Abstract

This research is important because various complex dynamics have occurred in governance planning for the development of management resources in the bureaucratic apparatus in Industry 5.0, ready to face technological advances and also able to pay attention to aspects of changes in people's lives in a sustainable manner. This research aims to analyze how the implementation of Industry 5.0 affects the Indonesian economic sector and the challenges faced in adopting this technology. Research method A comprehensive literature review was carried out to understand the Opportunities and Challenges of Sharia Business in Industry 5.0 and then applied in the Indonesian context. The findings of this research provide an explanation of the current conditions regarding Opportunities, Sharia Business Challenges in Industry 5.0, aspects such as digital infrastructure, workforce skills, and government policies that support or hinder the development of Industry 5.0 in Indonesia. The results of this research can provide input for policy and stakeholders in understanding the contribution of sharia business in Industry 5.0 to the Indonesian economy and formulating appropriate strategies to encourage sustainable economic growth. Abstract

Kemajuan teknologi informasi terus mendorong munculnya berbagai kegiatan yang dilakukan masyarakat melalui kecanggihan teknologi tersebut, khususnya internet. Salah satu kegiatan di dunia maya adalah transaksi jual beli secara elektronik (e-commerce). i. Pendekatan ini memastikan bahwa kasus-kasus seperti itu dapat diselesaikan secara hukum, mencegah terjadinya kekosongan hukum yang dapat mengakibatkan kerugian yang lebih besar. Penelitian ini bertujuan untuk mengeksplorasi langkah-langkah hukum yang dapat diambil sebagai respons terhadap tindakan melawan hukum dalam transaksi jual beli berbasis internet. Dengan mengkaji dan menganalisis aspek-aspek hukum yang melibatkan transaksi ini, penelitian ini berusaha memberikan wawasan mengenai potensi penyelesaian hukum. Fokusnya adalah memastikan bahwa keadilan dilayani dan kerugian yang dialami oleh pihak yang terlibat dapat diatasi dengan tepat dalam kerangka hukum. Secara keseluruhan, penelitian ini berkontribusi pada pengembangan strategi hukum dalam menanggapi tindakan melawan hukum dalam transaksi e-commerce. Dengan mengidentifikasi dan memahami implikasi hukum, penelitian ini membuka jalan untuk tindakan hukum yang efektif, melindungi kepentingan pihak yang terlibat dalam transaksi online, dan mencegah terjadinya kekosongan hukum yang dapat mengakibatkan kerugian yang lebih besar.

Abstract

Di era digital saat ini dunia telah mengalami revolusi digital, umat manusia telah mengubah cara pandangnya dalam menjalani kehidupan yang sangat canggih saat ini. Teknologi telah membuat perubahan besar kepada seluruh dunia, mulai dari mempermudah hingga menimbulkan masalah, karena fitur digital yang semakin canggih ini tidak digunakan dengan baik dan benar. Perkembangan teknologi yang berkembang saat ini dapat dijadikan sebagai alat bantu untuk mempermudah mengungkap tindak pidana yang terjadi. Dikarenakan meningkatnya jumlah tindak pidana sekarang ini, maka diperlukan pembuktian yang juga harus mengikuti perkembangan zaman untuk mempermudah penanggulangan tindak pidana. Seiring dengan perkembangan teknologi dan elektronik Closed Circuit Televison (CCTV) banyak digunakan sebagai alat bukti atau setidak-tidaknya penunjang alat bukti lain dalam perkara pidana, pada umumnya CCTV digunakan untuk alasan keamanan namun sekarang fungsi CCTV sudah bisa membantu para penegak hukum dalam sistem pembuktian. Seperti halnya pada kasus Ronald Tannur dan ada beberapa kasus lain. Berhadapan pada keabsahan CCTV sebagai alat bukti sudah tentu akan bertentangan dengan instrument hukum mengingat pada pasal 184 ayat (1) Kitab Undang-Undang Hukum Acara pidana tidak menyebutkan secara jelas kedudukan CCTV sebagai alat bukti yang sah dalam perkara pidana.

Abstract

This research aims to analyze the urgency of regulations specifically addressing the misuse of deepfake technology as a form of legal protection for victims of Online Gender-Based Violence (GBV). Artificial intelligence (AI)-based deepfake technology can create highly realistic visual content but is also prone to misuse, especially for non-consensual pornography and the dissemination of false information that damages individuals' reputations. This research employs normative legal methods, examining Indonesian laws and regulations such as the Electronic Information and Transaction Law (EIT Law), the Pornography Law, the Personal Data Protection Law (PDP Law), and the Criminal Code (KUHP). The results indicate that, although there are existing regulations that could apply, there are no specific regulations addressing deepfake technology, resulting in suboptimal victim protection. Specific regulations are necessary to provide preventive protections, restrict the creation and dissemination of illegal deepfake content, and enforce stricter sanctions. Additionally, increasing digital literacy and public legal awareness is crucial as a preventive measure. With comprehensive regulations, it is hoped that the rights of GBV victims will be better protected and the misuse of deepfake technology minimized.

Abstract

The research aims to analyze the potential for cybercrime in e-commerce buying and selling transactions. The research method used is normative juridical. The type of primary data is interviews and discussions related to e-commerce, and secondary data is library literature. Data collection techniques used literature studies, interviews, observation, and documentation. The data analysis technique is descriptive qualitative which is used in the form of an interactive analysis model. The research results show that the potential for cybercrime in e-commerce buying and selling transactions has increased significantly, including minimal knowledge, waste of money, being tempted by fake gifts, high levels of unemployment and poverty, and less strict government security policies. Forms of cybercrime in e-commerce include hacking, identity theft, data breach, phishing, spamming, pharming, pretexting, qui pro quo, and contacting the victim directly. Specific solutions are needed to overcome the cybercrime problem of e-commerce buying and selling, namely Backup, Use of SSL Certificates, Firewall, E-Commerce Security Plugin, Multilayer security, User and Staff Education. The conclusion of this research is that the potential for cybercrime in e-commerce buying and selling transactions has increased significantly so it is very necessary to prevent specific solutions in resolving cybercrime problems in e-commerce buying and selling transactions.

Abstract

Malpractice, a criminal act in the healthcare field, creates legal problems when patients realize the impact. Medical negligence can harm patients, triggering risks that could have been avoided with medical prudence. Normative and sociological research supports the criminal law assessment of malpractice, focusing on maltreatment and negligence causing death. Sanctions are imposed by the medical professional organization and the immediate supervisor in charge, taking into account the ethical values and values of the profession. Punishment is only imposed if the act violates the law, and the form of malpractice needs to be adjusted to the development of science and the times.
