the rejection of the relocation policy stipulated in PERBUP Kabupaten Tangerang No. 60 of 2016 by traders in the Cisoka District. Findings indicate that the majority of traders oppose the policy due to the prohibition of street vendors (PKL) in the new market and the imposition of fees for public access. This situation significantly impacts the traders' income, potentially lowering their standard of living. The rejection reflects human rights issues, specifically the traders' right to work and earn a decent living. Dissatisfaction arises from a policy that lacks support and imposes access fees on the public. The study emphasizes the importance of involving traders in the formulation of policies affecting their livelihoods. The government is urged to review the relocation policy to be more inclusive and consider the aspirations and needs of the community. Overall, this research provides insights into the negative impacts of relocation policies that do not take into account the needs and rights of traders, highlighting the necessity of a fairer and more sustainable approach in policy-making to support the overall welfare of the community.

Abstract

The legal theory "Law as a Tool of Social Engineering" was introduced by Roscoe Pound, meaning law as a means of social engineering or legal reform inw3s % society. The purpose of this study is to understand the implementation of the theory "Law as a Tool of Social Engineering and Social Control" in the management of the Covid-19 pandemic in Indonesia, where legal instruments are used in risk mitigation management and addressing the impacts of the Covid-19 pandemic. Almost all countries worldwide, including Indonesia, have adopted legal instruments in this regard. This research employs a qualitative approach with a descriptive analytical normative-empirical repository method, essentially combining a normative legal approach with additional empirical elements from Non-Judicial Case Study repository data. The research findings indicate that legal instruments in the form of regulations and legislation have consistently been utilized by the government in managing the Covid-19 pandemic.

Abstract

Partner refers to SMK Sasmita Jaya 2, a vocational high school located in Pamulang District, South Tangerang City. As stated in Article 3 of Law No. 20 of 2023 of the Republic of Indonesia, education should aim to develop students' potential so they become individuals who are faithful and devoted to God Almighty, possess noble character, good health, knowledge, competence, creativity, independence, and discipline, and uphold Pancasila values as responsible citizens. Based on observations and school data, bullying cases are still frequently found at SMK Sasmita Jaya 2. One common form of bullying is social exclusion, where a student is deliberately avoided or isolated by their peers. This practice makes the excluded student feel sad, pressured, uncomfortable, and even inferior. Bullying is a serious concern for all parties, including school management, teachers, and non-educational institutions, considering the severe negative psychological impact on students. The goal of this community service program (PKM) is to provide counseling to students to raise awareness about the dangers of bullying, its negative psychological effects, and preventive measures through Pancasila and Civic Education (PPKn). This community service initiative is conducted through direct counseling sessions using several methods, including the lecture method, interactive discussion, and simulation techniques, tailored to the theme and audience. By teaching Pancasila values, such as just and civilized humanity and Indonesian unity, students are encouraged to understand the importance of respecting differences, upholding human dignity, and fostering cooperation in diversity. Through this approach, students can develop a mutual respect attitude and strengthen harmonious relationships in their daily lives. Consistent reinforcement of Pancasila and Civic Education is essential in building a school culture free from bullying, ensuring that every student feels valued and protected.
