Abstract

Interfaith marriage remains a contentious issue in many legal and religious traditions, particularly in Islam, where it is explicitly regulated. This study explores the theological, legal, and sociocultural reasons behind the prohibition of interfaith marriage in Islam, with a focus on its implications for Muslim communities. Islamic law, derived from the Quran, Hadith, and scholarly interpretations, generally prohibits Muslim women from marrying non-Muslim men, while permitting Muslim men to marry women from the People of the Book (Christians and Jews) under specific conditions. This distinction is rooted in concerns about religious continuity, family structure, and the spiritual well-being of future generations. From a legal perspective, many Muslim-majority countries incorporate these religious principles into their national laws, restricting or entirely prohibiting interfaith unions. The justification for this prohibition is often linked to the preservation of Islamic values and the potential conflicts arising from differing religious obligations within a marriage. Sociologically, interfaith marriages can lead to identity struggles, legal uncertainties, and challenges in raising children with a unified religious identity. However, critics argue that such prohibitions may conflict with contemporary human rights principles, including freedom of marriage and religious choice. By examining Islamic jurisprudence alongside modern legal and social perspectives, this study seeks to provide a nuanced understanding of why interfaith marriage is restricted in Islam and how these regulations impact Muslim communities globally. It also explores the evolving discourse on this issue, particularly in pluralistic societies, where legal frameworks and personal freedoms increasingly challenge traditional religious interpretations.

Abstract

In facing the challenges of globalization and increasing financial crimes such as money laundering and terrorism financing, the Know Your Customer (KYC) principle is an important pillar in maintaining the integrity of the financial system in Indonesia. This article analyzes the legal aspects of the application of the KYC principle in Indonesian banking institutions using a normative legal approach. The study was conducted on various regulations that serve as the legal basis, including Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering, as well as regulations from the Financial Services Authority and Bank Indonesia. The findings show that although the legal framework is available and the implementation of KYC has made a significant contribution to identifying and preventing suspicious transactions, there are still implementation challenges such as limited human resources, technology gaps, and ownership of official documents by customers. To increase the effectiveness of KYC, it is necessary to increase human resource capacity, utilize advanced technology, and strengthen cross-country cooperation in combating financial crimes.

Abstract

The development of information technology has driven the transformation of banking services through internet banking which provides easy access and transaction efficiency for customers. However, this progress also increases the risks faced by customers, especially related to unclear agreements, unilateral changes in provisions, and the use of detrimental standard clauses. This study aims to analyze legal protection for users of internet banking services according to Law No. 8 of 1999 concerning Consumer Protection. The method used is empirical legal research with a positive law approach and field data collection. The results of the study indicate that although there are no specific regulations that explicitly regulate internet banking, legal protection for customers can still be implemented through the interpretation of the Consumer Protection Law and other related regulations. This law provides a strong legal basis to protect customer rights from unilateral practices and imbalances in credit agreements. However, the implementation of this legal protection still faces challenges, especially related to customer legal awareness and legal certainty. Therefore, strengthening regulations and legal education are needed to improve protection for users of internet banking services in Indonesia.

Abstract

ABSTRACT. Islamic boarding schools are religious-based educational institutions with a focus on forming children's morals and character as an effort to prevent children from falling into immorality which can obstruck the fulfillment of children's educational rights to the maximum. The problem is that the survey results of the target community (Santri Islamic Boarding School Ar Rosyid) do not yet have an optimal understanding (17 respondents answered incorrectly) regarding marriage regulations as regulated in the Marriage Law, including regarding the minimum age limit for marriage. The target community also does not optimally understand the existence of alternative solutions for children dropping out of school due to child marriage, so that the right to education cannot be obtained optimally. Based on this concern, the author offered an alternative solution in the form of sustainable activities that focused on increasing the urgency of understanding the age of marriage in order to manifest children's educational rights at the Ar Rosyid Pemalang Islamic boarding school. The target achievement is increasing the urgency of understanding the marriage age and educational forum solutions through post tests with higher correct answers than the survey results. The methods used to achieve the objectives of this service program are: (1) Coordination and survey of partner needs (2) legal counseling; and (3) Evaluation. The target audience for this service program are ordinary people who have not optimally understood and analyzed the urgency of understanding the marriage age so that basic education is fulfilled.
