Abstract

Misek tradition is known as the proposing procession of the Dayak Ngaju community in Central Kalimantan before marriage. This tradition is still preserved by the indigenous people, even though they have converted to Islam. As a law that lives in society, misek has become the nation's cultural heritage and, at the same time, enriches the national cultural treasures of Indonesia. The presence of Islam in the lives of the Dayak Ngaju community did not immediately eradicate the misek tradition. Progressive Islamic law has an elastic accommodation to adapt misek cultural values. This research aimed to analyze the progressive Islamic law and misek tradition of the Dyak Ngaju Community in Central Kalimantan. The research was empirical legal research, with data sources from observation, interviews, and documentation. Accommodation theory is used for the research. The research showed two conclusions. First, Misek's traditional practice has two processes, namely the misek hakumbang auh process (the small proposal procession) and the misek hakumbang hai (the big proposal procession). Second, progressive Islamic law accommodates the cultural values of misek, both misek hakumbang auh and misek hakumbang hai as good customs. The Misek tradition can coexist with Islamic law without losing its traditional identity.

Abstract

This article analyzes the management of zakat (almsgiving) in Indonesia, focusing on the genealogy of legal politics and its relationship with state policies in centralizing zakat management. Given the variations in zakat management systems among Muslim countries, Indonesia’s direct participation in zakat management has provoked resistance within Islamic civil society. They do not desire any state intervention in zakat management, as it contradicts their longstanding practice before Indonesia’s independence. This article employs a historical approach and analyzes data using Fred W. Riggs’ prismatic legal theory. The authors find that the state’s argument for centralizing zakat management in Indonesia aims to optimize the efficient utilization of zakat funds. However, this policy hurts the participation of Islamic civil society in managing zakat according to their genealogical traditions. Therefore, the article argues that the state’s centralization of zakat management is inappropriate, as it overlooks the integral zakat practices rooted in Islamic civil society’s history and culture in Indonesia.

Abstract

The research is motivated by the increasing number of cases of domestic problems caused by the presence of third parties, resulting in divorce cases, therefore the presence of the singer tunkun is an effort to increase legal awareness in the community so that they obey and respect existing Dayak traditional religious values and instill awareness. Customary living based on religious teachings is always emphasized so that divorce and cases of the presence of third parties in domestic relationships do not occur again. The research aimed to explore the religious values found in singer tungkun among the Dayak people of Central Kalimantan. The method used phenomenological research using collaboration from interviews and literature review surveys. The results showed similarities between the religious values in the tradition of singer tungkun with the religious values, contained in the Islamic religion, namely being devoted to God Almighty, being fair, deciding everything through deliberation, forgiving each other, and living peacefully in unity and not mutual enemies, and do not betray each other.

Abstract

This article aims to analyze the shift in the orientation of Nahdlatul Ulama’s (NU) fiqh (Islamic jurisprudence) tradition in managing zakat in Indonesia. The shift occurs in the zakat fund management institution through the Lembaga Amil Zakat Nahdlatul Ulama (LAZISNU) and their fiqh understanding of zakat recipients (mustaḥiq). The article also explores the forms of involvement of the NU’s structural and cultural members, known as Nahdliyin, in their efforts to improve social welfare. As an Islamic philanthropy institution, LAZISNU strategically synergizes with social welfare issues for its community. Despite being the most prominent Islamic community organization in Indonesia and globally, most Nahdliyin fall into the lower to middle-income category. The article employs a qualitative research approach with a descriptive-argumentative methodology, utilizing Harry J. Benda’s theory of change and sustainability as an analytical tool. The findings reveal a shift in the Nahdliyin zakat management fiqh tradition in three aspects: zakat fund collection through LAZISNU, the broadening of the meaning of fī sabīlillāh (on the path of God), and the differentiation between zakat collectors (‘āmil) and zakat committees. This shift is attributed to changes in the method of NU legal opinion (fatwā) determination from the qawlī to the manhaji. To enhance the social welfare of Nahdliyin, NU consistently participates actively through its Islamic philanthropic actions by modernizing zakat management adapted from technological advancements.

Abstract

In the midst of the rampant divorce that occurs in Palangka Raya, Kepompong Community is present to provide parenting practice services for its members. This study aims to examine the extent of maqāṣid syarī'ah implementation in parenting practices conducted by Kepompong Community at Sekolah Alam Palangka Raya. This juridical-empirical research uses a conceptual approach to examine the description of parenting practices in the community. The source of data is from interviews with resource persons, among others: the initiator of the Kepompong community and members of the Community and teachers of Sekolah Sahabat Alam. The results showed that the parenting program conducted by Kepompong Community is a parenting seminar by experts, family consultation and family gathering. The purpose of the program is to understand the members about parenting patterns and realize the importance of creating a harmonious family, as well as building an environment full of togetherness. From these activities, it can be seen how the community contributes to guiding families towards the concept of sakinah, which is in line with the maqāṣid syarī'ah, namely the protection of religion, soul, offspring, mind and property. Thus, Kepompong Community's parenting practices can be used as a model by other communities so that harmonious families can be realized. In addition, collaborating institutions such as Pusaka Sakinah, Komnas Perempuan and DPPPA are expected to take part in facilitating parenting practices for the community considering the urgency of these activities because harmonious families are the foundation of a strong state.

Abstract

Abstract: Islamic civil society participation in democratization among Muslim countries is still being questioned, including in Indonesia. Nevertheless, this article provides evidence concerning the notion that saprah amal, as part of Islamic philanthropy practice, has strengthened democratization in Muslim countries based on Sherry R. Arnstein’s theory of participation. To answer questions about the role of saprah amal as a reasonable proxy for the practice of generosity, how to negotiate charity, and its participation in empowering democracy in Indonesia. These several research findings, firstly, saprah amal is a unique tradition from Banjar Islamic community and becomes a proxy for indigenous generosity practices. Charity auctions through influencers in the saprah amal tradition are also a unique way of negotiating in giving. Second, the spirit of togetherness in charity is an excellent social capital to overcome the limit of state developmentalism. Lastly, the practice and tradition of saprah amal is a form of expression and participation of the Banjar Islamic society to participate in nation-building, recognized and guaranteed by the Indonesian constitution.
