Abstract

The charismatic power of ondoafi as a leader in customary government can determine the direction of the policy including the resolution of problems of indigenous people. In the new order Era, ondoafi was not involved further in resolving land issues, so he would not be labeled as part of the Free Papua Movement (OPM). In the Special Autonomy era, the roles of ondoafi got stronger as indicated by the privileges given by the government to indigenous people in Papua. This paper explores the roles of ondoafi in resolving the conflict over the customary land in Sentani, Jayapura, Papua, using a qualitative approach with secondary data. The result of the research shows that ondoafi could not resolve the conflict over the customary land in Sentani effectively due to the discrepancy of values between the conflicting parties. Nevertheless, ondoafi should become a mediator to resolve the conflicts between indigenous people and non-indigenous people; including privates or corporates and the central government. An ondoafi should be able to become a diplomat who can bridge the values differences between the conflicting parties and urge the conflicting parties to understand others’ interests and values so that conflicts can be resolved in a peaceful manner.

Abstract

The background of the study is the existence of Fiqh Muhammadiyah and Fiqh Nahdlatul Ulama in coping with disaster, in response to the phenomenon of disasters happened in Indonesia, which has taken many victims and caused various losses. Muhammadiyah and Nahdlatul Ulama are two largest Islamic community organizations in this country, so the way on managing the society is always interesting to study, including FIQH (ISLAMIC JURISPRUDENCE) of coping the disaster.Based on the reasons above, the backgrounds of the study are how do muhammadiyah and nahdhatul ulama apply their fiqh (islamic jurisprudence) to cope with disaster? and why do they apply their fiqh?This study is library research using qualitative design and comparing between the two fiqhs from both Muhammadiyah and Nahdatul ulama. The researcher applies Philosophical approaches, through the term epistemilogi bayani, burhani dan ‘irfani as instruments to clarify the content of both fiqhs to find the answer for both research problems above.The findings are the guideline and methodhology used both Muhammadiyah and Nahdatul ulama covered in both fiqhs; there are several differences on the Basic conceptions related to beliefs and Aqida; ethical and moral formulations and practical things. Muhammadiyah Fiqh explained in details regarding with practical procedures and steps of worship in coping with disaster, while Nahdlatul Ulama Fiqh explained only practical guidelines in coping with disaster.The other finding is related to the triple epistimology. The point of bayani on both fiqhs are relatively similar, same level and size. The point of burhani on Muhammadiyah fiqh gave deeper understanding than Nahdlatul Ulama fiqh. And the point of ‘irfani neither muhammadiyah nor Nahdlatul Ulama seem to use it. The fact of the differences refers to the basic methodology from both organizations; Muhammadiyah refers from verse and hadith, while Nahdlatul Ulama refers from aqwal ulama, although both of them refer to the verse, hadith and the decree of classical ulama (preachers)

Abstract

Handling corruption cases is not always consistent in emphasizing the element of intention/intentionally. Theoretically, the concept of deliberation has been put forward by some experts. However, in the realm of implementation the theoretical studies of those experts become contradictory. This is because there is no certainty of indicators of intent. Deliberation in this research is viewed from criminal law and psychology. The method used in this research is Forum Group Discussion (FGD). Then also is performed professional judgment by legal practitioners and academics. The results show that law enforcers have a common perception in viewing the deliberate in cases of corruption. Law enforcers in understanding the Articles use the theory of science and the theory of Possibility in Certainty. It is deliberate behavior when viewed from psychology produces a construct that can be measured using the science theory.

Abstract

The study explores the causes of the controversy between the Muhammadiyah and the State in the policy of ecological law in Indonesia. The exploration uses methods of normative law research with conceptual approaches and philosophy of law. The results of this study show that the contestation of the Muhammadiyah and the State in ecological law politics in Indonesia is caused by the first factor of epistemological differences in legal policy, the epistemology of Muhammadiyah in line with the Islamic ecological concepts of Tauhid, Khilafah, Amanah, Halal Haram, Balance and Misconduct. This epistemology differs from what the state practices, namely industrialization, which is reflected in the birth of some legislative regulations that are considered ecologically unfair. Both paradigm differences, Muhammadiyah advances theoantroposentrism. As God's representative on earth, Muhammadiyah takes precedence over a prophetic perspective. The State paradigm also in practice needs to industrialize for economic growth, so that in practice there is controversy in legal politics. In practice, the controversy led to a change in the political direction of ecological law in Indonesia as Muhammadiyah succeeded in conducting judicial review, criticizing state policy to advocating the law against societies in conflict ecological sector

Abstract

H}isbah is an important way of monitoring is known by the Muslims in the early days of Islam that completes supervision to correct and prevent ethical lapses. H}isbah during Umar have an important role in market surveillance and the activities carried out in them, which is ekonomi. This article is aimed at the most important things that exist in the economy by Umar jurisprudence on h}isbah and its role in overseeing economic activities. H}isbah is in etimolgy and terminology revolves around the ordering good and forbidding the evil (amar ma’ruf nahi munkar). Terminological meaning h}isbah was ordered to leave if there is goodness and forbid unjust if there are practiced. The concept of hisbah above extends to cover all members of society capable of ordering the good and forbidding the evil, whether they are assigned by the state or did not required by resmi. Sebagaimana space h}isbah scope includes the rights of Allah and the rights of man. This means that h}isbah cover all facets of life. Where is the discussion here will be narrowed explanation h}isbah implementation by the state at the time of Umar in matters related to the economy

Abstract

: In the reform era, there was a transformation of the legal products of the Tarjih Muhammadiyah Council from monodisciplinary to multidisciplinary. One of the new products is fiqh which carries the concept of responsive fiqh. The issue of ecological politics in Indonesia is the dominant issue responded to. This research seeks to reveal the shift in the concept of fiqh muhammadiyah from monodisciplinary to multidisciplinary and criticalism fiqh muhammadiyah respond to the political constellation of ecological law in Indonesia in the reform era. The research uses normative legal research methods with a political approach to law. Data was collected through literature research. The results of this study indicate that Muhammadiyah jurisprudence is a new paradigm of responsive jurisprudence that is in line with the spirit of tajdid and ijtihad. The factor of the shift in the legal products of the Tarjih Assembly is largely determined by the role of the chairman of the Tarjih Assembly itself. Of the many fiqh products issued by the Tarjih Assembly, this study highlights Muhammadiyah fiqh products related to ecology. First, water fiqh responds to the alarming and global water crisis. In addition, water fiqh is also the basis for Muhammadiyah to conduct a judicial review of Law No. 7 of 2004 concerning Water Resources (SDA) which was granted by the Constitutional Court, in this context there is accommodation of water fiqh in ecological politics in Indonesia. Second, disaster jurisprudence responds more to social problems that are also connected to ecological problems in the disaster sector and there is no contestation or accommodation in the context of ecological legal politics. Third, Agrarian Jurisprudence responds to various agrarian problems in Indonesia such as food self-sufficiency, environmental damage, agrarian conflicts, indigenous peoples, and housing and access to public space. So that in this Fikih there is contestation with state policies in ecological politics. so that Muhammadiyah Fikih takes a role in efforts to realize a democratic political configuration that seeks to contribute fully and egalitarian to actively influence government policies.

Abstract

The reform era witnessed a shift in the Tarjih Muhammadiyah Council’s legal outputs from monodisciplinary to multidisciplinary, resulting in a product known as responsive fiqh. Ecological political issues in Indonesia became a primary focus of this new approach. This research aims to analyze the Tarjih Muhammadiyah Council’s conceptual shift from monodisciplinary to multidisciplinary fiqh, and to explore how its critical fiqh responds to the ecological legal-political constellation in Indonesia during the reform era. This research employed normative legal research methods, utilizing a political approach to law. Data were gathered through literature review. The findings reveal that Muhammadiyah’s fiqh represents a new paradigm of responsive fiqh, aligned with the principles of tajdid and ijtihad. The shift in the Tarjih Council’s legal outputs is largely attributed to the leadership of its chairman. From the Tarjih Council’s diverse fiqh outputs, this research selected and highlighted Muhammadiyah’s fiqh products pertaining to ecology. First, the Fiqh of Water addresses the alarming, global water crisis, serving as the legal basis for Muhammadiyah’s judicial review of Law No. 7/2004 concerning Water Resources, which the Constitutional Court upheld, signifying the incorporation of this fiqh into Indonesia’s ecological political landscape. Second, the Fiqh of Disaster Management, addressing socio-community issues linked with ecological problems in disaster contexts, has not resulted in contestation or accommodation within ecological politics. Third, Agrarian Fiqh addresses varied agrarian challenges in Indonesia, including food self-sufficiency, environmental degradation, agrarian conflicts, indigenous community rights, and housing and public space access, thereby engaging in contestation with state policies within the realm of ecological politics. In this way, Muhammadiyah’s fiqh seeks to actively contribute to establishing a democratic political configuration by ensuring comprehensive and egalitarian influence on government policies.

Abstract

This study reveals how Islamic law and human rights can be a voice of justice in challenging situations, offering exciting and relevant answers for a harmonious future of peace. The research method applied in this study is designed in an integrative and comprehensive manner to explore the relationship between the two in the context of conflict separatism. The study results show that Islamic law and human rights have similar perspectives in respecting religious plurality, avoiding discrimination, and prioritizing peace in dealing with conflict separatism. Both emphasize the importance of understanding the root causes of conflict and seeking comprehensive and sustainable solutions to achieve reconciliation and just peace. In separatism conflicts, Islamic law and human rights also emphasize the importance of social justice, solidarity, education, and accountability as integral parts of conflict management. Both perspectives view that efforts to achieve peace and reconciliation must involve all elements of society, including religious leaders, community leaders, and community organizations, in mediating and promoting peace values.  In addition, the harmony between Islamic law and human rights emphasizes the importance of understanding human rights as a universal value that must be upheld by all people, not only in the context of separatism conflicts but also in broader social and political life.

Abstract

Law No. 22 of 2022 on Corrections is a legal reform that replaces Law No. 12 of 1995. Before the enactment of this law, correctional regulations were governed by several rules, including Government Regulation No. 99 of 2012, Ministry of Law and Human Rights Regulation No. 3 of 2018, and Ministry of Law and Human Rights Regulation No. 7 of 2022. However, in practice, Law No. 22 of 2022 still leaves unresolved issues of inconsistency with the principles and objectives of the state, particularly regarding the substance of granting remission to corrupt prisoners. This article examines these regulations from the perspective of siyāsah tasyrī’iyyah and assesses their relevance to anti-corruption efforts. The research uses a normative legal method with a legislative approach, utilizing the theory of siyāsah tasyrī’iyyah and legislative theory. The research results indicate that the rules on remission for corrupt prisoners only partially fulfill the principles of siyāsah tasyrī’iyyah, namely the principle of gradualism in enacting laws and simplifying regulations. Meanwhile, the principles of ease, public interest, and justice have not been realized. Based on Article 28 of the 1945 Constitution, human rights can indeed be restricted by law, so the restriction of remission for corrupt prisoners is considered valid. Therefore, Article 10 of Law No. 22 of 2022 must be revised. Undang-Undang Nomor 22 Tahun 2022 tentang Pemasyarakatan hadir sebagai pembaruan hukum yang menggantikan Undang-Undang Nomor 12 Tahun 1995. Sebelum lahirnya undang-undang tersebut, aturan pemasyarakatan ditetapkan melalui beberapa regulasi, antara lain PP Nomor 99 Tahun 2012, Permenkumham Nomor 3 Tahun 2018, dan Permenkumham Nomor 7 Tahun 2022. Namun, dalam praktiknya, Undang-Undang Nomor 22 Tahun 2022 masih menyisakan problem ketidaksesuaian dengan asas dan tujuan negara, terutama terkait substansi pemberian remisi bagi narapidana korupsi. Artikel ini membahas pengaturan tersebut dalam perspektif siyāsah tasyrī’iyyah dan menelaah relevansinya terhadap upaya pemberantasan korupsi. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan, serta memanfaatkan teori siyāsah tasyrī’iyyah dan teori legislasi. Hasil penelitian menunjukkan bahwa aturan remisi bagi narapidana korupsi hanya memenuhi sebagian prinsip siyāsah tasyrī’iyyah, yaitu prinsip berangsur-angsur dalam penetapan hukum dan prinsip penyederhanaan peraturan. Sementara prinsip kemudahan, kemaslahatan, dan keadilan belum terwujud. Berdasarkan Pasal 28 UUD 1945, hak asasi manusia memang dapat dibatasi oleh undang-undang, sehingga pembatasan remisi bagi narapidana korupsi dinilai sah. Oleh karena itu, Pasal 10 UU No. 22 Tahun 2022 dipandang perlu untuk direvisi.
