Abstract

The important role which should be played by the national banking world for the present and forthcoming is positioning itself as one of the main pillars for national development oriented to the improvement of people's welfare. The economic development of a country, of course, indispensable presence settings regarding the management of economic resources available to run with directional and integrated. Research methods in this thesis using normative juridical approach. Based on the results of research and discussion on the subject matter presented in this thesis research, the results of this study is to analyze the comparative clause, the legal basis and purpose of the loan agreement with Bank BRI Bank BRIS murabaha contract, it can be found similarities and differences.While the banking system on the external control (conventional and sharia) conducted by BI, OJK, and specifically Islamic banks are supervision of DPS. There are 2 monitoring system conducted by BI is based compliance monitoring, risk-based supervision. Conditions of supervision of Bank Indonesia since the enactment of authority OJK dated December 31, 2013 has been restricted to macroprudential supervision as microprudential supervision was transferred to the OJK, but between BI and the OJK remains mutual correspondence. Supervision of DPS to Islamic banks is very important in maintaining and mengawasai that Islamic banking in running its operations remain in accordance with Islamic principles.Keywords : National banking, BRI syari’ah, Akad Murabbah

Abstract

Socialization and assistance for Micro and Small Business Permits (IUMK) in Karang Kemiri Village, Karang Lewas Subdistrict through the Online Single Submission System (OSS) began with the results of a survey that many UMKM did not have a permit. This is due to the lack of socialization and education on the importance of IUMK. This community service activity was attended by 20 UMKM consisting of 14 UMKM engaged in the culinary sector, 3 UMKM engaged in fashion and 3 UMKM engaged in skills. The high level of enthusiasm was shown by the number of participants asking questions about legality and interested in managing the legality of their business. The IUMK process is carried out by OSS, namely via a smartphone so that the process is easy, fast and free of administration fees. The benefits of having an IUMK are that UMKM have a clear, legal identity, added value for access to capital and can develop businesses by participating in empowerment and coaching programs held by local and central governments. Results show an increase in the understanding and legal awareness of UMKM to take care of the legality of their business. Sosialisasi dan pendampingan Izin Usaha Mikro Kecil (IUMK) di Desa Karang Kemiri Kecamatan Karang Lewas melalui Sistem Online Single Submission (OSS) berawal dari hasil survey bahwa banyak pelaku UMKM yang belum mempunyai izin. Hal ini disebabkan karena kurangnya sosialisasi dan edukasi arti penting IUMK. Kegiatan pengabdian masyarakat ini dihadiri oleh 20 UMKM terdiri dari 14 UMKM bergerak dibidang kuliner, 3 UMKM bergerak dibidang fashion dan 3 UMKM bergerak dibidang keterampilan. Tingkat antusiasme yang cukup tinggi ditunjukan dengan banyaknya peserta mengajukan pertanyaan seputar legalitas dan berminat untuk mengurus legalitas usahanya. Proses IUMK dilakukan secara OSS yaitu melalui smartphone sehingga prosesnya mudah, cepat dan bebas biaya administrasi. Manfaat memiliki IUMK yaitu UMKM memiliki identitas yang jelas, legal, nilai tambah untuk akses permodalan dan dapat mengembangkan usaha dengan mengikuti program-program pemberdayaan dan pembinaan yang diadakan oleh pemerintah daerah maupun pusat. Hasil PKM menunjukkan peningkatan pemahaman dan kesadaran hukum UMKM untuk mengurus legalitas usahanya.

Abstract

Many factors lead people to get married even though their age do not meet the requirement of the Marriage Law. It happens because they desire to avoid the adultery tradition or probably their mate is being pregnant. It becomes problem when people who are under nineteen years old involve to this issue. They actually require additional legal consideration and the existence of legal certainty regarding to the abridge pace of the registration offer until the presence of establishment. The invocation proposes by the parents are for the sake of their children. By mean of these, this study aimed to investigate the practice of principles such as a brief, simple and low-cost toward the case of a marriage dispensation petition through the ethic Contante Justitie. This study used the empirical juridical approach to gain the facts from the implementation of Contante Justitie, and this study belongs to descriptive qualitative research. The data were collected from primary data supported by secondary data. The data gathered from official document, literature, and the results of unstructured interview. Then, the results are presented through texts and qualitative descriptive analysis. The result has indicated that the basis principles of Contante Justitie has implemented in surroundings religious court in Purwokerto. It is useful to protect underage marriage due to the pressing reasons to get married.

Abstract

Sebuah kebijakan pemerintah akan memberikan pengaruh di masyarakat, khususnya dalam penelitian ini akan membahas tentang adanya kebijakan pencatatan perkawinan siri di Kartu Keluarga (KK) dalam kajiannya dari sudut pandang administrasi kependudukan yang memberikan tercapainya hak publik Warga Negara Indonesia dalam kepastian memperoleh syarat pengadministrasian kependudukan yang dapat dipakai untuk proses pengadministrasian kependudukan dan proses sosial seperti mendaftarkan sekolah dan pembuatan akta lainnya. Sedangkan dalam sisi status hukum hal ini tidak memberikan perlindungan hukum terhadap pihak yang terkait. Penelitian ini dilakukan dengan metode penelitian kualitatif dengan pendekatan deskriptif terkait adanya kebijakan pencatatan perkawinan siri di Kartu Keluarga (KK) dari sudut pandang administrasi kependudukan dan status hukum. Adapun sumber data yang digunakan menggunakan data sekunder dari data kepustakaan misalnya kebijakan pemerintah yang berupa peraturan perundang-undangan maupun sumber referensi tertulis lainnya yang berkaitan dengan penelitian ini.

Abstract

Abstract. Dagan Village has an unhealthy behavior in processing household waste, namely by burning their waste. This behavior has a negative impact on the health of both the environment and humans. Krenova was presented to the Dagan community as an alternative solution to this problem. Krenova is a waste burning device with minimal smoke that can be used to burn communal waste equivalent to 1 RW's waste. Installation of this tool includes three stages, namely preparation, installation, and monitoring-evaluation. The preparation stage includes community outreach with waste science and empowerment techniques. The installation stage involved three-way coordination, namely between the Service Team, Dagan Village and Krenova Makers. The monitoring stage is carried out in two ways, namely online with the Krenova Team in Charge from the Village, and offline, namely through direct visits. At the monitoring and evaluation stage, obstacles were found in the practice of burning waste using Krenova, and this became the basis for subsequent service activities. Abstrak. Desa Dagan memiliki perilaku mengolah sampah rumah tangga yang tidak sehat, yaitu dengan cara membakar sampah mereka. Perilaku ini memiliki dampak negatif terhadap kesehatan baik itu lingkungan maupun manusia. Krenova dihadirkan di tengah masyarakat Dagan sebagai solusi alternatif bagi permasalahan tersebut. Krenova merupakan alat pembakar sampah minim asap yang bisa dimanfaatkan untuk membakar sampah komunal setara dengan sampah 1 RW. Instalasi alat ini meliputi tiga tahap yaitu persiapan, instalasi, dan monitoring-evaluasi. Tahap persiapan meliputi pengapasitasan masyarakat dengan sains sampah dan teknik pemberdayaan. Tahap instalasi melibatkan koordinasi tiga arah yaitu antara Tim Pengabdian, Desa Dagan dan Pembuat Krenova. Tahap monitoring dilakukan melalui dua cara yaitu secara daring dengan Tim Penganggung Jawab Krenova dari Desa, dan secara luring yaitu melalui kunjungan langsung. Pada tahap monitoring dan evaluasi ditemukan kendala pada praktik pembakaran sampah menggunakan Krenova, dan ini menjadi landasan bagi kegiatan pengabdian berikutnya.

Abstract

Penelitian ini membahas kelayakan pemekaran Kabupaten Banyumas menjadi tiga daerah otonom dalam kerangka desentralisasi dan otonomi daerah di Indonesia. Pemekaran wilayah dipandang sebagai salah satu strategi untuk memperpendek rentang kendali pemerintahan, meningkatkan kualitas pelayanan publik, serta mendorong pemerataan pembangunan. Secara historis, kebijakan sentralistik Orde Baru menciptakan ketimpangan pembangunan, yang kemudian dijawab melalui reformasi 1998 dengan pemberlakuan otonomi daerah. Landasan hukum pemekaran ini diperkuat oleh UUD 1945 Pasal 18, UU No. 23 Tahun 2014, serta PP No. 78 Tahun 2007. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, melalui analisis terhadap bahan hukum primer dan sekunder. Hasil kajian menunjukkan bahwa Banyumas layak dipertimbangkan untuk dimekarkan berdasarkan aspek administratif, kewilayahan, demografis, ekonomi, sosial-budaya, serta kesiapan infrastruktur. Pemekaran diproyeksikan mampu mempercepat pemerataan pembangunan, terutama di wilayah pinggiran yang selama ini tertinggal, sekaligus menciptakan pusat-pusat pertumbuhan ekonomi baru berbasis potensi lokal. Namun demikian, kelayakan ekonomi dan fiskal masih bersifat kondisional. Diperlukan strategi untuk memperkuat Pendapatan Asli Daerah (PAD), meningkatkan kapasitas birokrasi, serta menjamin tata kelola pemerintahan yang transparan dan partisipatif. Rekomendasi utama penelitian ini adalah penyusunan masterplan pembangunan terpadu, penguatan sistem keuangan daerah, dan keterlibatan masyarakat secara aktif dalam proses pemekaran. Dengan langkah tersebut, pemekaran Banyumas diharapkan tidak hanya menghasilkan entitas administratif baru, melainkan juga mewujudkan tujuan utama otonomi daerah, yaitu peningkatan kesejahteraan masyarakat secara merata.

Abstract

State forest management in Indonesia faces a complex problem due to the existence of community-owned land within the state forest area, which often triggers tenurial conflicts. This study is conducted to analyze the legal status of community land ownership within state forests and assess dispute resolution based on the principles of Pancasila Justice. The research method adopted is a juridical-empirical approach, which is normative in terms of forestry and agrarian laws and regulations, and empirical through field observations and limited interviews conducted in the KPH East Banyumas. Research findings indicate that there were 0.9 hectares of community-owned land in Plot 14 of RPH Kaliputih, Forest Management Unit Section of Jatilawang, which has been factually controlled and cultivated for years with clear physical boundaries. Administratively, it still falls under a state forest area, as per the BATB. The dualism of regulations between the Forestry Law and the Basic Agrarian Law resulted in a lack of synchronization of interpretation and weak legal certainty. Through the Pancasila Justice Perspective, it is necessary for the settlement of disputes not only to be formally lawful but also to balance the rights of the state and the community, environmental sustainability, and social justice. An integrative resolution model is recommended through regulatory harmonization, verification of enclave land status, strengthening deliberation-based mediation mechanisms, and protection of the community rights based on the principle of substantive justice.

Abstract

This study aims to determine the legal status of Microfinance Limited Liability Companies (PT. LKM) established by Joint Village-Owned Enterprises (BUM Desa bersama) using revolving funds from the former National Program for Rural Community Empowerment (PNPM MPd) prior to the enactment of the Job Creation Law. The research method used was normative juridical with a legislative and conceptual approach. Based on the results of the research, it can be concluded that prior to the issuance of the Job Creation Law, the status of PT. LKM that used community revolving funds was not in accordance with the applicable laws and regulations, such as PT. LKM Kedungmas in Banyumas Regency. The results of this study are expected to provide input for PT LKM or other legal entities that manage revolving funds from PNPM MPd activities before the enactment of the Job Creation Law to comply with applicable laws and regulations.

Abstract

Penelitian pada artikel ini menggunakan jenis penelitian yuridis empiris atau penelitian hukum empiris, yaitu penelitian hukum yang dilakukan oleh peneliti dengan melakukan pengamatan secara langsung di lapangan. Penelitian ini juga menggunakan analisis data kualitatif yang bertujuan untuk menganalisis dan memberikan gambaran seberapa efektifnya sinergi lintas sektoral dalam penanganan kekerarasan seksual terhadap anak di Unit Pelayanan Perempuan dan Anak Kepolisian Resor Kota Banyumas secara jelas dan rinci. Hasil dari penelitian ini juga didukung dengan adanya data kasus kekerasan seksual terhadap anak di wilayah Banyumas, seperti persetubuhan dan pencabulan yang trennya itu semakin menurun dan cepat teratasi sehingga dari tren tersebut menunjukan bahwa sinergi antara Unit PPA dengan lembaga-lembaga terkait seperti UPTD PPA, Polisi Resor, Dinas Sosial, Lembaga Kesehatan, Lembaga Bantuan Hukum sudah efektif. Hambatan yang dihadapi dalam upaya sinergi antar lembaga dalam menangani kasus kekerasan seksual terhadap anak bersumber dari sikap masyarakat, keluarga, dan bahkan dari korbannya sendiri yang menjadi penghambat bagi sinergi antar lembaga dalam menangani kasus kekerasan seksual terhadap anak.
