Abstract

Children have rights guaranteed and protected by law so that the growth and development of children must be protected by every element of the country. The purpose of this study is to identify and explain the factors that cause violence against children in the family, to know and explain the forms of local wisdom contained in the Batak Toba tribe community to prevent violence against children in the family, to know and explain constraints and obstacles that arise in empowering local wisdom in the Batak Toba tribe. This research is a normative legal research and supported by empirical research. The data used in this research is secondary data. Factors causing violence against children in the family are poverty, parental education which is still lacking in terms of and patterns of child care, socio-cultural and technological advances and information and the environment. The forms of local wisdom of the Toba Batak community in preventing violence against children are pauli uhum (correcting mistakes) and manopoti sala (correcting violations). The obstacles and obstacles in empowering Batak Toba's local wisdom in preventing violence against children in the household are the concern of lawmakers and law enforcers, legal pluralism in Indonesia, the low level of socialization carried out by village and kelurahan officials.

Abstract

Anak sebagai generasi penerus diharapkan menjadi tumpuan bangsa di masa yang akan mendatang. Oleh karena itu sudah menjadi kewajiban untuk memenuhi hak dasar anak bagi seluruh elemen bangsa. Akan tetapi di masa pandemi sekarang ini, Peraturan Walikota Medan Nomor 11 Tahun 2020 tentang Karantina Kesehatan Dalam Rangka Percepatan Penanganan Corona Virus Disease 2019 (Covid-19) Di Kota Medan, masihlah belum mengakomodir pemenuhan hak dasar anak. Penelitian ini bertujuan untuk mengetahui perlindungan hak dasar anak pada masa pandemic covid 19 di kota medan. Penelitian ini merupakan penelitian normatif, yaitu penelitian yang membahas aspek hukum dengan melakukan penelusuran bahan kepustakaan (library research) yang berorientasi kepada peraturan perundang-undangan yang berlaku.Pemerintah Kota Medan Beserta Dewan Perwakilan Rakyat Daerah Kota Medan haruslah segera menerbitkan produk hukum daerah setingkat Peraturan Daerah (Perda) untuk menjamin perlindungan dan pemenuhan hak-hak dasar anak di masa pandemi Covid-19.

Abstract

The large number of cases of suspected election crimes at every stage of the elections in Indonesia are not balanced with a fair law enforcement design and legal certainty. The establishment of the Integrated General Election Law Enforcement Center (Sentra Gakkumdu Pemilu) apparently did not have a significant impact in effectively prosecuting perpetrators of election crimes. This research aims to examine the design of law enforcement for election crimes and analyze the application of the concept of restorative justice as an approach to law enforcement for election crimes. The results of the research, firstly, are that the complexity of the law enforcement mechanism for election crimes causes the number of reports of election crimes submitted by the public to election supervisors to be meaningless. Second, that the current law enforcement design for election crimes still prioritizes punishment, even though law enforcement prioritizes the principle of ultimum remedium in its implementation. The absence of legal loopholes in prioritizing the concept of restorative justice in enforcing election criminal law is an obstacle for the Gakkumdu Center in enforcing election criminal law. The large number of cases of suspected election crimes that occur while the resolution time is relatively short makes it difficult for law enforcement to promote election crimes to promote justice and legal certainty. So there is a need to design technical regulations in implementing restorative justice in handling election crimes in the future.
