Abstract

The Non-Fungible Token (NFT) market has grown rapidly as one of the innovations in the digital economy, opening up new opportunities for creators to trade their works globally. However, this development also presents significant challenges related to copyright protection and dispute resolution in blockchain-based digital transactions. This study aims to analyze Indonesia's legal regulations in overseeing the NFT market, with a focus on copyright protection and dispute resolution mechanisms. The research method used is a normative juridical approach with a literature analysis of existing regulations, such as Law No. 28 of 2014 on Copyright. The results show that legal regulations in Indonesia have not fully accommodated blockchain technology and NFT transactions, thus creating legal loopholes that increase the risk of copyright infringement. In addition, the existing oversight and dispute resolution mechanisms are still conventional in nature, which is less effective for handling the complexity of the NFT market. To address these challenges, this study recommends the establishment of specific regulations governing copyright protection in the NFT market, the development of a technology-based surveillance system, and the implementation of a digital dispute resolution mechanism. The implication of this research is the importance of collaboration between the government, creator community, and technology platforms to create a healthy, safe, and competitive NFT market ecosystem. The findings are expected to be the basis for strengthening regulations and increasing legal protection on copyrighted works transactions in the NFT market in Indonesia.

Abstract

The survival of the nation and state to build a civilization is to build a good quality family, then when a family has become good then the state will be good and quality so that Indonesian civilization can be built, then human resources become a central point that needs to be fostered and developed and One of the best places for HR education is in the family environment. One of the efforts to develop the potential of human resources so that they are able to ensure the survival of the nation and state can be done through education to understand the law to know the rights and obligations that have been determined by the state in building a good family so that they are able to also understand and provide legal protection for the components of the nuclear family who have accommodated in the legal system in Indonesia. So because of this, the state needs to be present in addition to creating law, the state must also conduct legal education socialization related to family law and legal protection for the community component, namely the nuclear family.

Abstract

Penelitian ini menganalisis peran dan tanggung jawab hukum Badan Penyelesaian Sengketa Konsumen (BPSK) Kota Medan dalam melindungi hak konsumen jasa pengiriman barang. Dengan menggunakan metode yuridis normatif dan empiris, penelitian ini mengkaji efektivitas penyelesaian sengketa konsumen melalui studi kasus Putusan BPSK Nomor 010/Arbitrase/2024/BPSK.Mdn. Hasil penelitian menunjukkan bahwa BPSK memiliki peran strategis dalam memberikan solusi cepat, murah, dan mudah diakses untuk sengketa konsumen, dengan dominasi penyelesaian melalui arbitrase (80%). Namun, terdapat kendala berupa kurangnya sosialisasi kepada masyarakat dan keterbatasan dalam eksekusi putusan jika pelaku usaha tidak kooperatif. Penelitian ini memberikan rekomendasi untuk meningkatkan efektivitas BPSK melalui optimalisasi sosialisasi, penguatan mekanisme pengawasan putusan, dan peningkatan kualitas sumber daya manusia.

Abstract

Penelitian ini membahas akibat hukum yang timbul bagi debitur yang tidak melanjutkan pembayaran utang setelah objek jaminan fidusia hilang. Dalam praktik pembiayaan, jaminan fidusia sering digunakan sebagai bentuk agunan, di mana objek jaminan tetap berada dalam penguasaan debitur. Namun, ketika objek tersebut hilang, baik karena kelalaian maupun faktor lain, muncul permasalahan mengenai kelanjutan kewajiban debitur dan perlindungan bagi kreditur. Tujuan penelitian ini adalah untuk menganalisis hak dan perlindungan hukum bagi kreditur serta debitur dalam kondisi tersebut, dan untuk mengetahui peran lembaga hukum dalam penyelesaian sengketa. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa debitur tetap bertanggung jawab atas sisa kewajiban utangnya meskipun objek jaminan fidusia telah hilang, sebagaimana diatur dalam Pasal 15 UU Fidusia dan Pasal 1243 KUHPerdata. Kehilangan objek tidak menghapus utang debitur, dan apabila debitur lalai, maka ia dapat dikenakan ganti rugi. Di sisi lain, kreditur memiliki hak untuk mengeksekusi aset lain milik debitur. Perlindungan hukum terhadap debitur juga dapat diperoleh melalui asuransi dan Undang-Undang Perlindungan Konsumen.

Abstract

This study is motivated by the ongoing weakness in the implementation of legal responsibility by expedition service providers for consumer losses in the form of lost or damaged goods, despite the existence of consumer protection regulations. The research focuses on the prevailing legal framework, the form of legal responsibility held by PT. Antar Jasa Indonesia as a business operator, and the effectiveness of dispute resolution mechanisms available to consumers. The objective is to provide a comprehensive analysis of the legal basis governing the liability of expedition service providers, the practical implementation of such liability, and the obstacles that hinder effective consumer protection. The methodology employed combines normative and empirical juridical approaches, utilizing statutory, conceptual, and sociological perspectives. Normative analysis was conducted on Law Number 8 of 1999 on Consumer Protection and the Indonesian Civil Code, while empirical analysis involved a case study of claim handling and dispute resolution practices at PT. Antar Jasa Indonesia. The findings reveal that, normatively, business operators are obliged to compensate consumers for losses; however, in practice, the implementation of this responsibility remains suboptimal. Contributing factors include a lack of legal awareness among consumers, weak regulatory oversight, and claim procedures that are insufficiently transparent and inefficient. The study concludes that the legal responsibility of PT. Antar Jasa Indonesia has not yet fully ensured maximum protection for consumers. The implications highlight the need to strengthen consumer complaint systems, enhance corporate transparency and accountability, and harmonize operational standards with consumer protection principles to ensure legal certainty and fairness for all parties.

Abstract

Penyebaran pandemi virus corona atau Covid-19 merupakan tantangan bagi Indonesia, karena sampai saat ini Indonesia masih berjuang untuk memulihkan keadaan dengan melawan pandemi covid 19, khususnya bagi pendidikan yang tidak berjalan sebagaimana mestinya. Dalam pelaksanaan kegiatan Pengabdian kepada Masyarakat ini pengabdi memberikan literasi atau pemahaman dalam bentuk penyuluhan yang berkaitan dengan aturan atau dasar hukum penyelenggaraan pembelajaran ta. 2020/2021 di masa pandemi covid-19. Dimana metode yang digunakan adalah metode ceramah dan diskusi secara tatap muka langsung, yang dilakukan bersama dengan Guru SMA Harapan 3 Deli Serdang, sebanyak 10 orang. Pemerintah mengeluarkan Surat Edaran Menteri Pendidikan dan Kebudayaan Nomor 4 Tahun 2020 Tentang Pelaksanaan Kebijakan Pendidikan Dalam Masa Darurat Penyebaran Corona Virus Disease (Covid-19) sebagai dasar hukum pelaksanaan pembelajaran daring atau jarak jauh, dan cara-cara yang dilakukan oleh guru dan siswa dalam melakukan proses belajar mengajar antara lain melalui media sosial seperti WhatsApp (WA), telegram, instagram, aplikasi zoom, VoiceNote yang tersedia di WhatsApp, ataupun media lainnya.
