Abstract

"Demi Kita" is the first edu-web platform or portal in Indonesia that focuses on empowering and strengthening the capacity of prospective couples and families to have the spirit of continuous learning. This research aims to conduct an in-depth study related to the concept of the "Demi Kita" program as an effort to strengthen family institutions. After that, the description related to the "Demi Kita" program is reviewed using a normative or legal approach. The type of research used in this study is Normative Legal Research with a legal approach (based on norm research). The data collection techniques used in this study are interviews and documentation. In addition, the researcher used literature studies. The data analysis used in this study is a qualitative descriptive analysis. The results of this study inform that “Demi Kita” is the first edu-web platform or portal in Indonesia that focuses on empowering and strengthening the capacity of prospective couples and families to have the spirit of continuous learning. The use of the latest technology is used to increase the effectiveness of the program in supporting family education. The goals and programs of “Demi Kita” are in accordance with the purpose of marriage, which is to form a happy and eternal family. As according to the marriage law and several legal scholars related to the meaning of marriage. In addition, marriage law in Indonesia, along with related regulations, provides a strong basis to support programs for our sake. Namely lifelong education for families, increasing family capacity, establishing partnerships in family planning programs, and improving the skills of extension workers and field officers.

Abstract

Thrifting is growing in Indonesia in in recent years. Thrifting is often seen as a solution to reduce waste, especially textile waste. Thrifting that is mostly done in Indonesia is thrifting which is done by importing used clothes. Meanwhile, UMKM textiles in Indonesia are declining. The method in this study uses qualitative research. A method that describes in depth about thrifting from various literatures. Then analyzed using the priority fiqh approach (fiqh al-aulawiyyat) reformulated by Jasser Auda. examine in depth the factors and their impact. Both everything that creates damage personally and damage in general. This is to serve as a guide to determine the level of urgency of thrifting for the public. The conclusion of this study is that thrifting is shopping for used goods with the aim of getting cheaper prices for both local and imported goods. Thrifting which is mostly done by the people of Indonesia today is on imported goods. Thus, thrifting activities have a position that does not have to be prioritized. On the contrary, if thrifting is carried out on local goods or products, then thrifting has a position that must be prioritized.

Abstract

Government Employees with Employment Agreements (PPPK) are required to comply with regulations relating to employment and are required to have good behavior such as being loyal and obedient to the stateIn siyasa fiqh it is referred to as tabi'in (followers). Where tabi'in are required to obey and obey the orders and rules made by ulil amri (Leader). The purpose of this study is to find out the application of government employee discipline with work agreements (PPPK) according to PP no. 49 of 2018 concerning Management of Government Employees with Work Agreements (PPPK). Knowing the Application of Discipline for Government Employees with Employment Agreements (PPPK) According to Fiqh Siyasah. The results of the study show that the application of disciplinary regulations for Government Employees with Employment Agreements (PPPK) is confirmed in Government Regulation No. 49 of 2018 article 51 and article 52 but in these articles, it is explained that the imposition of disciplinary sanctions is carried out by government agencies that have the authority to impose sanctions on employees. In adhering to the Siyasah Fiqh principles in the application of employee discipline, employees must have the principles of sovereignty, the principles of justice, the principles of deliberation and Ijma', the principles of equality, the principles of the obligations of the state and the people and the principle of amar ma'ruf nahi munkar. Keywords: Work Discipline; PPPK; Fiqh Siyasah Abstrak Pegawai Pemerintah Dengan Perjanjian Kerja (PPPK) wajib mematuhi peraturan-peraturan yang berkaitan dengan kepegawaian dan wajib berkelakuan baik seperti setia dan taat kepada negara. Dalam fiqh siyasah disebut sebagai tabi’in (pengikut). Dimana tabi’in diwajibkan untuk patuh dan taat terhadap perintah dan aturan yang dibuat oleh ulil amri (Pemimpin). Tujuan dari penelitian ini adalah Untuk Mengetahui Penerapan Disiplin Pegawai Pemerintah Dengan Perjanjian Kerja (PPPK) Menurut PP No. 49 Tahun 2018 tentang Manajemen Pegawai Pemerintah dengan Perjanjian Kerja (PPPK). Mengetahui Penerapan Disiplin Pegawai Pemerintah Dengan Perjanjian Kerja (PPPK) Menurut Fiqih Siyasah. Hasil penelitian menunjukkan bahwa Penerapan peraturan disiplin bagi Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) ditegaskan pada Peraturan Pemerintah No. 49 Tahun 2018 pasal 51 maupun pasal 52 namun didalam pasal tersebut dijelaskan bahwa pemberian sanksi disiplin dilakukan oleh instansi pemerintah yang memiliki kewenangan untuk memberikan sanksi kepada Pegawai Pemerintah. Dalam menegakan prinsip Fiqih Siyasah pada penerapan disiplin pegawai harus memiliki prinsip kedaulatan, prinsip keadilan, prinsip musyawarah dan Ijma’, prinsip persamaan, prinsip hak kewajiban negara dan rakyat serta prinsip amar ma’ruf nahi munkar. Abstract

The Human Development Index (HDI) in Indonesia, especially in the field of education, has shown significant development over the past 10 years. HDI in education is measured through indicators such as average years of schooling, expected years of schooling, and literacy rate. The purpose of this research is to review Ma'had Al-Zaytun in Improving Human Development Index Based on Indramayu Regency Regional Regulation Number 8 of 2015 and Siyasah Dusturiyah. The author uses a library research method with a legal research approach conducted in a normative juridical manner. The data sources used are primary data sources, namely Indramayu Regency Regional Regulation Number 8 of Indramayu Regency Regional Regulation Number 8 of 2015, the book of Legal Science in the knot of Siyasah Dusturiyah Reflections on the theory and practice of Constitutional Law in Indonesia by Ali Akbar Abaib Mas Rabbani Lubis, M..H, and the book Al-Zaytun Source of Inspiration by Drs. Ch. Robin Simanullang, and secondary data sources, namely, books, journals, documents, and so on. The result of this research is Ma'had Al-Zaytun Review in Human Development Index Improvement Based on Indramayu Regency Regional Regulation Number 8 Year 2015 By paying attention to health needs, economic welfare, and religious values, Al-Zaytun supports the formation of strong, disciplined, and responsible characters in students. The commitment to a decent standard of living, health, and the integration of religious education ensures that students not only acquire academic knowledge, but also moral and social capabilities that are useful for personal life and positive contributions to the wider community and Ma'had Al-Zaytu Review in improving Human development Index based on Siyasah Dusturiyah plays an important role in improving the Human Development Index (HDI) in its region by meeting basic needs and empowering its community. Through the synergy between education, health, and economy, Al-Zaytun makes a real contribution to sustainable welfare, proving its dedication in creating a prosperous society. Abstract

Food is a basic need and a human right essential for national stability. Rice, as the primary source, plays a strategic role in Indonesia's food security. Rice production declined in 2021 due to land degradation, climate change, and pest attacks, particularly the rice field rat, which is the most destructive pest. This study evaluates ecologically based rat pest control in accordance with Law No. 32 of 2024 and the principles of maqashid sharia at Ma'had Al-Zaytun, which implements sustainable agriculture, to provide effective recommendations for increasing rice productivity and preserving the ecosystem. The purpose of this study is to examine rat pest control in rice fields at Ma'had Al-Zaytun from the perspective of Law No. 32 of 2024 and Maqashid Sharia. This research uses a normative legal approach or literature study. The data used include primary sources: Law No. 32 of 2024, the book "Bioecology and Control of Rice Field Rats" by Sudarmaji, the book "Hifdh Al-Bi’ah as part of Maqasid Al-Shari’ah: Yusuf Al-Qardawy’s perspective on the environment in Ri’ayat al-Bi’ah fi Shari’ah al-Islam book" by Ahmad Sarip Saputra, et al., the book "Panorama Maqashid Syariah" by Dr. Sutisna et al., and the book "Al-Zaytun Sumber Inspirasi" by Drs. Ch. Robin Simanullang, as well as Al-Zaytun Magazine, edition 49, 2008, and the book "Mengenal Aneka Komoditas Tanaman Pertanian di Ma'had Al-Zaytun" by Sobirin, S.P., M.Pd., et al., and strengthened by secondary data, namely journals, books, and related articles. Data were collected through finding, organizing, and editing techniques, then analyzed using content analysis methods. To ensure data validity, triangulation, member checking, and expert opinion were used. The results of this study are: (1) Control of rat pests in rice plants at Ma'had Al-Zaytun from the perspective of Article 4 of Law Number 32 of 2024 is through a strategy of conserving biological resources and ecosystems for controlling rat pests. This practice not only reflects institutional ecological awareness, but also demonstrates a model of sustainable agricultural practices that integrate biological conservation principles with the national legal framework. (2) Control of rat pests in rice plants at Ma'had Al-Zaytun from the perspective of Maqashid Syariah is by implementing hifdz al-nafs, namely protecting humans from health risks, and hifdz al-bi'ah, namely preserving the environment through a non-chemical approach. In other words, this practice is a concrete form of actualizing Islamic teachings in a sustainable agricultural system

Abstract

This research is motivated by changes in the national education system and global challenges that have forced Islamic educational institutions, particularly the Al-Zaytun Elementary Madrasah, to update their curriculum without losing their religious focus. As part of a pesantren-based educational institution, the Al-Zaytun Elementary Madrasah has been in the spotlight for integrating the national curriculum with Islamic values within a unique environment, namely a boarding school-based Islamic boarding school. This study describes a qualitative approach with a case study research type. The data collection method uses interview methods, and documentation. The technique is by examining data, classification, and conclusions. The data analysis model used is a qualitative descriptive method using an inductive thinking process. While the data validity test used in this study is a credibility test with the triangulation method. The results of this study indicate that the Implementation of Curriculum Development at Al-Zaytun Elementary Madrasah in the Review of Fiqh Siyasah Dusturiyah is the Islamic state administration Fiqh rules used in this thesis as an analytical framework to assess the extent to which state education policies are in line with Islamic principles in governance and public policy management. In this context, the curriculum is not only seen as an educational instrument, but also as a concrete form of policy implementation that has an impact on the formation of character and thinking of future generations. A review of Law Number 18 of 2019 on the Implementation of Curriculum Development at Al-Zaytun Elementary Madrasah shows that the implementation of the Independent Curriculum as a development of the 2013 Curriculum through the Decree of the Minister of Religious Affairs of the Republic of Indonesia No. 450 of 2024 concerning Guidelines for the Implementation of the Independent Curriculum, has been successfully integrated well. This policy not only complies with applicable legal provisions, but also ensures that the curriculum at Madrasah Ibtidaiyah Al-Zaytun remains relevant to current developments while maintaining Islamic values.

Abstract

Undang-Undang tentang Pemberantasan Tindak Pidana Korupsi hanya diatur tentang korupsi material dan keuangan. Pasal 2 UU No. 31 Tahun 1999 yang disempurnakan dengan Undang-Undang No. 20 Tahun 2001 terhadap pelaku tindak pidana korupsi bagi penyelenggara negara dalam perspektif hukum Islam dilaksanakan karena sesuai dan sejalan dengan maqasid al-tasyri’ dalam artian tetap mempertimbangkan kepentingan umum yang berorientasi pada kemaslahatan dan menolak segala kemungkaran. Oleh karena itu, yang menjadi pokok masalah dalam penelitian ini adalah sanksi hukum terhadap pelaku tindak pidana korupsi menurut hukum positif di Indonesia dalam perspektif hukum pidana Islam dan HAM. Teori hukum pidana Islam yaitu mengenai pembagian dan operasionalisasi jinayah atau jarimah serta penerapan sanksi-sanksinya. Bertujuan untuk mengetahui pidana tambahan berupa pencabutan hak untuk memilih dan dipilih dalam jabatan publik jika ditinjau dari perspektif hukum pidana dan untuk mengetahui kesesuaian antara putusan hakim Mahkamah Agung Nomor 537K/Pid.Sus/2014 dengan prinsip-prinsip hak asasi manusia.

Abstract

Indonesia is a pluralistic country with diverse religions, races, ethnicities, and customs, making freedom of expression an essential right protected by law. Article 28E of the 1945 Constitution guarantees every citizen the right to freely express their beliefs and opinions. From the perspective of fiqh Siyasah Dusturiyah (Islamic constitutional politics), freedom of expression is a right that must be safeguarded by the state as long as it aligns with the principles of deliberation and does not contradict Islamic law. This study aims to examine the freedom of expression of Syaykh Al-Zaytun in light of Siyasah Dusturiyah and Article 28E of the 1945 Constitution. The research uses a normative juridical approach with primary data sources including the Constitution and the book Ilmu Hukum dalam Simpul Siyasah Dusturiyah by Ali Akhbar Abaib Mas Rabbani Lubis, as well as secondary sources such as books, journals, documents, and legal regulations. The findings indicate that Syaykh Al-Zaytun’s freedom of expression is permissible under both perspectives, provided certain conditions are met: it must comply with Islamic law and national law, uphold public interest, cause no harm, and be accompanied by social responsibility. Syaykh Panji Gumilang’s views should be understood as part of public discourse, not hate speech, as they aim to foster nationalism and the common good.
