Abstract

AbstrakPerkembangan teknologi jaringan komputer global atau internet telah menciptakan dunia baru yang dinamakan Cyberspace (Dunia Maya). Dengan munculnya internet ini banyak masyarakat yang memanfaatkan Cyberspace untuk mengakses informasi melalui media sosial, melakukan transaksi bisnis dan dapat berkomunikasi tanpa batas. Cyberspace dapat mendekatkan orang yang jauh begitu pula sebaliknya, adanya interaksi tersebut juga dapat menimbulkan konflik. Salah satunya berupa masalah privasi yang rentan terhadap tindak pidana yakni Cybercrime atau yang dikenal dengan kejahatan dunia maya. Cybercrime (kejahatan dunia maya) salah satunya yaitu Akses Ilegal. Akses ilegal inilah yang menyebabkan hilangnya ruang privasi masyarakat. Bocornya data informasi publik yang mana merupakan sebuah tindak kejahatan yang menimbulkan dampak buruk bagi seseorang yang data informasinya dicuri atau dibocorkan. Hal itu dapat di tindak secara pidana melalui Undang-Undang No.19 Tahun 2016 yang merupakan Perubahan Atas Undang-Undang No.11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik (ITE) sebagai bentuk perlindungan bagi korban dari Cybercrime. Kata Kunci: Cyberspace, Cybercrime, Akses Ilegal, Tindak Pidana. AbstractThe development of global computer network technology or the internet has created a new world called Cyberspace (Cyberspace). With the advent of the internet, many people take advantage of Cyberspace to access information through social media, conduct business transactions and be able to communicate indefinitely. Cyberspace can bring people who are far away closer and vice versa, the existence of these interactions can made conflicts. One of them is in the form of privacy problems that are vulnerable to criminal acts, namely Cybercrime or known as cybercrime. Cybercrime (cyber in crime) is Illegal Access. This illegal access that leads to the loss of people's privacy space. Leaking public information data which is a crime that has a bad impact on someone whose information data is stolen or leaked. This can be criminalized through Law No.19 of 2016 which is an Amendment to Law No.11 of 2008 concerning Electronic Information and Transactions (ITE) as a form of protection for victims of Cybercrime. Abstract

ABSTRAK Berkaitan dengan eksistensi Satuan Polisi Pamong Praja dalam penegakan hukum sebagai perangkat pemerintah daerah, kontribusi satuan Polisi Pamong Praja sangat diperlukan guna mendukung suksesnya pelaksanaan Otonomi Daerah dalam penegakan peraturan daerah menciptakan pemerintahan yang baik. Yang menjadi permasalahan dalam penelitian ini 1. Bagaimanakah batas kewenangan penegakan hukum Perda oleh Polisi Pamong Praja?, 2. Hambatan-hambatan apa yang dihadapi oleh Polisi Pamong Praja dalam Penegakan Protokol Kesehatan Covid-19 ?Metodologi pengumpulan data-data melalui penelitian kepustakaan. Hasil penelitian menunjukan bahwa Batas kewenangan penegakan hukum Perda oleh Polisi Pamong Prajadalam menangani Pandemi Covid-19adalah dilakukan dengan cara memberikan berbagai macam layanan kesehatan yang lebih baik, selalu menjaga jarak saat berpergian dan juga selalu menggunakan masker. Hambatan-hambatan apa yang dihadapi oleh Polisi Pamong Praja dalam Penegakan Protokol Kesehatan Covid-19 adalah, diantaranya yang menjadi faktor-faktor penghambatnya berasal dari : Faktor Internal yaitu:kekurangan personil, terdapat adanya kekurangan sarana dan juga prasarana, terdapat adanya suatu kualitas pendidikan,fasilitas kerja dan faktor eksternal yaitu, lemahnya penegakan hukum.Kesimpulan bawah proses penarikan kendaraan roda dua yang menunggak atau tidak membyar angsuran adalah Pihak Leasing dilarang melakukan penarikan paksa kendaraan bermotor dijalan. Kesimpulan, batas kewenangan penegakan hukum Perda oleh Polisi Pamong Prajadalam menangani Pandemi Covid-19adalah dilakukan dengan cara memberikan berbagai macam layanan kesehatan yang lebih baik, selalu menjaga jarak saat berpergian dan juga selalu menggunakan masker. Hambatan-hambatan dalam Penegakan Protokol Kesehatan Covid-19 adalah, diantaranya berasal dari : Faktor Internal yaitu:kekurangan personil, terdapat adanya kekurangan sarana dan juga prasarana, terdapat adanya suatu kualitas pendidikan,fasilitas kerja dan faktor eksternal yaitu, lemahnya penegakan hukum. Saran hendaknya Peran Pemerintah Daerah dalam menangani Pandemi Covid-19yang berada di Daerah Banyuasin sebaiknya dapat lebih fokus. diharapkan, bahwasannya Pemerintah Daerah dapat lebih menambah personil dan juga menambah sarana maupun juga prasarana, tenaga pembantu dan juga anggaran yang dalam hal ini dapatmenunjang atas suatu pelaksanaan tugas dan fungsi Satpol PP untuk menegakkan Peraturan Daerah dan juga Peraturan Kepala Daerah. Kata Kunci : Covid-19, Pemerintah Daerah, Pol-PP, PERDA. ABSTRACT In connection with the existence of the Civil Service Police Unit in law enforcement as a local government apparatus, the contribution of the Civil Service Police unit is very much needed to support the successful implementation of Regional Autonomy in the enforcement of regional regulations to create good governance. The problems in this study 1. What is the limit of the authority for law enforcement by the Civil Service Police? 2. What are the obstacles faced by the Civil Service Police in Enforcement of the Covid-19 Health Protocol? The methodology of collecting data is through library research. The results of the study show that the limit of authority for law enforcement by the Civil Service Police in dealing with the Covid-19 Pandemic is by providing various kinds of better health services, always keeping a distance when traveling and also always wearing masks. What are the obstacles faced by the Civil Service Police in Enforcement of the Covid-19 Health Protocol, among which the inhibiting factors come from: Internal factors, namely: lack of personnel, there is a shortage of facilities and infrastructure, there is a quality of education, work facilities and external factors, namely, weak law enforcement. The conclusion under the process of withdrawing two-wheeled vehicles that are in arrears or not paying installments is that the Leasing Party is prohibited from forcibly pulling motorized vehicles on the road. In conclusion, the limit of authority for law enforcement by the Civil Service Police in dealing with the Covid-19 Pandemic is to provide various kinds of better health services, always maintain a distance when traveling and also always use masks. The obstacles in the enforcement of the Covid-19 Health Protocol are, among others, from: Internal factors, namely: shortage of personnel, there is a shortage of facilities and infrastructure, there is a quality education, work facilities and external factors, namely, weak law enforcement. Suggestions should be that the role of the Regional Government in dealing with the Covid-19 Pandemic in the Banyuasin Region should be more focused. It is hoped that the Regional Government can add more personnel and also add facilities and infrastructure, auxiliary staff and also the budget which in this case can support the implementation of the tasks and functions of the Satpol PP to enforce Regional Regulations and Regional Head Regulations.

Abstract

Pengadilan tidak berwenang memeriksa kembali perkara yang sudah di jatuhkan putusan arbirtasenya kecuali apabila ada perbuatan melawan hukum terkait dengan pengambilan keputusan arbitrase dengan itikad baik, dan apabila putusan arbitrase itu melanggar ketertiban umum. Kelebihannya, kerahasiaan sengketa para pihak terjamin, dapat dihindari kelambatan yang diakibatkan karena hal prosedural dan administrasf dan kelemahannya, putusan arbitrase sangat tergantung kepada kemanpuan teknis arbiter untuk memberikan putusan yang memuaskan kepada kedua belah pihak. Karena walaupun arbiter adalah seorang ahli, namun belum tentu dapat memuaskan para pihak. Kata Kunci : Arbitrase penyelesaian di luar pengadilan, kerahasiaan sengketa para pihak terjamin. Abstract

This research discusses the perspective of Islamic economic law on business ethics in relation to human life. Islamic economic law, which is based on Sharia principles, offers ethical and moral guidelines in conducting business activities. Business ethics in Islam not only aim to achieve material profit but also consider aspects of justice, balance, and sustainability in social life. This research explores how the application of Islamic ethical values in business can create harmony between the interests of individuals, society, and the environment. With a literature-based qualitative approach, this article highlights the importance of integrating Islamic economic principles and modern business practices to support human well-being comprehensively. The results show that the application of Islamic business ethics can be a solution in facing global economic challenges, such as social inequality and moral crises, as well as promoting sustainable development.

Abstract

Every work that is born from brilliant ideas useful for humans needs to be recognized and protected by the Indonesian government. For this reason, the Intellectual Property Rightssystem is needed as a form of appreciation for the work. In addition, the Intellectual Property Rights system supports the establishment of a good documentation system for all forms of human creativity, so that the possibility of producing the same technology and works can be avoided or prevented. The existence of legislation that regulates the Intellectual Property Rights, the community can work optimally for the necessities of life or develop it further to provide even higher added value.

Abstract

The court is not authorized to re-examine a case where the award of arbitration has been passed unless there is an unlawful act related to making an arbitration decision in good faith, and if the arbitral award violates public order. The advantage is that the confidentiality of disputes between the parties is guaranteed, delays can be avoided due to procedural and administrative matters and weaknesses, the arbitration award is very dependent on the technical ability of the arbitrator to provide satisfactory decisions to both parties. Because even though the arbitrator is an expert, it may not necessarily satisfy the parties.
