Abstract

Penyebaran paham radikalisme dan intoleransi di Indonesia hingga kini belum terselesaikan dengan baik karena sejumlah masalah, baik dalam tingkat infrastruktur maupun suprastruktur hukum yang memadai. Tulisan ini bertujuan untuk menganalisis arah kebijakan Kepolisian dalam Penanganan Penyebaran Paham Radikalisme dan Intoleransi. Penelitian ini menggunakan metode penelitian hukum normatif, karena fokus kajian berangkat dari kekaburan norma, menggunakan pendekatan : statute approach, conceptual approach, serta analytical approach. Tehnik penelusuran bahan hukum menggunakan tehnik studi dokumen, serta analisis kajian menggunakan analisis kualitatif. Hasil penelitian ini menunjukan bahwa dalam penanganan paham radikalisme dan intoleransi di Indonesia, sejauh ini telah dilakukan beberapa upaya oleh Kepolisian. Akan tetapi, pemberantasan penyebaran paham radikalisme dan intoleransi di Indonesia tidak cukup apabila hanya dilakukan oleh pihak Kepolisian saja, tetapi juga harus melibatkan beberapa pihak dalam membangun kesadaran bersama

Abstract

The study aims to find out the setting for the sentencing of sanctions against children who commit criminal acts of abuse resulting in death. The type of research used by the author is the empirical normative research type. The results showed that the regulation of sanctions against children who commit crimes that are sentenced to criminal sanctions has been contained in Article 71 paragraph (1) to paragraph (5) of Law No. 11 of 2012 concerning the Criminal Justice System of Children. In addition to the type of sanctions contained in Article 71, sanctions actions can also be imposed on children who commit criminal acts and the overall number of cases obtained from the results of research in the Sungguminasa Court is a total of 7 cases and in its ruling the tendency of judges to give criminal sanctions to prison for children perpetrators of crimes that result in death.

Abstract

This study positions customary land not merely as an object of agrarian law but as a reflection of the complex relationship between state entities, local traditions, and the human rights of indigenous communities, which are constantly adapting to the demands of modernisation and the need for legal certainty. Using a normative legal approach and socio-legal analysis, the discourse on the existence and protection of customary rights in Indonesia illustrates the contestation between formal recognition dominated by the national registration system and local practices that still rely on customary values, structures, and legitimacy. This dynamic demands strengthening legal harmonization mechanisms, innovation in institutional instruments, and sensitivity to state policies so that substantive justice and social sustainability for indigenous communities can be realised within the framework of national agrarian law.

Abstract

This study examines the impact of changes in customary marriage structures on the individualisation of customary land rights, from communal to individual ownership, and its implications for the governance and protection of customary land in Indonesia's indigenous communities. Using normative legal methods, the study finds that modernisation and land certification policies encourage the fragmentation of collective rights into private rights, thereby posing risks to weakened social solidarity, ownership conflicts, and increased vulnerability to land exploitation. Although providing administrative legal certainty, individualisation has not been able to optimally accommodate customary values and the social functions of customary land. Therefore, synergy between customary law and national law is needed to create fair and sustainable agrarian regulations, ensuring the protection of customary rights while adapting to the socio-cultural dynamics of indigenous communities.

Abstract

The purpose of this research is to reconstruct the practice of Dui' Papenre in Bugis marriage customs, ensuring it aligns with human rights values, particularly non-discrimination and equality, while preserving its cultural essence. This research also examines the harmonization between customary law, national law, and human rights principles, and proposes recommendations for legal reform. The research method used is normative law with a descriptive-analytical approach, supported by legislative, conceptual, and sociological perspectives. Data is sourced from legal documents and literature and analyzed qualitatively. The novelty of this research lies in its unique combination of analyzing Dui' Papenre from the perspectives of customary law, national law, and human rights, thereby filling a gap left by previous studies that have not comprehensively discussed this intersection. The findings reveal that the practice of Dui' Papenre still holds cultural value, but it often raises human rights concerns, particularly regarding the rights to form a family and non-discrimination, when the nominal value is disproportionate. The analysis shows that regulation through local regulations with reasonable nominal limits, dispute mechanisms, and community-based customary mediation can preserve traditions without violating human rights. In conclusion, the harmonization of customary law, national law, and human rights principles is key to ensuring that Dui' Papenre remains sustainable and fair. Transparent and participatory regulations will ensure that this tradition aligns with social justice and the protection of citizens' constitutional rights.
