Abstract

Cases that involve children as perpetrators of violence have increased sharply year by year. This phenomenon is interesting to study, especially to examine the common thread, find the root of the problem, and see how the law enforcement process is and what obstacles are faced by the Yogyakarta City Police. The research method used is qualitative field research. The results of the study concluded that the law enforcement process carried out by the Yogyakarta City Police was always guided by the Law, but still needed improvements in the applicable Law.

Abstract

Although the 1945 Constitution of the Republic of Indonesia states that the state recognizes and respects customary law communities, its recognition is conditional on customary law communities in managing their natural resources, especially in the status of certain forest areas. This paper examines how the role of customary forests in social forestry schemes provides space and access to customary law communities in natural resource management. The results of the study show that the ratification of the Decree (SK) of Customary Forests in the social forestry scheme is able to provide legitimacy to indigenous peoples in managing natural resources in accordance with their local wisdom and also have an impact on strengthening customary practices in the management of their natural resources

Abstract

Kekerasan pada anak merupakan isu serius yang mencakup berbagai bentuk tindakan seperti kekerasan fisik, psikis, verbal, pengabaian, hingga pelecehan seksual. Fenomena ini seringkali melibatkan pelaku yang justru memiliki tanggung jawab untuk melindungi anak. Dalam konteks hukum dan Hak Asasi Manusia (HAM), perlindungan terhadap anak di Indonesia telah diatur melalui berbagai peraturan, termasuk Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak dan Undang-Undang Nomor 39 Tahun 1999 tentang HAM. Penelitian ini bertujuan untuk menganalisis kekerasan terhadap anak dari perspektif hukum dan HAM, dengan menggunakan metode yuridis normatif dan pendekatan kualitatif deskriptif. Penelitian ini menggambarkan bagaimana hukum memberikan jaminan perlindungan terhadap anak dan menekankan pentingnya peran negara, masyarakat, keluarga, serta kebijakan yang mendukung perlindungan hak anak. Hasil penelitian menunjukkan bahwa perlindungan anak memerlukan pendekatan komprehensif, mulai dari upaya preventif hingga rehabilitatif, serta penerapan sanksi yang tegas untuk memberikan efek jera bagi pelaku. Selain itu, anak sebagai korban memiliki hak untuk mendapatkan restitusi atas kerugian yang dialaminya. Penelitian ini diharapkan dapat memberikan pemahaman yang lebih mendalam mengenai fenomena kekerasan pada anak dan upaya penanganannya, sehingga tercipta lingkungan yang aman dan mendukung bagi anak-anak untuk tumbuh dan berkembang secara optimal.

Abstract

Kenakalan remaja di Indonesia sudah masuk pada taraf yang menghawatirkan, bebarapa kasus kenakalan remaja cenderung kepada perbuatan kriminal, dewasa ini kenakalan remaja bukan sekedar perilaku menyimpang atau perbuatan tidak sesuai dari kebiasaan yang lumrah dalam masyarkat, akan tetapi kenakalan remaja pada faktanya seringkali masuk kepada perbuatan-perbuatan yang bertentangan dengan norma hukum positif khususnya perbuatan pidana. Sunarwiyati S, mengkategorikan bentuk kenakalan remaja kedalam tiga tingkatan yaitu, a) Kenakalan biasa; b) Kanakalan yang menjurus pada pelanggaran dan kejahatan; c) Kenakalan khusus. beberapa faktor yang mendorong terjadinya kenakalan remaja antara lain, a) Faktor Pribadi; b) Faktor Keluarga; c) Lingkungan Sosial, adapun kenakalan remaja yang sering kali melanggar hukum atau merupakan tidak pidana yaitu, Pencurian, Bullying, Perjudian, Penyalahgunaan Narkoba, Tindakan Asusila, Perusakan Properti, Cybercrime dan Pelanggaran Lalu Lintas.

Abstract

This paper discusses the restorative justice approach as an alternative to punishment in the Indonesian criminal justice system. The massive use of imprisonment has caused serious problems such as the overcapacity of correctional institutions and the lack of recovery for victims. Restorative justice comes as a response to the weaknesses of the traditional punishment system that overemphasizes the punishment aspect, and is not effective in solving the problem of crime as a whole. The results showed that restorative justice offers a more comprehensive solution by prioritizing victim recovery, social reconciliation, and offender accountability without always relying on conventional punishment. The study results show that restorative justice has the potential to be a more humanist, adaptive, and effective punishment solution, especially in dealing with minor crimes. Several challenges such as the resistance of a rigid legal culture, the lack of understanding of the community and law enforcement officials, and the need for policy harmonization need to be considered. However, the implementation of this approach must be carried out while still paying attention to certain limitations and conditions so as not to cause imbalances in law enforcement.

Abstract

Legal and illegal tin mining activities have caused environmental damage in the Bangka Belitung Islands Province. This damage includes forest destruction, water and soil pollution, coastal abrasion, and loss of biodiversity. In environmental law, the polluter pays principle requires polluters to be responsible for the costs and actions to restore the damaged environment caused by their actions. In addition, environmental justice is also very important to uphold in the case of tin mining in the Bangka Belitung Islands Province. This study aims to analyze the application of environmental justice and the polluter pays principle in efforts to restore the environment caused by tin mining activities in the Bangka Belitung Islands Province. This study uses a normative juridical method with an emphasis on legislative and conceptual approaches. The focus of the analysis is directed at reviewing regulations and concepts related to the polluter pays principle and environmental justice theory, particularly within the framework of environmental damage restoration. The results of the study indicate that regulations in Indonesia have regulated the polluter pays principle, however, in practice, this principle faces obstacles in its implementation. In addition, the implementation of environmental justice is also carried out within the framework of environmental restoration. Therefore, the implementation of environmental justice needs to be carried out holistically. Political commitment, public oversight, and firm law enforcement are needed so that post-tin mining environmental recovery in Bangka Belitung not only improves the ecology, but also restores the rights of local communities who have been marginalized by the logic of natural resource exploitation.

Abstract

The phenomenon of juvenile delinquency that develops within society reflects a complex issue involving individual, family, and social environmental factors. Children in conflict with the law require a more humanistic legal approach that emphasizes recovery rather than mere punishment. In Indonesia, Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (JCJS Law) introduces the diversion mechanism as an implementation of restorative justice, aiming to shift the settlement of juvenile cases from formal judicial proceedings to non-penal measures. This paper aims to examine the legal basis for the involvement of counselors in the diversion process by employing a normative juridical research method through statutory and literature approaches. The findings indicate that, although the role of counselors is not explicitly stated in the Juvenile Criminal Justice System Law, the inclusive legal provisions within Indonesia’s Law No. 11 of 2012, Government Regulation No. 65 of 2015, and Supreme Court Regulation No. 4 of 2014 provide opportunities for counselors to participate as professional actors in the diversion process. Counselors hold a strategic role in facilitating the psychological and social recovery of both juvenile offenders and victims through guidance and counseling services that focus on emotional regulation, trauma healing, and moral responsibility development.

Abstract

The phenomenon of non-procedural Hajj in the Bangka Belitung Islands represents a complex form of social conflict between state policy, the economic interests of travel agencies, and the spiritual motivations of the community. This study aims to understand the structural, cultural, and behavioral dimensions of non-procedural Hajj practices through a descriptive qualitative approach. Data were collected through in-depth interviews with six informants consisting of religious officials, licensed travel agency managers, and non-procedural pilgrims, then analyzed using Johan Galtung's triangle of conflict model (Contradiction, Attitude, Behavior). The results show that the conflict surrounding non-procedural Hajj stems from structural inequalities in quota policies and Hajj bureaucracy, reinforced by cultural legitimacy that places religious intentions above administrative rules, and manifested in social behavior that maintains practices outside the legal corridor. Theoretical analysis confirms that structural and cultural violence operate simultaneously, creating an illusory negative peace. This study emphasizes the need for policy transformation and social awareness towards positive peace through religious education, inclusive regulation, and value-based social mediation.
