Abstract

Didalam pengadilan di indonesia terdapat aparat penegak hukum untuk menyelesaikan perkara atau sengketa, terutama dalam suatu memutus keadilan dalam setiap masalah yang di selesaikan di pengadilan di lakukan oleh hakim, yang mana hakim wajib mengadili menurut hukum, maka hakim harus mengenal hukum di samping peristiwanya, seorang hakim tidak memihak kepada siapapun juga walaupun itu keluarganya, kalau sudah sidang semuanya di perlakukan sama, namun dalam prakteknya tidak jarang bahkan sebagian besar dari putusan pengadilan tidak mendapatkan rasa keadilan bagi masyarakat sehingga dalam banyak kasus putusan pengadilan sesungguhnya tidak lebih dari akumulasi dari proses ketidak adilan tak bisa di pungkiri semakin berkembang masyarakat semakin maju, praktek jahat aparat lembaga peradilan semakin berkembang pula, hal ini mengabaikan sebuah kode etik, permasalahan yang akan di teliti adalah mengenai perilaku hakim yang menyimpang dan melanggar kode etik profesi hakim. Dalam sebuah penelitian hukum ini metode yang di gunakan yaitu metode normatif, teori, undang-undang, yuridis yang menekan pada ilmu hukum dan penelitian studi kepustakaan ini berdasarkan pengetahuan yang cukup serta ciri-ciri tertentu yang berhubungan dengan suatu permasalahan penelitian. Hasil dari sebuah penelitian yang di lakukan berdasarkan logika dan peraturan undang-undang serta silogisme yang bertujuan menjamin kepastian hukum terhadap suatu putusan hakim dan perilaku hakim agar tidak menyimpang dan melanggar kode etik hakim.

Abstract

Sejak dilantik sebagai Presiden Republk Indonesia pada 20 Oktober 2024 lalu, Presiden Republik Indonesia mulai tanggal 8 November 2024 akan melakukan kunjungan ke beberapa negara, yaitu ke Tiongkok, ke Amerika Serikat, Peru, Brasil dan terakhir ke Inggris. Dengan kepergian Presiden Prabowo ke luar negeri tersebut mengakibatkan negara Indonesia terjadi kekosongan kekuasaan Presiden. Permasalahan yang diajukan dalam penulisan ini adalah a. hasil apa saja yang diperoleh Presiden Prabowo ke luar negeri. B. apakah terjadi kekosongan kekuasaan Presiden selama Presiden Prabowo melakukan kunjungan ke luar negeri. Metode yang dipergunakan dalam penelitan ini adalah metode penelitian normative. Hasil penelitian menunjukkan bahwa Ketika Presiden Prabowo melakukan kunjungan ke luar negeri, tidak terjadi kekosongan kekuasaan Presiden. Hal ini dikarenakan Presiden menerbtkan Keputusan Presiden Nomor 31 Tahun 2024 tentang Penugasan Wakil Presiden melaksanakan Tugas Presiden

Abstract

The provisions of Article 24C paragraph (1) of the Republic of Indonesia Constitution Year 1945 give authority to the Constitutional Court to the dispute over the authority of state institutions whose authority is granted by the Constitution. Whereas disputes between state institutions that are not regulated in the Republic of Indonesia Constitution Year 1945 have a vacuum of norm.The results of the study show that: first, the need to regulate disputes over authority between state institutions that are not regulated in the Republic of Indonesia Constitution Year 1945 because Indonesia is a constitutional state, due to the incomplete discussion in the Amendment of the Republic of Indonesia Constitution Year 1945, due to the potential for disputes of authority between state institutions. Second, the legal implications of the settlement of authority between state institutions not regulated in the Republic of Indonesia Constitution Year 1945 conducted by the President through instructions for resolving disputes. Third, in the perspective of state life, the formulation of disputes settlement arrangements between state institutions can be done through three options: (1) expanding the authority of the Constitutional Court (2) expanding the authority of the Supreme Court (3) giving authority to other state institutions.

Abstract

The Constitutional Court of the Republic of Indonesia is a State Institution as a product of the Third Amendment to the 1945 Constitution of the Republic of Indonesia. The Third Amendment stipulates that the Constitutional Court of the Republic of Indonesia must have been established on August 17, 2003.Article 24C paragraph (1) Constitution of the Republic of Indonesia year 1945 stipulates that The Constitutional Court has four powers and one obligation. First review: a .to review the law against the constitution, b. resolve disputes between state institutions whose authority is granted by the Constitution, c. dissolve a political party d. resolve disputes over election results. Meanwhile, one obligation of the Constitutional Court is to decide on the opinion of the DPR that the President is based on the opinion of the DPR regarding alleged violations of the law by the president and vice president according to the Constitution. But this research just discussed the first authority, namely to review the law to Basic Law. This research is a normative legal research using various legal norms as an analysis material. Conclusions are drawn using legal interpretation.

Abstract

Article 24C paragraph (1) of the 1945 Constitution of the Republic of Indonesia, hereinafter referred to as the 1945 Constitution of the Republic of Indonesia states that, the Constitutional Court has the authority to try at the first and final levels whose decision is final to review laws against the Constitution, decide on disputes over the authority of state institutions whose powers are granted by the Constitution, decide on the dissolution of political parties, and decide on disputes about the results of general elections. The dissolution of political parties through this legal aspect is the result of the third amendment to the 1945 Constitution of the Republic of Indonesia. Previously, the dissolution of political parties was carried out by the government. The dissolution of political parties through legal channels is a consequence of the statement that Indonesia is a state of law. This is also due to the provisions of Article 1 paragraph (2) of the 1945 Constitution of the Republic of Indonesia which states that Sovereignty is in the hands of the people and implemented according to the Constitution. The provisions of Article 1 paragraph (2) of the 1945 Constitution of the Republic of Indonesia constitute a shift from the supremacy of the People's Consultative Assembly to the supremacy of the Constitution The research method used in this study is a normative juridical research method, which means that this research uses legal norms as a means to analyze problems. While the approach method in this study uses: statute approach, conceptual approach, historical approach, and comparison approach. To analyze in this research is to use the interpretation of legal systematics.The conclusion will answer the problems raised in this study.
