Abstract

The article aims to reveal the complexities of mixed marriages between local people and mining workers (immigrants). The research method is a qualitative descriptive study that describes the impact of mixed marriages in mining areas in Southeast Sulawesi. The paper shows that mixed marriages are carried out in series without going through the applicable legal procedures. Mixed marriages are based on several aspects behind the legitimacy of providing a way for men (immigrants) as long as they can fulfil the traditional elements, pay for the customs, and are Muslim. Then mixed marriages took place, and it was their (women's) habit who see that immigrant workers could provide welfare. However, mixed marriage indirectly in civil terms means their marriage cannot be recognized and legalized.

Abstract

The study aims to measure this dilemma through the theories of natural law, utilitarianism, and positivism. It employs a qualitative approach using library research and normative juridical analysis. Despite their role in enhancing transactional efficiency, standard clauses often obscure critical rights and responsibilities, particularly for consumers who lack the bargaining power or legal literacy to fully comprehend or negotiate contract terms. This condition is increasingly urgent in the context of digital transactions on e-commerce platforms, etc where standard clauses are not only more prevalent but also more opaque. Existing scholarship has yet to explore how consumer legal literacy—or the lack thereof—affects the understanding, acceptance, and contestation of standard clauses in the digital marketplace. This study fills that gap by integrating legal theory with a critical analysis of consumer awareness, offering a novel perspective on the intersection between legal formalism and substantive justice in contemporary consumer contracting. The results indicate that standard clauses are deemed unjust based on natural law theory due to their formulation often violating universal moral principles, which demand mutual agreement and fairness for all parties. According to utilitarian theory, standard clauses are beneficial if they serve all parties; however, since they mainly benefit business actors, the usefulness is limited and creates imbalance. Meanwhile, positivist theory considers standard clauses legally valid as long as they adhere to the pacta sunt servanda principle—once written and agreed upon, the contract is binding law for the parties. Although standard clauses promote business efficiency, the imbalance in bargaining power may disadvantage consumers, who must therefore critically assess their ability to accept or reject the contract.

Abstract

Tujuan penelitian ini yaitu untuk mengetahui bentuk pemberdayaan ekonomi masyarakat, faktor  pendukung dan penghambat pemberdayaan ekonomi masyarakat melalui Bank Sampah Al-Faidzi di Kota Kendari, dan dampak positif dan negatif Bank Sampah terhadap ekonomi masyarakat di Kelurahan Puawatu, Kecamatan Puawatu, Kota Kendari. Penelitian ini adalah penelitian kualitatif, untuk mengumpulkan data menggunnakan metode observasi, wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa bentuk-bentuk pemberdayaan masyarakat yang dilakukan oleh Bank Sampah Al-Faidzi di Kota Kendari diantaranya memberikan pelatihan pada masyarakat dengan tujuan meningkatkan skill masayarkat dan membantu masyarakat mendapatkan penghasilan baru dari hasil pengolahan sampah. Faktor pendukung dari pemberdayaan ekonomi masyarakat melalui Bank Sampah mendapat respon positif dari masyarakat, pengadaian, pemerintah daerah dan pihak lain dengan memberikan bantuan seperti gerobok motor, karung, dan mesin jahit. Faktor penghambat dari pemberdayaan ekonomi masyarakat yaitu kesibukan dan jarak yang ditempuh oleh masyarakat ke Bank sampah yang dinilai jauh. Keberadaan Sampah Al-Faidzi di Kota Kendari telah memberikan dampak positif pada masayarakat seperti pekerjaan sampingan yang memberikan penghasilan tambahan, dan untuk dampak negatif belum ditemukan.

Abstract

Pinjaman secara online sangat populer dikalangan masyarakat, namun pada kenyataannya masih sering terjadi penyalahgunaan data pribadi yang dilakukan oleh pihak pinjaman online. Ketika peminjam menunggak pembayaran, maka pihak pinjaman online akan menghubungi sejumlah nomor kontak yang ada di ponsel peminjam, lalu mereka meneror dan memberi tahu perihal pinjaman yang ditunggak tersebut. Dalam hal ini, pihak pinjaman online menjadikan seseorang sebagai emergency contact (kontak darurat) secara sepihak tanpa persetujuan dari pemilik nomor telepon tersebut. Tujuan dari penelitian ini untuk mengetahui bagaimana bentuk perlindungan hukum terhadap data pribadi pihak ketiga yang disalahgunakan akibat dari pinjaman online, dan untuk mengetahui bentuk sanksi yang diberikan kepada pihak pinjaman online yang menyalahgunakan data pribadi pihak ketiga. Penelitian ini menggunakan jenis penelitian hukum normatif, dengan menggunakan pendekatan pendekatan perundang-undangan. Hasil penelitian ini menyimpulkan bahwa bentuk perlindungan hukum terhadap kasus penyalahgunaan data pribadi pada khususnya dijadikannya kerabat nasabah sebagai emergency contact (kontak darurat), yaitu perlindungan hukum multi dimensi yang meliputi perlindungan hukum secara administratif, perlindungan hukum secara perdata dan perlindungan hukum secara pidana. Sedangkan bentuk sanksi yang diberikan kepada pihak pinjaman online yang menyalahgunakan data pribadi yaitu Sanksi administratif berupa peringatan tertulis, denda yaitu kewajiban untuk membayar sejumlah uang tertentu, pembatasan kegiatan usaha, dan pencabutan izin, Sanksi perdata berupa pihak pinjaman online wajib membayar ganti rugi kepada pihak korban, dan sanksi pidana berupa penjara paling lama 4 (empat) sampai 7 (tujuh) tahun atau denda paling banyak Rp700.000.000,00 (tujuh ratus juta rupiah) sampai Rp750.000.000,00 (tujuh ratus lima puluh juta rupiah).Kata Kunci: Pinjaman Online, Penyalahgunaan Data Pribadi, Pihak Ketiga, Sanksi.

Abstract

This study discusses the application of the principle of exceptio non adimpleti contractus in kiosk sale and purchase contracts at Baruga Market in Kendari. Exceptio non adimpleti contractus is used as a legal defense to delay or refuse the performance of obligations until the other party to the contract fulfills their obligations. Previous studies have extensively discussed this principle normatively in general contracts, but empirical studies are still limited in cases of kiosk sales and their relationship with maqasid sharia as a form of property protection in muamalah practices in traditional markets. The purpose of this study is to analyze how this principle is applied in kiosk sale and purchase contracts and to examine its compatibility with the principle of maqasid syariah, particularly hifz al-mal (protection of property). The method used was empirical legal research, where primary data was obtained from interviews and agreement documents, while secondary data was obtained from relevant literature. The results of the study show that the contract stipulated a kiosk price of IDR 80,000,000. The payment obligation has been partially fulfilled, with the buyer paying the first installment of IDR 40,000,000 but failing to pay the second installment of IDR 40,000,000. In the agreement, Article 10 stipulates that if one party violates the agreement, it shall automatically become void. The seller then used the principle of exceptio non adimpleti contractus to refuse to hand over the kiosk because his rights had not been fulfilled. From the perspective of maqasid syariah, this principle reflects the principle of hifz al-mal, which is to protect the assets of both parties by withholding the performance of obligations until the other party's obligations are fulfilled. This finding contributes to the debate on Sharia contract law by providing empirical evidence of the application of this principle in the context of traditional markets. This study recommends that contracting parties pay more attention to exception clauses and develop clear mechanisms for default
