Abstract

Penelitian ini bertujuan menguraikan konstruksi norma  pencegahan dan penanggulangi plagiarisme dalam peraturan perundang-undangan  Indonesia, mendeskripsikan penerapan atau implementasi norma pencegahan dan penanggulangan plagiarisme pada beberapa  Perguruan Tinggi serta merekonstruksi norma pencegahan dan penanggulangan plagiarisme berdasarkan berdasarkan analisi peraturan perundang-undangan serta implementasinya.Untuk menjawab ketiga permasalahan tersebut,  peneliitan menggunakan pendekatan hukum non doktrinal yakni dengan melakukan inventarisasi seluruh peraturan perundang-undangan terkait pencegahan dan penanggulangan plagiarisme kemudian diikuti dengan  penelitian atas praktek pelaksanaannya pada  beberapa Perguruan Tinggi yang menjadi unit sampel dalam penelitian ini. Pengumpulan data primer dilakukan dengan cara wawancara mendalam terhadap responden di Perguruan Tinggi. Analisis dilakukan melalui 3 (tiga) tahap berdasarkan Miles dan Huberman yang mencakup reduksi data, display data serta verifikasi/penarikan kesimpulan.Penelitian menghasilkan : Pertama, terdapat inkonsistensi antarperaturan perundang-undangan, baik dalam taraf vertikal maupun horisontal. Kedua,ditemukan 2 (dua) pola dalam  implementasi penanggulangan plagiarisme pada perguruan tinggi yang menjadi sampel dalam penelitian ini. Untuk kasus plagiarisme yang menimpa langsung dosen internal perguruan tinggi yang bersangkutan,maka penanggulangannya menggunakan pendekatan perundang-undangan secara ketat dengan sanksi yang pasti. Sebaliknya, untuk penanggulanga plagiarisme yang terjadi pada perguruan tinggi yang bersangkutan tetapi  terduga plagiatornya berasal dari luar perguruan tinggi tersebut, penyelesaiaannya diserahkan sepenuhnya pemilik karya ilmiah yang dikutip, kepada pihak plagiator,   serta asal perguruan tinggi plagiator tersebut sudah menggunakan pendekatan norma perundangan-undangan untuk . Ketiga, rekonstruksi norma dilakukan dalam bentuk usulan perbaikan peraturan perundang-undangan (sinkronisasi) serta perbaikan cara penanggulangan plagiarisme yang ditemukan dalam penelitian ini. Keywords : Rekonstruksi Norma, Plagiarism, karya ilmiah, penulis akademik, plagiator.

Abstract

Abstract: Through political education of women are expected to know and understand the rights and obligations as citizens, so that women have a significant role in developing democracy and intelligent in determining political attitudes. It is time women are placed as the subject in the political arena, not solely as a political object, which appears to be merely exploit them for elite interests or political party. Conditions, due to a lack of political education for women. For that a good political education, are expected to materialize the political role of women in the life of society, nation and the state towards the realization of a democratic civil society and justice. Thus the urge strengthening women's political rights should be increased primarily through the regulation / legislation in favor of women. Empowerment of women in various aspects of social life and civic culture, very urgent to increase women's political role.

Abstract

Abstract

The development of human rights as an intrinsic element that exists in humans has existed for a long time. Awareness of the existence of human rights, self-esteem, dignity and human dignity has actually been started since humans were on earth. This is because human rights have naturally existed since humans were born and are rights that are inherent and inseparable from human beings. The constitution in force in Indonesia recognizes that the position of human rights is very vital, although there are differences in terms of quality and quantity, especially in adopting human rights instruments, socio-political conditions which then have an influence on the contents of the constitution. Thus, it is clear that human rights are a basic need of society that must be contained in a constitution, as well as related to the basic values of the nation state itself.

Abstract

Natural law always measures and evaluates law in terms of justice, justice is an inseparable part of law, therefore the essence of law is justice. If the law is not fair, then according to natural law it is not law. Meanwhile, legal positivism measures and evaluates the law from the perspective of formal justice. The priority of justice as in natural law, is not a priority in legal positivism. For legal positivists, the most important thing is what the law is, not how the law should be. Even outside the law there is no law, the law must be in written form, to be able to provide legal certainty. With the different points of view of the two schools of law, until now there is no common ground between natural law and legal positivism in formulating justice. Each is adamant and differs in determining justice. Natural law is always ideal and places justice in the highest place. Justice is a priority that is non-negotiable and becomes the spirit of the law. Therefore the law must be fair and just is a constitutive element rather than the law. Meanwhile, justice in the perspective of legal positivism is limited to formal justice/procedural justice, or in other words, formalism justice that prioritizes form (written law)

Abstract

The relationship between law and morals has become an academic and philosophical debate throughout the ages, especially in the schools of natural law and legal positivism. The school of natural law always relates law and morals in a close, inseparable relationship, like a coin. The law must contain moral values. Meanwhile, legal positivism clearly separates the relationship between law and morals. Thus the law is not at all related to morality, the problem of law contains moral values or not, not the substance and legal issues, the most important thing is that the law is made by a sovereign ruler. Law is separated from non-juridical elements, such as ethics, morals, politics, economics, sociology, and so on. In other words, the law is purified from something that is not law. With the very sharp differences between the two schools of law, the schools of natural law and legal positivism for hundreds of years have never agreed on the relationship between law and morals. Each has a paradigm, method, theory, and a strong philosophical basis in seeing the relationship between law and morals.Keywords: Natural Law, Legal Positivism, Law and Morals

Abstract

Pengabdian masyarakat dengan memberikan materi “Teknik Penyusunan Putusan dan Metode Penulisan Bahasa Hukum” dalam Rapat Koordinasi Penyelesaian Sengketa Proses Pemilihan Kepala Daerah Tahun 2024 yang diselenggarakan oleh Bawaslu Provisi Jawa Tengah bertujuan untuk memperkuat pengetahuan dan kapasitas Anggota Bawaslu Kabupaten/Kota dalam Menyelesaikan Sengketa Proses pada Pemilihan Kepala Daerah 2024. Kegiatan dilaksanakan menggunakan pendekatan kombinasi. Metode kombinasi memberi ruang peserta untuk aktif dalam proses pembelajaran, dan mengungkapkan pengalaman praktis sebelumnya. Hasil pembahasan menunjukan bahwa ada peningkatan dalam pemahaman peserta dengan rentang rata-rata 10%. Kenaikan ini mencerminkan kegiatan efektif guna mempersiapkan anggota Bawaslu dalam dalam membuat keputusan sengketa proses dengan menggunakan bahasa hukum yang sesuai kaidah. Kegiatan juga dalam rangka memperkuat hubungan antara Bawaslu dengan stakeholder

Abstract

Mashlahat theory has historically been widely used in developing Islamic law. The public interest is a fundamental issue that must be considered when exploring Islamic law. The main objective of the development of Islamic law is to realize the mashlahat. This study examines the relevance of the mashlahat theory in the development of Islamic law. This research is a type of library research and uses a philosophical approach. Data were analyzed through content analysis. The results of this study indicate that the purpose of Islamic law is to realize and maintain the mashlahat. A mulism will get mashlahat if he can keep the five main aspects in the dharury group: religion, soul, intellect, lineage and honor, and property. On the other hand, we will get mafsadat if we cannot maintain it. The theory of mashlahat is very much needed to form Islamic law and respond to the times. Consideration of mashlahat is limited to issues other than ritual worship. Mashlahat theory has been applied since the beginning of the growth and development of Islam during the Khulafa al-Rasyidun period. Until now, many products of Islamic law have been produced by adhering to the principle of mashlahat. With the theory of mashlahat, Islamic law will not stagnate. All new problems can be solved from the perspective of Islamic law. With the consideration that mashlahat, too, can be realized, including in the context of the MUI fatwa in preventing the spread of Covid-19.

Abstract

Tindak pidana korupsi merupakan salah satu persoalan besar di Indonesia, karena korupsi sudah masuk dalam semua aspek kehidupan. Pencegahan dan pemberantasan tindak pidana korupsi harus dilakukan secara seimbang. Peran pendidikan sangat strategis dalam pencegahan tindak pidana korupsi melalui berbagai cara, salah satunya melalui pendidikan di sekolah. Kegiatan ini dilaksanakan di SMP Al-Bayyan Pekalongan, yang bertujuan untuk menanamkan nilai-nilai anti korupsi. Metode yang digunakan adalah ceramah, diskusi dan praktik pembuatan poster anti korupsi. Hasil pre-test menunjukkan nilai rata-rata 62, dengan nilai tertinggi 80 yang diraih 1 peserta didik dan nilai terendah 33 yang diraih 1 peserta didik. Sedangkan hasil post-test menunjukkan nilai rata-rata 83, dengan nilai tertinggi 93 yang diraih 5 peserta didik dan nilai terendah 60 yang diraih 1 peserta didik. Dari data tersebut tampak ada perubahan pemahaman peserta didik mengenai pendidikan anti korupsi yang signifikan, dari nilai rata-rata 62 menjadi 83. Hal ini menunjukkan bahwa peserta didik memahami materi yang disampaikan dengan baik, serta dipengaruhi oleh metode penyampaian materi yang tepat.
