Abstract

This article examines the collective inheritance distribution system in the Semende migrant community. This article focuses on two aspects: how the inheritance distribution system works in the Semende migrant community in the Kaur Regency and to what extent this inheritance distribution model creates harmony among family members. The data were obtained from academic works and interviews with community leaders in the field. This article concludes that the inheritance distribution in the Semende migrant community in Bengkulu uses a system called “tunggu tubang,” where the eldest daughter (tunggu tubang) keeps and manages the inherited wealth. Inheritance distribution always emphasizes consensus through deliberation. The inheritance distribution in the Semende tribe with the tunggu tubang system has proven to achieve harmony in both the legal system and among families. The research findings show a concept of al-ma'rūf in the inheritance distribution in the Semende migrant community. The idea of al-ma'rūf in the inheritance customs of Semende migrants reflects values respected and firmly held by the community. This concept forms the basis for maintaining harmony, preserving cultural identity, and regulating the inheritance process based on mutual agreement. Artikel ini mengkaji sistem pembagian warisan kolektif pada komunitas Semende migran yang dikelola secara kolektif dan produktif. Kajian dalam artikel ini difokuskan pada dua hal, yakni bagaimana sistem pembagian harta warisan di komunitas Semende migran yang ada di Kabupaten Kaur Provinsi Bengkulu, dan sejauhmana model pembagian warisan tersebut dapat mewujudkan keharmonisan hukum dan keharmonisan di antara anggota keluarga. Data-data dalam artikel ini diperoleh dari literatur ilmiah dan wawancara dengan tokoh masyarakat di komunitas Semende. Menggunakan metode penelitian kualitatif dengan perspektif harmoni hukum, artikel ini menyimpulkan bahwa pembagian harta warisan pada masyarakat Semende migran di Bengkulu menggunakan sistem yang disebut tunggu tubang, di mana harta warisan disimpan dan dikelola oleh anak perempuan tertua (tunggu tubang). Pembagian harta warisan selalu mengedepankan musyawarah mufakat. Pembagian harta warisan yang ada di suku semende dengan sistem tunggu tubang terbukti dapat mewujudkan keharmonisan baik pada sistem hukum maupun keharmonisan di antara keluarga. Temuan penelitian ini menunjukkan bahwa terdapat bangunan konsep al-ma'rūf dalam pembagian warisan pada komunitas Semende migran. Konsep al-ma’rūf dalam kewarisan adat Semende migran ini mencerminkan nilai-nilai yang dihormati dan dipegang teguh oleh masyarakat. Konsep ini membentuk dasar untuk menjaga keharmonisan, memelihara identitas budaya, serta mengatur proses kewarisan dengan prinsip kesepakatan bersama.

Abstract

Qibla direction is a valid requirement in performing prayer. But then the understanding of Qibla direction becomes divided into two, the perspective of science and fiqh. These two opinions are then dialectic on ancient mosques in Lombok, where the Qibla direction is only based on the guidance/jihad of the wali/ulama. Methodology used in this research is qualitative research with the type of field research and socio-historical approach. The results of this study showed that the dialectic of Qibla direction on ancient mosques in Lombok can still be maintained and is still considered valid. This argument uses the fiqh argument that the Qibla direction is jihadul ka'bah. But certainly the fiqh perspective of jihadul ka'bah is no longer relevant if it is associated with measuring the Qibla direction in the construction of modern mosques.

Abstract

The term staycation as a connotation of sexual activity in a certain place has become increasingly popular in society, especially after the phenomenon of a viral case in the public. Bosses invited female workers in the company to engage in sexual activities in exchange for certain promises. Female workers are often vulnerable to sexual exploitation in the workplace. This requires legal protection to reduce risks and protect the rights of female workers. This article uses a normative juridical research method with a statutory approach based on various provisions in the TPKS Law and several relevant literatures to analyze aspects of legal protection for female workers. This study finds that the TPKS Law provides an important legal basis to protect women workers from sexual exploitation, including the provision of victims' rights to restitution, handling, recovery, and protection through the Witness and Victim Protection Agency (LPSK). This protection is important to prevent backlash from perpetrators and provide a sense of security to victims. Towards effective implementation of legal protection, socialization and education are needed in an effort to increase legal awareness in the community and reduce the incidence of sexual exploitation in the work environment.

Abstract

Economic hardship remains an unresolved issue in Indonesia. Data from Statistics Indonesia (BPS) shows that 8.57% of the population still earns below IDR 609,160 per month, meaning approximately 24 million people live below the poverty line. The Governor of West Java plans to implement a policy requiring vasectomy as a condition for receiving social assistance, which has sparked controversy in society. This plan indirectly places poor families in a position where they feel compelled to undergo the procedure. They face hidden pressures that limit their freedom of choice, creating ethical tensions between religion, policy implementation, and basic livelihood needs. The study examined the responses of West Java society to objectively evaluate and engage in a comprehensive dialogue about the Governor’s policy plan, which includes vasectomy as a requirement for social assistance, through the lens of maqasid al-syari'ah (the objectives of Islamic law). Using empirical legal research with a mixed-methods approach, the study combined quantitative and qualitative data. Findings reveal that over 60% of respondents underwent vasectomy due to economic incentives or policy pressure rather than personal conviction. Qualitative data also indicate that although the fatwa is understood as a normative reference, in practice, people prioritize social and economic needs. The particular analysis confirms that the fatwa cannot be applied rigidly without considering the structural pressures and ethical dilemmas faced by the community. Through the framework of maqasid al-syari'ah, focusing on daruriyyat (essential needs), particularly hifz al-nafs (preservation of life), hifz al-nasl (preservation of lineage), and hifz al-mal (preservation of wealth), a reinterpretation of the fatwa becomes an ethical imperative.  Then, it ensures Islamic law remains contextual, just, and responsive to contemporary realities, especially when religious authority and state regulations intersect in governing the rights of vulnerable groups.
