Abstract

The implementation of governance in the village, so far only refers to the village head and village apparatus. Law No. 6 of 2014 concerning villages has stated that the Village Consultative Body or what is referred to by other names is an institution that carries out government functions whose members are representatives of the village population based on regional representation and are democratically determined. The Village Consultative Body has the duty to discuss and agree on various policies in the administration of the Village Government. In an effort to improve institutional performance at the village level, strengthen togetherness, and increase participation and empowerment the community, the Village Government and / or the Village Consultative Body facilitate the implementation of the Village Deliberation.

Abstract

External oversight of constitutional judges is a crucial element in maintaining the integrity and accountability of the constitutional judiciary system. The urgency of this oversight lies in its ability to prevent the abuse of power, enhance transparency, and strengthen public trust in the judiciary. In this context, external oversight functions as a control mechanism that helps ensure constitutional judges perform their duties in accordance with principles of justice and applicable law. However, effective external oversight requires an ideal and comprehensive model. The ideal oversight model should include key elements such as the independence of the oversight body, transparency of the oversight process, clear procedures for reporting and handling complaints, and accountability of the oversight body to the public. Additionally, public involvement in the oversight process is crucial to ensure that the oversight reflects the general interest. This study aims to evaluate the urgency of external oversight of constitutional judges and to develop an ideal oversight model that can enhance the effectiveness of external control. By implementing this model, it is hoped that the constitutional judiciary system can operate more fairly and accountably, and maintain public confidence in the constitutional judiciary.

Abstract

Tanah merupakan tempat tinggal, tempat manusia melakukan aktivitas sehari-hari dan juga menjadi sumber mata pencaharian bagi kalangan petani di wilayah pedesaan di seluruh Indonesia. Pentingnya arti tanah bagi masyarakat Indonesia, maka banyak masyarakat yang berupaya untuk memiliki hak atas tanah tersebut agar dapat dijadikan tempat mendirikan rumah kediaman, tempat bercocok tanam, tempat berusaha dengan mendirikan bangunan rumah tempat usaha atau bahkan melakukan pengalihan hak atas tanah tersebut melalui suatu transaksi jual beli. Dalam penelitian ini yang digunakan adalah penelitian yuridis normative yang mengolah data dari bahan hukum primer, bahan hukum sekunder serta bahan hukum tersier. Berdasarkan hasil penelitian yang didapat dapat memberikan informasi untuk dipahami tentang Keabsahan surat tukar tanah yang dibuat oleh Kepala Desa adanya suatu kewenangan berdasarkan Permendagri No. 6 Tahun 1972 tentang Pelimpahan Wewenang Pemberian Hak Atas Tanah sehingga diantara para pihak yang berkeinginan untuk melakukan peralihan hak berupa tukar menukar atas tanah baik secara lisan maupun tertulis kemudian harus dituangkan dalam suatu Berita Acara yang ditandatangani oleh para pihak atas persetujuan tukar menukar sehingga Kepala Desa dapat membuat surat keterangan atas peralihan hak berupa tukar menukar tanah tersebut.

Abstract

Impeachment dianggap sebagai proses politik dan hukum yang kontroversial di banyak negara. Studi ini membandingkan aspek hukum impeachment di Indonesia, Amerika Serikat, dan Korea Selatan, fokus pada prinsip due process dan mekanisme hukumnya. Metode penelitian adalah penelitian hukum normatif dengan pendekatan perbandingan. Hasilnya menunjukkan bahwa di Amerika Serikat, impeachment cenderung politis dengan penentuan akhir oleh suara mayoritas Senat. Di Korea Selatan, impeachment lebih terstruktur secara hukum, diputuskan oleh Mahkamah Konstitusi setelah proses pengadilan. Di Indonesia, meskipun sebelum amendemen UUD 1945 impeachment cenderung politis, setelah amendemen melibatkan Mahkamah Konstitusi dan MPR, yang dapat menghasilkan keputusan berbeda. Hal ini menunjukkan impeachment dalam UUD 1945 setelah amendemen tidak dapat dikatakan semata bersifat hukum tetapi memiliki dimensi politik dan hukum.

Abstract

The Constitutional Court was born because of the desire to make Indonesia a democratic legal state, where the community can contribute to the administration of state government power and the direction of the state. In this case, the emphasis on democracy is the purpose of checks and balances, which are basically an essential element of the separation of powers so that they cannot be in full power. This democracy also lies not only in one of the powers of the Constitutional Court to provide a judicial review of laws and regulations to be in line with the mandate of the Constitution, but also other powers of the Constitutional Court also summarize that the legal state system becomes democratic, such as the Constitutional Court's authority to resolve and decide disputes over election results. In general, there is a conflict of interest not only between participants in the General Election but also the problem with the organizing agency that can make mistakes in carrying out the implementation of the general election. Disputes over the general election results (PHPU) include Disputes over the results of the general election for President and Vice President and Disputes over the general election results, namely members of the People's Representative Council (DPR), Regional Representatives Council (DPD), and Regional People's Representative Council (DPRD). However, since the issuance of Law Number 12 of 2008 concerning the Second Amendment to Law Number 32 of 2004 concerning Regional Government, the authority of the Constitutional Court has been added, namely the results of the elections which are the authority of the Supreme Court (MA). Its development and the breakthrough in the decision of the Constitutional Court in producing election results only proves that the Constitutional Court does not only evaluate the results of the calculation of the number of votes for the new pair moving to a court that oversees democracy which is mandated in the 1945 Constitution by holding general elections democratic. The decisions of the Constitutional Court that disqualify election participants in the post-conflict local elections are the basis for jurisprudence as well as legal interpretations and analogies for other elections, especially in 2024, simultaneous elections will be carried out as a whole.

Abstract

The Indonesian government's legal policy in the environmental sector has been regulated in Article 28H paragraph (1) and Article 33 paragraph (4) of the 1945 Constitution of the Republic of Indonesia, namely regarding the right to a good and healthy environment as a human right and the implementation of the national economy based on the principles of sustainable and environmentally sound development. To increase investment and make it easier to obtain environmental approval, the Government made changes to regulations regarding the environment which were previously regulated by Law Number 32 of 2009 concerning Environmental Protection and Management. The problems discussed in this study are how the shift in legal politics in the environmental sector after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, how changes in environmental regulations after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, how is the settlement of environmental disputes through filing an administrative lawsuit at the State Administrative Court after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law. This research uses normative legal research methods by examining library materials and the type of research used in this research is an inventory of positive law. The results of this study indicate that the government's legal politics in the environmental sector has shifted after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation into Law because of the ease of obtaining environmental approval and increasing investment, not in accordance with the legal politics of environmental management and protection stipulated in Article 28 H paragraph (1) and Article 33 paragraph (4) of the 1945 Constitution of the Republic of Indonesia and the environmental development agenda which is a national priority agenda in the 2020-2024 National Medium-Term Development Plan.The ease of obtaining environmental approval can be seen from the loss of public participation in the AMDAL document, the change of environmental permits to environmental approval, the withdrawal of the authority of the Regional Government to the authority of the Central Government, the revocation of the provisions of the article regarding absolute liability without the need to prove the element of fault (stict liability), the revocation of the provisions of the article regarding the cancellation of environmental permits through court decisions, the revocation of the provisions of the article regarding the right to administrative lawsuits in environmental disputes in the State Administrative Court, and the change of articles regarding environmental crimes from formal crimes to material crimes. The settlement of environmental disputes through administrative lawsuits at the State Administrative Court after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law is Individuals, business entities incorporated or not incorporated, and / or Environmental Organizations whose interests have been and / or have the potential to be harmed by State Administrative Decisions and / or Government Administrative Actions can file a lawsuit at the State Administrative Court with the legal basis of the Supreme Court of the Republic of Indonesia Regulation Number 1 of 2023 concerning Guidelines for Adjudicating Environmental Cases.

Abstract

Kebijakan Reforma Agraria merupakan upaya untuk menata kembali hubungan antara masyarakat dengan tanah, yaitu menata kembali penguasaan, pemilikan, penggunaan dan pemanfaatan permukaan bumi yang berkeadilan di Indonesia melalui penataan aset dan disertai dengan penataan akses untuk kemakmuran rakyat Indonesia. Dalam pelaksanaan penyediaan TORA di Kabupaten Serdang Bedagai, Gugus Tugas Reforma Agraria menemukan adanya tanah eks HGU PT. Deli Minatirta Karya yang sudah berakhir haknya. Berdasarkan ketentuan pada Perpres 86/2018 maka tanah tersebut dapat dijadikan sebagai objek TORA. Tantangan muncul karena tanah eks HGU tersebut ternyata bersengketa. GTRA harus terlebih dahulu menyelesaikan persoalan yang ada, kemudian mengidentifikasi tanah eks HGU menjadi objek TORA. Puncak persoalan terjadi saat Kelompok 80 melakukan demo penuntutan tanah eks HGU PT. Deli Minatirta Karya. Sehingga peneliti tertarik untuk mengkaji peranan GTRA dalam mengatasi sengketa pertanahan, pelakanaan GTRA apakah berhasil mencapai tujuannya dan apa kendala dalam pelaksanaanya.Penelitian ini menggunakan metode penelitian hukum yuridis empiris. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Terkait pengumpulan data dilakukan dengan 4 tahapan yaitu studi dokumen, observasi, wawancara, dan kuisioner yang dianalisis secara kualitatif.Peranan Gugus Tugas Reforma Agraria dalam penyelesaian sengketa tanah eks HGU PT. Deli Minatirta Karya belum maksimal, padahal pihak perusahaan PT. DMK sudah bersedia mengikuti program GTRA. Masih terdapat tuntutan pengembalian tanah eks HGU PT. DMK oleh Kelompok 80. Capaian tujuan pelaksanaan Gugus Tugas Reforma Agraria kurang maksimal, dimana berdasarkan hasil penelitian, bahwa sebagian besar masyarakat tidak merasakan manfaat adanya TORA. Kelompok 80 melakukan demo penuntutan pengembalian tanah eks HGU yang sudah menjadi objek TORA Upaya penyelesaian dalam mengatasi kendala dalam pelaksanaan Gugus Tugas Reforma Agraria yaitu melaksanakan koordinasi dengan Dinas Kehutanan atau instansi terkait mengenai pelepasan dari kawasan hutanHasil output identifikasi TORA menjadi tidak efektif karena tidak dilanjutkan dengan legalisasi aset melalui redistribusi tanah.

Abstract

Independent regional institutions as derivatives of independent state institutions or will be studied can regional institutions be formed on the basis of regional needs and regulated in laws and regulations, so that a comparison will be made with France and the United States regarding independent regional institutions that are consultative with those that are implemented or that have not been implemented in the local government system in Indonesia. The research method used is normative juridical. The results showed that Indonesia does not yet have independent regional institutions that are consultative, compared to France and America have independent regional institutions that are consultative so that local/state governments can take appropriate policies.

Abstract

Age discrimination in recruitment processes remains a significant issue in Indonesia, where many companies set age limits for job seekers. This practice is allowed under Article 35 of Law 13/2003, which grants employers the freedom to establish their own job requirements, resulting in injustice and limiting job opportunities for older individuals. This study uses a normative legal research approach, analyzing age discrimination regulations in various countries, as well as an analysis of Constitutional Court Decision Number 35/PUU-XXII/2024 and a conceptual approach to develop an anti-discrimination legal framework. The results show that age restrictions in recruitment are discriminatory, failing to provide legal justice, certainty, and benefits for job seekers. Legal studies of other countries regulations reveal that countries like the Philippines and Germany have explicit laws prohibiting age-based discrimination in employment. Although the Constitutional Court rejected the claim that Article 35 of Law 13/2003 is unconstitutional, a dissenting opinion from the judge highlighted the subjectivity of age-based requirements. This underscores the need for legislative reforms in Indonesia to establish clear anti-age discrimination laws, ensuring fairness and equal opportunities in recruitment processes. Therefore, it is crucial to implement policies that focus on job seekers competencies, experience, and skills, without being influenced by age.

Abstract

Revenue Sharing Fund (DBH) in the oil and gas sector is one of the important instruments in regulating the distribution of revenue between the central government and producing regions in Indonesia. This DBH policy is designed to ensure fair revenue sharing between the center and regions. However, its implementation often encounters various problems, such as delays in distribution, unfairness in distribution, and the impact of fluctuations in world oil and gas prices. The type of research used is normative legal research with a prescriptive juridical approach to understand the discourse on oil and gas DBH policies in Indonesia. The results of the study show that there is a discourse on the Revenue Sharing Fund policy in the oil and gas sector in Indonesia showing that this policy still faces a number of serious challenges, such as delays in distribution, unfairness in distribution, lack of transparency, and the impact of fluctuations in global oil and gas prices. To improve this policy, reforms are needed in the distribution mechanism, revision of the distribution formula, increased transparency, and economic diversification in producing regions
