Abstract

This article aims to provide knowledge and increase understanding to the public regarding the implementation and limitations of the principle of freedom of contract in making agreements in society to ensure balance and legal certainty. An agreement is an agreement by which one or more parties bind themselves to one or more people. The application of the principle of freedom of contract cannot be used freely. There are several restrictions imposed by legislative regulators. Because if there are no restrictions, it will result in arbitrariness in making the contents of the agreement which can harm the interests of the parties involved in the agreement, so that the concept of social justice for all parties, which is one of the goals of freedom of contract, will not be realized. The method used in this community service process is by conducting outreach and outreach with the community through focus group discussions. Implementing and limiting the principle of freedom of contract is a crucial step in maintaining balance and legal certainty in society. Although this principle provides flexibility to parties involved in an agreement, there is an important need to ensure that individual rights and societal interests are protected without compromising contractual flexibility. A wise balance must be found. Legal certainty in the agreement must be prioritized. Adequate regulation should ensure that the weaker party to an agreement is protected from harmful practices.

Abstract

This article examines the role of local wisdom in the protection and enforcement of Human Rights (HR) in Indonesia, focusing on how local customs, cultural values, and customary laws contribute to a more holistic approach to HR. The study aims to explore how local wisdom can enhance HR protection and address challenges in aligning traditional values with universal HR principles. Employing a qualitative research design, this study utilizes a case study approach across multiple regions in Indonesia, analyzing specific instances where local wisdom has been integrated into HR practices. The findings reveal that local wisdom, including community-based conflict resolution mechanisms, traditional justice systems, and cultural norms, significantly contributes to HR enforcement by ensuring the inclusion of indigenous perspectives in legal frameworks. However, challenges arise in harmonizing local practices with national and international HR standards, particularly when local values conflict with universal rights. The research highlights that a participatory approach, which incorporates both local and global HR principles, is essential in crafting an inclusive legal system. The theoretical implication of this study suggests that integrating local wisdom into HR frameworks could lead to a more contextualized and culturally sensitive approach to HR, thereby fostering greater social cohesion and respect for diversity while safeguarding fundamental human rights. This integration requires cooperation from multiple stakeholders to maintain a balance between honoring cultural traditions and upholding universal HR norms.

Abstract

This research investigates the role of the Buleleng Regency Industrial Trade and SME Cooperative Service in providing legal protection for the intellectual property rights (IPR) of MSME industry players in Buleleng Regency, and the obstacles faced in these efforts. Using empirical legal methods and non-probability sampling, the study involves the Department of Trade, Industry and Cooperatives, and MSME business actors. Data collection techniques include document study, observation, and interviews, with qualitative descriptive analysis. The findings reveal that the Department's role encompasses preventive measures like intensive outreach, IPR registration recommendations, technical guidance, and collective IPR registration facilitation, as well as repressive measures such as providing legal assistance during IPR violations. Obstacles include low awareness and understanding of IPR among MSME actors, the complexity of the registration process, limited competence of some employees, and an annual quota for IPR registration recommendations.

Abstract

Integrity and civic responsibility are two crucial elements in the life of a nation and state. Both are widely believed to be developed through processes of awareness and education. Accordingly, this study aims to identify the role of educational philosophy, as a framework for cultivating awareness, and civic education in strengthening students’ integrity and civic responsibility. This research employed a sequential explanatory mixed-methods design, involving 22 respondents consisting of students, teachers, and school principals. The study began with the collection of quantitative data using a five-point Likert-scale questionnaire to identify the perceptions of students, teachers, and school principals regarding the role of educational philosophy and civic education in strengthening students’ integrity and civic responsibility. The collected data were quantified and analyzed quantitatively by calculating percentages and mean scores. Subsequently, qualitative data were gathered through interviews to confirm and elaborate on the previously obtained quantitative findings. The interview data were analyzed qualitatively using an interactive analysis model. The findings indicate that, in general, students, teachers, and school principals hold positive perceptions of the role of educational philosophy and civic education in strengthening students’ integrity and civic responsibility. This is reflected in the mean scores obtained from the questionnaire results, which show positive responses from students (4.52), teachers (4.57), and school principals (4.95). Furthermore, the qualitative findings support and reinforce the quantitative results. Therefore, it can be concluded that educational philosophy and civic education play a significant role in strengthening students’ integrity and civic responsibility.
