Abstract

Disclosure issues priva the patient data cov id-19 has a dilemma, on the other hand the patient covid-19 must be protected data privacy of her so as not to spread public consumption because it will be implications negative for patients covid-19 towards economic, social , and -Other if the medical record is disseminated without perse purpose. Thus, the study will also describe a court decision in which a patient sued peme covid 19 Rinta h area who held a press conference on the post itifnya patients covid-19 and also sued one sa tu mass media that reported on k eadaannya. Thus, there are like two sides of a coin, in the other hand  patient data privacy must be protected , but on the other hand, information dissemination d ith patient permission dibutuh right to avoid other people her exposed covid-19 , because it takes trace contacts of patients covid-19 so that the virus does not spread. That way, the privacy protection of Covid-19 patient data needs to be studied to answer this dilemma with the data privacy protection model for Covid-19 patients . The research method used in this research is a normative juridical method using a doctrinal approach. Objective is to familiarize yourself isa setting clicking Enai patient data privacy Covi d -19 in Indonesia and comparative with the protection of the privacy of patient data covid-19 in n egara another. Discussion result study showed that  compassion are, whereas the Constitution (Article 28 G paragraph ( 1 )), Article 57 of the Health Act, and some of international convention  already ratification in Indonesia, also on the core of her had been arranged that the privacy of the patient should be in the case but there is still a central or regional governments that violate the privacy of patients covid-19 with announce very detail about  patient covid-19 data privacy that adversely affects the patient. Refers to protecting the privacy of patient data covid-19 in the EU, UK, US, China, India, Hongkong, Malaysia, and Singapura which ensures it firmly to prevent leakage of data that can be go to the general public so that, right to maintain the privacy of data of covid-19 patient, and the tracking integrated via applications that are already guaranteed securities.

Abstract

Pengaturan wakil kepala daerah dalam UUD NRI Tahun 1945 berdampak terhadap sistem pemerintahan daerah di Indonesia. Rivalitas semasa menjabat antara kepala daerah dan wakil kepala daerah diberbagai daerah, sehingga akan berdampak terhadap berjalannya sistem pemerintahan daerah. Kewenangan wakil kepala daerah dalam tatanan atribusi, delegasi maupun mandat yang sangat timpang antara kepala daerah dan wakil kepala daerah, mulai dari tidak disebutkan secara eksplisit dalam Pasal 18 UUD NRI Tahun 1945, hingga kewenangannya yang bersifat asistensi dalam UU Pemda dan juga mandatoris melalui keputusan kepala daerah. Metode penelitian yang dilakukan adalah penelitian hukum normatif dengan pendekatan penelitian pendekatan perundang-undangan (statute approach). Hasil penelitian menunjukkan bahwa meskipun secara eksplisit UUD NRI Tahun 1945 hanya menyebutkan mengenai kepala daerah dan tidak menyebutkan mengenai wakil kepala daerah, tetapi terdapat Pasal 18 ayat (7) UUD NRI Tahun 1945 yang memerintahkan untuk membentuk UU berkaitan dengan penyelenggaraan pemerintahan daerah. Naskah komprehensif perubahan UUD NRI Tahun 1945 juga memuat bahwa frasa kepala daerah sudah termasuk wakil kepala daerah, tetapi konteks masa kini, diperlukan penguatan jabatan wakil kepala daerah mulai dari UUD NRI Tahun 1945 hingga keseimbangan tugas, fungsi, dan wewenang dalam UU Pemda.

Abstract

Independent regional institutions as derivatives of independent state institutions or will be studied can regional institutions be formed on the basis of regional needs and regulated in laws and regulations, so that a comparison will be made with France and the United States regarding independent regional institutions that are consultative with those that are implemented or that have not been implemented in the local government system in Indonesia. The research method used is normative juridical. The results showed that Indonesia does not yet have independent regional institutions that are consultative, compared to France and America have independent regional institutions that are consultative so that local/state governments can take appropriate policies.

Abstract

The existence of artificial intelligence technology (artificial intelligence) has brought significant changes in various fields, including laws and regulations, in addition to providing convenience but AI also has the potential to be a threat to the human profession. One of them is the presence of law analyzer, as one of the AI-based innovations, capable of analyzing, harmonizing, and providing recommendations for improvement in draft laws and regulations efficiently and accurately which can affect the role of the drafters of laws and regulations. The research method used is sociological research with qualitative analysis, sociological and comparative approaches. This study aims to explore the impact of the use of law analyzer on the role and function of functional positions of legislative drafters. The results of the study show that although law analyzer can improve the speed and quality of the regulatory harmonization process, its existence also raises concerns about the shift in the role of Legislative Drafters. AI technology has the potential to take over tasks previously performed by humans, so Legislative Drafter are required to upgrade skills so that they are not replaced by the presence of AI.

Abstract

The division of authority between regional heads and deputy regional heads in the system of local government administration is not only administrative, but also contains a deep philosophical dimension. The research method used is normative juridical with a philosophical approach. The results of the study show that, ontologically, the existence of the positions of regional head and deputy regional head is a manifestation of the principle of duality in leadership, where responsibility cannot be borne by one individual alone. Its epistemology reflects efforts to formulate a balanced and functional power structure, in order to achieve effectiveness in local government. Meanwhile, axiologically, this division of authority is based on the values of democracy, justice, and accountability, which aims to ensure that regional leadership can run collectively, not authoritarianly, and remain within the corridor of public services. However, in practice, the unclear boundaries of authority often lead to conflicts, functional inequality, and even government stagnation. Therefore, a philosophical and normative reformulation of the relationship of authority between regional heads and deputy regional heads is needed in order to create harmonious, effective, and people-oriented regional governance.

Abstract

Fulfillment right choose for person with disabilities disability is an integral part of inclusive democracy , but in practice Still often experience obstacles , good from side accessibility information , infrastructure , and mechanism participation in the political process . Research This leave from problem lack of oversight and transparency in fulfillment right political disability in elections Head of Medan City Region in 2024, where the limitations manual mechanisms often give rise to data bias and potential neglect rights . Purpose study This is analyze effectiveness monitoring digital -based as instrument For ensure participation political disability can protected and guaranteed optimally . Method research used is approach juridical-empirical with technique data collection through studies library , interview with voters disability , organizer elections , as well as observation supported fields utilization application digital monitoring . Research results show that monitoring digital -based capable increase transparency , data accuracy , and give room more participation wide for person with disabilities disability . However Thus , it was found challenge in the form of limitations digital literacy , internet networks , and Not yet integration system digital surveillance with regulations elections . Therefore that , innovation technology need strengthened through policy responsive law for democracy inclusive truly can realized.

Abstract

The unfulfilled sexual rights for prisoners cause problems related to potential such as psychological shocks, sexual violence between fellow prisoners, high divorce rates for married prisoners, besides that the absence of sexual rights for prisoners in laws and regulations in Indonesia violates the principle of non-discrimination for prisoners so it needs to be studied in the perspective of human rights, especially sexual rights for prisoners. The method used is normative juridical with a doctrinal approach. The results showed that the urgency of regulations related to sexual rights for prisoners so that there is fulfillment of sexual rights that do not injure the principle of non-discrimination for prisoners so that legal certainty related to sexual rights for prisoners can minimize psychological shocks, sexual violence between fellow prisoners, high divorce rates for married prisoners.Keywords: Rights, Sexual, Prisoner

Abstract

Kewenangan Presiden dalam membentuk undang-undang pasca amandemen yaitu bahwa Presiden masih memiliki hak dalam pembentukan undang-undang hal itu terjadi atas implikasi pergeseran fungsi legislasi sebelum dan sesudah amandemen, saat ini Presiden yang berhak mengajukan Rancangan Undang-Undang, DPR memegang kekuasaan membentuk undang-undang. Dalam penelitian ini juga dilakukan perbandingan dengan negara-negara di Amerika Latin dan Brazil untuk menemukan indikator kewenangan presiden membentuk undang-undang dalam sistem presidensial, agar proporsinya lebih ideal. Metode penelitian yang digunakan yaitu yuridis normatif. Hasil penelitian menunjukkan bahwa dibutuhkannya penyerahan kekuasaan legislasi sepenuhnya kepada DPR dan DPD serta perlu mempertimbangkan pranata Veto.

Abstract

Permasalahan hak atas lingkungan yang baik dan sehat menjadi suatu problematika yang harus dihadapi oleh masyarakat yang berdomisili di pinggir sungai salah satunya sanggar anak sungai deli yang berada di kota medan, tujuan kegiatan ini yaitu memberikan sosialisasi kepada sanggar anak sungai deli yang berdomisili di pinggir sungai untuk memiliki hak atas lingkungan hidup yang baik dan sehat sebagaimana amanah Pasal 28H UUD NRI Tahun 1945. Metode pelaksanaan yang digunakan yaitu studi lapangan. Hasil kegiatan menunjukkan bahwa masyarakat di sanggar anak sungai deli telah mendapat edukasi terkait hak atas lingkungan yang baik sehingga memiliki kesadaran untuk merawat daerah aliran sungai ditambah lagi dengan adanya program barterisasi mengutip sampah botol di sungai yang dapat ditukarkan dengan beras menambah semangat dan kesadaran masyarakat untuk menjaga lingkungan.
