Abstract

Proyek LRT Jabodebek merupakan bagian dari Proyek Strategis Nasional (PSN) yang dirancang untuk menyediakan moda transportasi massal modern guna mengatasi kemacetan di kawasan Jabodebek sekaligus meningkatkan mobilitas masyarakat urban. Namun, pelaksanaannya dihadapkan pada kompleksitas hukum yang melibatkan berbagai aspek, seperti hukum perdata, hukum administrasi negara, hukum pidana, hukum ketenagakerjaan, hukum pertanahan, hukum pendanaan, dan hukum lingkungan. Penelitian ini menggunakan metode yuridis normatif untuk menganalisis aspek hukum yang relevan dalam pelaksanaan proyek LRT Jabodebek. Hasil analisis menunjukkan bahwa aspek hukum perdata memastikan legalitas kontrak kerja konstruksi, sementara hukum administrasi negara mengatur pemenuhan izin seperti AMDAL, PBG, dan SLF. Kepatuhan terhadap hukum pidana diperlukan untuk mencegah tindakan korupsi, hukum ketenagakerjaan untuk menjamin perlindungan hak pekerja, dan hukum pertanahan untuk melindungi hak masyarakat serta pemilik lahan. Selain itu, pengelolaan pendanaan yang optimal serta mitigasi dampak lingkungan yang efektif mendukung penerapan prinsip keberlanjutan. Proyek LRT Jabodebek menjadi contoh keberhasilan integrasi antara pembangunan infrastruktur modern dengan kepatuhan terhadap regulasi hukum yang mampu memberikan manfaat ekonomi, sosial, dan lingkungan. Studi ini menekankan pentingnya penerapan aspek hukum yang komprehensif untuk mendukung infrastruktur yang berkelanjutan dan berkualitas tinggi, sekaligus menjadi acuan untuk pembangunan proyek strategis nasional lainnya.

Abstract

Purpose –This study aims to analyze the impact of design changes from lattice tower to steelpole on the 150 kV New Garuda Sakti - Perawang electricity transmission project, with a focus on legal and financial implications, including cost claims, material efficiency, and land acquisition. Methodology/approach –This study uses a qualitative approach with analysis of contract documents, applicable legal regulations, and technical data related to the project. Additional data were obtained through a literature review of relevant regulations, such as Presidential Regulation No. 16 of 2018 and Law No. 2 of 2017, as well as the international standard FIDIC Conditions of Contract. Findings –The design change from lattice tower to steelpole provides material efficiency because it utilizes waste material without new procurement. The use of land owned by the road eliminates the need for land acquisition, but there are additional costs arising from the adjustment of installation and labor. From a legal perspective, claims for additional costs are acceptable if they are in accordance with the contract and supported by valid documentation.. Novelty/value –Given the importance of cost claims management and legal compliance in infrastructure projects, this research provides important insights for construction industry players in managing design changes and legal challenges.

Abstract

Objective -This study aims to analyze the legal and contractual aspects related to the reimbursement scheme for land and ROW payments as a solution to completing transmission construction work during the Covid-19 pandemic. Methodology/Approach– This study uses a case study approach by analyzing contract documents, perception alignment, and related agreements between PLN and contractors. This study also examines the main elements of the contract in terms of the scope of work, with the addition of a reimbursement clause for land payments and ROW (Right of Way) at cost, as well as the addition of payment procedures.Findings– The results of this study indicate that the method of adding land reimbursement and ROW clauses to the agreement between the two parties can help complete transmission construction work according to the planned target, even though construction was underway during the Covid-19 pandemic, where the pandemic caused PLN to divert part of the budget to handling and controlling the impact of Covid on human resources, so that the budget for the work was temporarily constrained during the pandemic. Novelty/Benefits– This study provides an alternative solution to the completion of transmission construction work during the Covid-19 pandemic, where budget constraints can be overcome by adding a land and row reimbursement clause that will be paid at cost to partners. This alternative solution can also be a practical reference for transmission construction work owners during the pandemic

Abstract

The provision of electricity has a very important and strategic role in realizing national development in Indonesia. PT PLN (Persero) as a State-Owned Enterprise (BUMN) which in the law is given the mandate in the provision of electricity carries out its role in the business of providing electricity, one of which is the construction of power plants. In the provision of electricity through the construction of power plants, PT PLN (Persero) can appoint a private company to become the developer of the Independent Power Produce (IPP) plant construction with a power purchase agreement scheme whose provisions are regulated by the Regulation of the Minister of Energy and Mineral Resources. In this study, we will analyze the dispute resolution mechanism in the agreement contract of PT. PLN (Persero) with PT. Poso Energy in the supply of electricity for the Poso hydropower plant through the International Chamber of Commerce. The method used in this study is the normative juridical method in the statute approach and the qualitative analysis method in the example of the Poso IPP hydropower contract to get an overview of the conclusion of the alternative dispute resolution chosen by the parties by paying attention to the applicable legal foundations and concepts in the dispute resolution of construction contract agreements.

Abstract

Kegiatan Pengabdian Kepada Masyarakat di Desa Purworejo terletak di Kecamatan Sragi, Kabupaten Pekalongan, di bagian barat Kabupaten Pekalongan, dekat dengan Pantura Wiradesa bertujuan untuk memberikan pemahaman kepada masyarakat Desa Purworejo tentang Hak Kekayaan Intelektual (HKI) dan membantu mereka dalam melindungi produk home industri mereka dengan mendaftarkan HKI. Ini adalah langkah yang penting dalam mendukung pengembangan usaha rumahan dan kreativitas masyarakat, serta melindungi hak-hak intelektual mereka. bahwa mayoritas penduduk Desa Purworejo adalah petani. Ini memberikan latar belakang ekonomi yang penting karena kegiatan pengabdian masyarakat akan membantu diversifikasi mata pencaharian melalui home industry. Hak Kekayaan Intelektual (HKI): Penjelasan mengenai pentingnya HKI untuk mendukung pembangunan dan kesejahteraan umum sesuai dengan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 sangat relevan. HKI mencakup hak cipta, paten, merek dagang, desain industri, dan lain-lain yang bisa berlaku untuk produk-produk home industry. Tujuan utama adalah memberikan pendampingan kepada usaha rumahan dalam melindungi HKI produk mereka dan memotivasi masyarakat untuk mendaftarkan HKI pada produk home industri. Hal ini dapat membantu masyarakat meningkatkan pendapatan mereka melalui perlindungan hukum atas karya-karya mereka. Metode Pelaksanaan Kegiatan : Pelatihan dan diskusi tentang pembuatan HKI adalah metode yang tepat. Ini akan memberikan pemahaman praktis kepada masyarakat tentang cara melindungi karya mereka. Waktu Pelaksanaan pada semester gasal tahun 2023. Hasil yang Diharapkan dari kegiatan ini adalah agar masyarakat memahami pentingnya legalitas produk home industri mereka dengan HKI. Dengan adanya pelatihan, diharapkan masyarakat akan termotivasi untuk mendaftarkan HKI pada produk mereka, sehingga produk-produk tersebut akan memiliki perlindungan hukum dan legalitas yang sesuai. Dampak Ekonomi: Melalui pelindungan HKI, masyarakat dapat meningkatkan nilai tambah produk mereka dan berpotensi memasarkannya dengan harga yang lebih baik. Ini dapat berkontribusi pada peningkatan pendapatan mereka dan perkembangan ekonomi di Desa Purworejo. Kegiatan seperti ini dapat berperan penting dalam memajukan usaha mikro dan home industri, memotivasi kreativitas masyarakat, dan melindungi hak-hak intelektual mereka. Selain itu, ini juga dapat menjadi langkah penting dalam mendukung pembangunan ekonomi dan kesejahteraan di daerah tersebut.

Abstract

Indonesia has a variety of languages, religions, tribes, and races as national characteristics. This diversity must be managed seriously by the young generation of the Indonesian nation. However, in the midst of this era of globalization, the young generation must face major challenges in managing the existing diversity, challenges in maintaining a sense of nationalism amidst the current of globalization that is starting to spread widely among the community. Because the sense of nationalism plays a very important role in uniting the differences in diversity that exist. The spread of the current of globalization has resulted in a sense of nationalism around society decreasing, especially for generation Z. The cause of the decline is the entry of foreign cultures into a country that is considered more modern and attractive because it is in accordance with the development of the times. Therefore, efforts are needed to maintain and foster a sense of nationalism in generation Z, by introducing a variety of Indonesian cultures, loving domestic products and cultures, implementing Pancasila in everyday life, and being more selective about the presence of foreign cultures into the country. Therefore, this study aims to determine the application of Pancasila in terms of fostering a sense of nationalism for generation Z in the era of globalization. The method used in this study is a qualitative method, namely a method whose discussion theory is obtained from various sources such as journals, books, and articles. The results of the study indicate that the application of Pancasila is very important in fostering a sense of nationalism in generation Z, because generation Z is very easily influenced by foreign cultures. The application of Pancasila can be carried out starting from elementary school to college through Pancasila education, where in Pancasila education studying Pancasila which is the basis of the Republic of Indonesia which can be used as a foundation for generation Z in fostering a sense of nationalism.

Abstract

This study examines the civil dispute resolution process between contractors and subcontractors in a construction project, based on a case study of PT. Alfa Mandiri versus PT. Hsing Loong Indonesia (Decision Number 124/Pdt.G/2020/PN.JKT.SEL). The dispute arose from a subcontract agreement drawn up solely in English and not in Indonesian, as required by Law Number 24 of 2009 concerning the National Flag, Language, Emblem, and Anthem. Furthermore, differing interpretations of the contract's contents and disharmony in project implementation led to a lawsuit filed with the South Jakarta District Court. This study aims to analyze the parties' responsibilities, the legal basis for contract cancellation, and the civil dispute resolution mechanism in construction projects in Indonesia.
