Abstract

the problem of forest, law, and community mirrors that the development of forest product commodities cannot be separated from the historical sequence of forest management in Indonesia which is a portrait of structural transformation between the community and the government of forest resources which is projected as an effort to realize ideal forest management. This condition is an initial task for the state and all its components to develop a forest management framework, which means it cannot be separated from the authority of the government which includes the village community, as well as the forest itself. Through normative juridical research methods, this paper will focus on anatomical discussions of forest management that are carried out when involving rural communities in the regions. the results of this study explain that: First, the beginning of the anatomy of forest management begins with a shift in forest management patterns. Second, the village community is one of the elements in the anatomy / management of the forest because of the strong relationship to forest resources in terms of concepts, norms, and history. Third, the anatomical framework of forest management is influenced by the Government, Village Communities and Forests as an interrelated system.

Abstract

The transcription of Good Corporate Governance (GCG) scenarios in various state regulations basically attempts to build plots to move various economic resources from an area with low productivity to an area with higher productivity with greater results. However, this condition is different when the Indonesian Government wants Village-Owned Enterprises (BUMDes) which normatively and culturally are not designed for entrepreneurship like BUMD/BUMN. The consequence of this desire is that in its implementation BUMDes tends to be neglected and not bound by the principles of Good Corporate Governance (GCG). Through juridical-normative research methods and 3 (three) legal approaches, this research focuses on "Motion Sickness" towards BUMDes resulting from their placement in the "return on investment" space without Good Corporate Governance (GCG). The results of this research show that when analogous to a vehicle, BUMDes experience Motion Sickness or nausea due to: First, the psychological burden on the apparatus in the Village Government; Second, the Good Corporate Governance (GCG) Design is not in accordance with the BUMDes Design. Hence, the acupressure points that need to be pressed in dealing with BUMDes problems include: legal revitalization in the Village Law, overcoming work culture (such as fraud and insider transactions), sterilization of political elements (separating the interests of village officials from interests of Business Entities), and expansion of the business environment. So that in the future Corporate Governance and Corporate Management in BUMDes can be realized through the commitment of stakeholders such as: Capital Owners/GMS, Board of Supervisory/Commissioners, and Board of Directors.

Abstract

Politik Hukum Desentralisasi Aceh tidak lepas dari “Historical View” atas hubungan antara Pusat-Daerah dan dinamika politik untuk mencapai titik tengah "Konsolidasi Demokrasi", yang bermuara pada sensitif politik yang belum tuntas penyelesaiannya. Tulisan ini merupakan sebuah catatan atas konsekuensi dari karakteristik perencanaan (het plan/plannen) di Provinsi Aceh dalam kacamata desentralisasi. Melalui metode penelitian yuridis normatif, terdapat beberapa poin yang dapat disimpulkan, Pertama, dalam sistem desentralisasi di Indonesia mengenalkan Sistem Perencanaan Pembangunan Nasional sebagaimana diatur dalam Undang-Undang Nomor 25 Tahun 2004, dimana  pendekatan dalam menyusun perencanaan tidak memungkinkan adanya bentuk “diskoneksi” melalui jalur “pengkhususan.” Kedua, Desentralisasi membuka daerah untuk menetapkan “nilai” khusus sebagaimana Aceh menerapkan syariat Islam sebagai hukum yang hidup dalam masyarakat Aceh sepanjang sejarah mereka. Ketiga, berdasarkan pada kondisi tersebut, maka Rencana Pembangunan Jangka Panjang Provinsi yang diatur dalam Qanun Aceh Nomor 9 Tahun 2012 tentang Rencana Pembangunan Jangka Panjang Aceh Tahun 2012-2032 mengalami “diskoneksi” dan butuh upaya reharmonisasi sebagaimana tercantum dalam Qanun Aceh tentang Rencana Pembangunan Jangka Panjang Aceh Tahun 2025-2045. Kata Kunci: Aceh; Desentralisasi; Perencanaan; Plannen/Het-Plan. The Legal Politics of Decentralization in Aceh is inseparable from the historical view of the relationship between the central and regional governments, as well as the political dynamics aimed at reaching a middle ground of democratic consolidation, which ultimately centers around unresolved political sensitivities. This paper serves as a note on the consequences of the characteristics of planning (het plan/plannen) in Aceh Province from the perspective of decentralization. Using a normative juridical research method, several conclusions can be drawn.First, Indonesia’s decentralization system introduces the National Development Planning System (SPPN) as regulated in Law Number 25 of 2004, where the planning approach does not allow for a “disconnection” through “specialization.”Second, decentralization allows regions to adopt specific “values,” as in the case of Aceh, which implements Islamic law as a living legal system within its society throughout its history.Third, based on these conditions, the Long-Term Development Plan (RPJP) of the province, as regulated in Qanun Aceh Number 9 of 2012 concerning the 2012–2032 Aceh Long-Term Development Plan, experiences a “disconnection” and requires reharmonization efforts as reflected in the Qanun Aceh on the Aceh Long-Term Development Plan for 2025–2045. Abstract

In facing the challenges of the digital era, Ngrendeng and Banjarsari villages need innovative approaches to improve the efficiency of public services. This activity aims to increase the understanding and ability of village officials and village residents about digital-based village administration services. The application was built by utilizing some technologies that are WhatsApp Chatbot, Google Drive and Google Form. The needs analysis shows that there are differences in service facilities between the two villages, where Banjarsari only focuses on providing information regarding the requirements for submitting certificates, while Ngrendeng allows for digital processing of letters at the same time. The evaluation of the questionnaire shows that the application developed is very appropriate to needs. This activity is published in national mass media Radar Malang, Prasetya Online UB, and Academiamu. In addition, the training module has been registered Intellectual Property Rights to the Indonesian Ministry of Law and Human Rights.
