Abstract

This research was conducted to find out the model of empowerment of the poor through a pesantren-based Micro-Wakaf Bank (BWM) financing scheme in Islamic Microfinance Institutions (LKMS) Ranah Indah Darussalam Ciamis. The existence of BWM in the Indonesian legal system is under three different legal protections, namely Law Number 25 of 1992 concerning Cooperatives, Law Number 1 of 2013 concerning Microfinance Institutions and POJK No. 12 / POJK. 5/2014 concerning Business Licensing and Institutions of Microfinance Institutions. The empowerment model carried out by BWM Ranah Indah Darussalam in the form of financing business capital using the Al-Qardh contract by prioritizing education (tauhid, discipline, tepo sliro) and mentoring (business and management development).

Abstract

Tujuan utama penelitian ini adalah untuk menganalisis peraturan mengenai standarisasiproduk dalam upaya melindungi konsumen dihubungkan dengan implementasiMaqashid al-Syari’ah. Penelitian yang dilakukan merupakan penelitian deskriptifanalitis dengan pendekatan yuridis normatif. Data diperoleh dari penelitian kepustakaan(library research) selanjutnya dianalisis secara kualitatif dan disimpulkan bahwastandarisasi produk nasional Indonesia sangat erat kaitannya dengan perlindungankonsumen dan merupakan wujud nyata implementasi Maqashid al-Syari’ah berupaterlindunginya agama (hifdzu din), terlindunginya jiwa (hifdzu nafs), terlindunginyapikiran (hifdzu 'aql), terlindunginya harta (hifdzu maal), dan terlindunginya keturunan(hifdzu nasab).

Abstract

This study aims at providing an insight into the legal status of waqf through application in fintech pursuant to Law No41 of 2004 and Law no 11 of 2008 on Information and electronic transactions, a form of nadzir responsibility for managing waqf assets through fintech applications and then seeking a model for the economic empowerment of individuals through through the use of fintech applications. The method employed in this study is a method of regulation, referring to qualitative legal research. The results found that the application of fintech applications in the management of cash waqf is not specifically governed by Waqf or ITE Law, but still permitted as long as the applicable law is not in contravention. In the management of waqf nazhir, the management of waqf properties shall be responsible and legal proceedings can be taken in the event that waqf property is lost due to negligence. In collaboration with Bandung's city of fintech companies, the sharia cooperative registered as Nazhir waqf cash is owned only by KSPPS BMT ITQAN where, in the form of SME finance for members based on waqf funds, the model of waqf management is used through the Rumah Pembiayaan Majelis (RPM) empowerment program, based on a fintech application called itQanmobile and kitawakaf.com, a social crowdfunding platform fintech

Abstract

Tujuan penelitian ini dilakukan adalah untuk mengeksplorasi hukum pembiayaan asset tanah wakaf produktif melalui platform financial technology dilihat dari perpspektif tafsir hukum ekonomi syariah. Penelitian ini merupakan penelitian kepustakaan (library research) dengan menggunakan pendekatan deskriptif-analitis dimana peneliti mengumpulkan data-data sekunder yang bersumber dari beberapa kitab tafsir, norma hukum positif khususnya Undang-Undang Wakaf, Peraturan Pemerintah tentang Wakaf, Buku ke III Kompilasi Hukum Islam, buku referensi terkait wakaf, dan beberapa jurnal serta hasil penelitian lain yang dipublikasikan yang kemudian dianalisis secara deskriptif untuk menjawab pertanyaan penelitian. Secara umum ayat al-Quran dan Hadits yang berkaitan dengan wakaf hanya memberikan gambaran tentang motivasi atau keutamaan berwakaf dan anjuran mengenai tentang produktifitas wakaf. Jumhur ulama sepakat bahwa wakaf hukumnya adalah sunnah muakkadah. Terkait pemanfaatan technology financial dalam pembiayaan asset wakaf produktif hukumnya diperbolehkan sebagaimana keumuman kaidah tentang asal muamalah adalah boleh yaitu “Al-Ashlu Fii al-Mu’amalati Al-Ibahatu Illa An Yadhulla Addalilu ‘Alaa Tahriimihaa” artinya asal mula setiap muamalah adalah boleh hingga ada dalil yang mengharamkannya.

Abstract

This study aims to analyze the role of the state in the economy through the lens of Baqir al-Shadr's economic theory. Article 33 of the 1945 Constitution connects this theory to the state's exercise of control. This literature research method gathers and examines secondary data from books, scientific journals, research findings, and pertinent articles using a qualitative method, followed by a normative analysis. According to Baqir al-Shadr, the research findings indicate that Islamic economics is not considered a scientific discipline but rather the practical application of Islamic sharia principles rooted in religious beliefs and devotion. This includes the promotion of social justice and the acknowledgement of various forms of property ownership. Second, exploitative and uncontrollable human behavior, rather than a lack of natural resources, is the true cause of economic issues. Furthermore, the government's involvement is necessary for the oversight and resolution of economic issues, particularly in ensuring the well-being of the population and achieving social equilibrium. Article 33 of the 1945 Constitution explicitly grants the state the authority to manage natural resources for the benefit of the people. This abstract presents a concise summary of the correlation between Baqir al-Shadr's economic ideology and the notion of state control, specifically in regard to Article 33 of the 1945 Constitution. It also examines the effects of this correlation on economic regulation and society's welfare.

Abstract

The aim of this research is to examine the influence of financial literacy and financial inclusion on investment decisions mediated by the use of financial technology. This research is quantitative research with data collection techniques using questionnaires and literature study. Variable measurement uses the Likert Scale technique with a weight scale from 1 to 5. The sample selected as respondents for this research was 100 people, from the total number of millennial generations in DKI Jakarta using the purposive sampling method. The data processing method in this research is structural equation modeling (SEM). The research results show that: 1) Financial literacy has a positive effect on investment decisions. 2) financial inclusion has a positive effect on investment decisions. 3) Financial technology has a positive influence on investment decisions. 4) Financial literacy has a positive effect on financial technology. 5) Financial inclusion has a positive effect on financial technology. 6) Mediating financial technology to influence financial literacy on investment decisions. 7) mediate financial technology to influence financial inclusion on investment decisions.

Abstract

The purpose of this study was to clarify how Sharia Economic Law is used to settle disputes involving cooperative businesses in Indonesia. This study uses a qualitative approach to the literature to investigate secondary data sources pertaining to Indonesian legislation and regulations pertaining to commercial conflict resolution. The findings demonstrated the crucial role that sharia cooperatives play in the Islamic economic system, particularly as a substitute finance source for the lower middle class. According to Indonesia's legal system, sharia business disputes, including those involving sharia cooperative businesses, can be settled through family mediation, legal proceedings in religious courts with absolute jurisdiction, arbitration, or alternative dispute resolution organizations like LAPSPI (banking), BMAI (insurance), BMDP (pension funds), BAPMI (capital market), BMPPVI (venture capital), and BAMPPI (guarantee). The establishment of LAPS Cooperatives that mesh well with the cooperative's spirit and have access to human resources with expertise in sharia-based cooperative business become crucial factors to take into consideration. Sharia cooperatives are seen as a unique type of business entity that operate member-based businesses that simultaneously hold two statuses (owner and user) and cooperative wealth owned by all cooperative members who run their businesses according to sharia principles
