Abstract

Mail forgery has a wide-ranging and serious impact, not only on the individual victims, but also on social stability, security, and trust in the legal system and government. Mail forgery can include various types of documents, ranging from personal documents such as identity cards and passports, to official documents such as certificates, deeds, and financial documents. This research is normative research that studies the purpose of law, values of justice, validity of legal rules, legal concepts, and legal norms. The source materials used in this research are primary legal materials, secondary legal materials and tertiary legal materials. Primary legal materials are the Indonesian Criminal Code and the Dutch Criminal Code. Furthermore, the data collected is analysed qualitatively. Indonesian law regulates related to the criminal offence of document forgery can be found in various laws. Among them are: Article 263 of the Criminal Code, Article 264 of the Criminal Code. In addition, Law Number 24 of 2013 concerning amendments to Law Number 23 of 2006 concerning population administration regulates the falsification of population documents such as KTP and birth certificates including deeds. As for the Dutch Legal Aspects, it specifically regulates Article 225 of the Dutch Criminal Code regarding forgery of all forms of documents that cause harm to others can be penalised and fined. The same as in Indonesia which regulates document forgery.

Abstract

Artikel ini menganalisis Putusan Nomor 1/Pdt.GS/2019/PN.Mgg mengenai wanprestasi berdasarkan prosedur gugatan sederhana dengan keputusan Hakim menyatakan gugatan Penggugat gugur. Tujuan artikel ini adalah untuk mengetahui aspek ketidakhadiran prinsipal yang diwakili oleh kuasanya dalam Putusan Nomor 1/Pdt.GS/2019/PN.Mgg yang menyebabkan gugatan gugur. Artikel ini diteliti menggunakan metode penelitian hukum normatif. Hasil penelitian membuktikan bahwa ketidakhadiran prinsipal perkara a quo adalah Penggugat secara individu maupun badan hukum tidak hadir pada agenda konferensi sehingga hanya diwakili oleh kuasa atau wakilnya yang tentu memahami perkara tersebut berdasarkan surat kuasa atau surat dari lembaga penggugat. Oleh karena itu, Hakim tetap memutus gugatan penggugat telah memenuhi pertimbangan berdasarkan Pasal 4 ayat (1) dan Pasal 13 ayat (1) Peraturan Mahkamah Agung Nomor 4 Tahun 2019 tentang Perubahan atas Peraturan Mahkamah Agung Nomor 2 Tahun 2015 tentang Tata Cara Penyelesaian Gugatan Sederhana. Perihal skewajiban kehadiran prinsipal dalam konteks yang berperkara adalah badan hukum pada hakikatnya perlu ditinjau ulang agar prosedur gugatan sederhana dapat memenuhi asas sederhana, cepat, dan biaya ringan.

Abstract

Artikel ini menganalisis pertimbangan hakim dalam menjatuhkan putusan pemidanaan perkara aborsi ilegal. Tujuan artikel ini adalah untuk mengetahui pertimbangan hakim dalam memutus perkara aborsi ilegal dalam Putusan Nomor: 118/Pid.Sus/2023/PN Skh telah memenuhi ketentuan Pasal 183 KUHAP. Metode penelitian yang digunakan adalah penelitian hukum normatif. Penelitian ini bersifat perskriptif dan terapan. Teknik pengumpulan bahan hukum dengan studi kepustakaan. Bahan hukum yang digunakan adalah bahan hukum primer dan sekunder. Berdasarkan hasil penelitian dan pembahasan, diperoleh kesimpulan bahwa pertimbangan hakim dalam memutus perkara aborsi ilegal dalam Putusan Nomor 118/Pid.Sus/2023/PN Skh telah memenuhi ketentuan Pasal 183 KUHAP. Pada tahap pembuktian di perkara ini, disajikan lebih dari dua alat bukti yang sah, di antaranya keterangan saksi-saksi, keterangan para terdakwa, dan alat bukti surat. Sementara itu, untuk menanggulangi banyaknya perkara aborsi di Indonesia diperlukan upaya kuratif dan preventif.

Abstract

Abstrak: Artikel ini mendeskripsikan dan mengkaji permasalahan mengenai pertimbangan hakim terhadap keterangan saksi yang penuntutannya dilakukan secara terpisah dalam Putusan Nomor 338/Pid.Sus/2021/PN. Yyk. Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan kasus (case approach). Jenis bahan hukum yang digunakan terdiri dari bahan hukum primer, dan bahan hukum sekunder dengan teknik pengumpulan data yang digunakan dalam penelitian ini yakni studi dokumen (kepustakaan). Hasil penelitian dan pembahasan menunjukkan bahwa keterangan saksi yang penuntutannya dilakukan secara terpisah dipertimbangkan oleh hakim karena telah memberikan keyakinan bagi hakim dalam memutus pelaku bersalah karena melakukan tindak pidana narkotika.Kata Kunci: Pertimbangan Hakim, Saksi, Narkotika Abstract: This article describes and examines the issue of the judge's consideration of the testimony of witnesses whose prosecution is carried out separately in decision number 338/Pid.Sus/ 2021 / Fr. Yyk. This study is a normative legal research that uses a case approach (case approach). The types of legal materials used consist of primary legal materials, and secondary legal materials with data collection techniques used in this study, namely the study of documents (literature). The results of the study and discussion showed that the testimony of witnesses whose prosecution was carried out separately was considered by the judge because it had given confidence to the judge in deciding the perpetrator guilty of committing narcoticscrimes.Keywords: Judge’s Consideration; Sanctions; Narcotics

Abstract

Customary law in the national legal system is undoubtedly fundamental to maintaining existence because customary law can also be applied to resolve conflicts in society. This research uses socio-legal methods, and the data obtained is based on data in the field through an interview process with several related parties. In contrast, for legal problems in this society, only some things can be resolved through a customary law approach. For example, in the Dayak indigenous community, several legal problems cannot be resolved according to custom, especially regarding unregistered land rights. These problems certainly cannot be solely resolved using a customary law approach. This certainly shows that customary law cannot necessarily accommodate the interests of Indigenous peoples because this is also closely related to legal certainty. Because they relate to legal certainty, they must be resolved through a positive legal approach, such as submitting a request to the court or an application to the relevant agency. This certainly happens because the legal awareness of regional communities in Indonesia is currently not very good; this leads to legal issues within indigenous communities that cannot be resolved through customary law.

Abstract

Technological advancements have driven the growth of the financial industry in Indonesia. A more complex financial system provides benefits but also raises issues, such as the rise of illegal investments by business entities without official authorization. Investment involves allocating capital with the expectation of future profits. The growing middle class and economic development in Cangkring Village have increased public interest in investing. Unfortunately, many are tempted by high returns with minimal capital without considering legality. This community service program, as part of the Tri Dharma of Higher Education, aims to educate the public about legally compliant investments. The activities were conducted through lectures and participatory methods. The results indicate that public awareness of investment remains low due to limited financial literacy. Further education is needed to help people distinguish between legal and illegal investments, ensuring they invest safely and in accordance with applicable laws.

Abstract

Local wisdom encompasses community-derived knowledge and practices transmitted through generations, highlighting the importance of balance with the environment. In Indonesia, traditional methods like the size in Papua and subak in Bali are crucial for maintaining ecological equilibrium. This study seeks to investigate the influence of local wisdom on environmental management and assess the degree to which Indonesian environmental policy facilitates or obstructs its application. This research employs a normative legal method and literature analysis to analyze laws, regulations, and customary practices about environmental governance. The findings indicate that although several legislative instruments—such as Law No. 32/2009 on Environmental Protection and Law No. 5/1990 on Conservation—recognize and endorse traditional knowledge, obstacles remain. Modernization, divergent commercial interests, and insufficient local government backing frequently marginalize Indigenous knowledge. Furthermore, the execution of policies is often inconsistent and occasionally detrimental. The study asserts that incorporating indigenous knowledge into environmental policy formulation is crucial for sustainable resource management in Indonesia. Enhancing legal acknowledgment, promoting multi-stakeholder cooperation, and increasing policymakers' awareness are essential.  Acknowledging local knowledge guarantees ecological sustainability and promotes social fairness for indigenous populations

Abstract

This study explores the practice of legal pluralism in environmental governance through an in-depth analysis of customary law integration in Bali, Indonesia. As a province that maintains strong Indigenous legal traditions, Bali presents a unique setting where "awig-awig" (customary regulations), "subak" (irrigation institutions), and traditional villages actively contribute to natural resource management and ecological protection. The purpose of this research is to examine how these indigenous legal institutions operate alongside state environmental laws and to assess the normative and institutional synergies or tensions that arise. Employing a normative juridical method, this study analyzes constitutional provisions, statutory environmental regulations, and regional laws while integrating case illustrations from Penglipuran, Tenganan, and Ubud villages. The findings indicate that community-based enforcement mechanisms grounded in local norms and social sanctions provide resilient and context-specific approaches to sustainability. However, the coexistence of customary and statutory systems also exposes challenges related to authority fragmentation, legal uncertainty, and policy misalignment. The study concludes that enhancing the legal status of indigenous institutions and developing cooperative governance frameworks are essential steps toward achieving inclusive, adaptive, and culturally embedded environmental management. These findings contribute to the growing global discourse on legal pluralism and support the integration of Indigenous Ecological Knowledge (IEK) within national and international environmental agendas.
