Abstract

Investment or investment has a very important function regarding will improve the development of the state of the country's economy. This investment is an activity carried out by the business world in order to improve people's living standards. The purpose of this study is to determine how the forms of dispute resolution in domestic investment according to Law No. 25 of 2007 and how the obligations and responsibilities of investors. By using normative juridical research methods concluded: the form of domestic investment dispute resolution according to Article 32 of Law No. 25 of 2007 is through deliberation and consensus; arbitration, Alternative Dispute Resolution, courts, and especially between disputes between governments and foreign investment, disputes are resolved through international arbitration that has been agreed. According to Article 15 of Law Number 25 of 2007, the obligation of investors in Indonesia is to apply the principles of good corporate governance, carry out corporate social responsibility (corporate social responsibility)while the responsibility of investors is regulated in Article 16, namely: ensuring the availability of capital from sources that do not conflict with the provisions of laws and regulations; to bear and settle any liability for losses if the investor ceases or abandons or abandons business activities unilaterally in accordance with the provisions of applicable laws and regulations; to create a healthy competitive business and to prevent practices. Investment mediation is the right choice because mediation is the spirit of local Indonesian stakeholders in resolving disputes and currently the international community is applying it as evidenced by ICSID offering wide access to mediation with countries, State entities or REIOS related to investment.

Abstract

Conflict or dispute always exists in every human relationship in social interaction, common property is a thing that often triggers conflict in the family is known that not a few cases of conflict which resulted from the inheritance that goes to court. Disputes generally occur regarding rights and obligations that are classified in civil conflict issues can be resolved one of them by mediation both out of court and in court. Mediation in the settlement of civil cases can conducted at the beginning of litigation as well as during litigation against inheritance claims, joint property claims. Solution dispute specifically has the meaning that the dispute between husband and wife differences of opinion between the two parties due to property can also refer to disputes so that over this there is an imbalance ownership and need a good mediation process to equalize the position for both parties. This study aims to explain the legal power of mediation in court proceedings Religion Medan, the second to know the procedures for the division of inheritance and joint property according to compilation of Islamic law. Type of research used is empirical legal research with approach juridical sociological. The Data used is sourced from primary and secondary legal data analyzed qualitatively. The results of this study indicate that the legal power of mediation in the trial process in the Religious Court of Medan, namely with the deed of peace, the result of the peace agreement received legal certainty, the second division of common property according to the compilation of the law Islam is a husband or wife gets the same half because it is also seen based on taste fairness or good faith of one of the parties.

Abstract

The current view of society no longer sees that the court is the only dispute resolution institution. The existence of court institutions has been indicated by various cases of corruption, collusion, and nepotism, better known as KKN. This is given that many products of court decisions deviate from the principles of justice, are quick and inexpensive. In this context, an alternative dispute resolution model is needed in the customary law community that is more efficient, fair and accommodating in order to maintain the continuity and sustainability of the life of the customary law community, which is more humane and equitable. The tradition of dispute resolution in customary law communities is based on the value of the philosophy of togetherness (communal), sacrifice, supernatural values, and Justice. In customary law Community, common interest is a philosophy of life that permeates every member of the indigenous community. The practice of customary mediation in this paper in practice, the karo people of North Sumatra and papu is a form of local wisdom in resolving disputes or conflicts in Customary Law communities with a community mediation approach where in Community Mediation, leaders (customary leaders) have an important role and must have skills in resolving disputes using customary rules contained in Indigenous communities. The purpose of adat mediation practices in Indonesia is the existence of community adat mediation to maintain the balance and harmony of Indigenous Peoples by prioritizing deliberation rather than dispute resolution through legal channels.

Abstract

Introduction: In resolving ordinary maritime disputes related to national borders, from several types of dispute resolution, mediation is the right way to resolve disputes involving third parties.Purposes of the Research: This paper aims to find out that in resolving martim aurann disputes the law is contained in international law, namely UNCLOS 1982 which regulates martim disputes.Methods of the Research: The type of research is normative juridical with analysis using legal documents in the form of primary legal materials, secondary legal materials, and tertiary legal materials.Results of the Research: Alternative settlement of territorial boundary disputes can be done by, first, referring to UNCLOS 1982 through Bilateral Mutual Agreement in drawing a temporary line (equidistant line) using the equity principle and considering relevant factors and the possibility of modifying the equidistant line with the diplomatic approach of both countries, second, through the ASEAN mechanism, and. third, through the mechanism of the International Court of justice by promoting equitable principles and relevant circumstances.However, resolving with the second alternative is more appropriate because it can use mediation methods in maritime dispute resolution.

Abstract

Introduction: The enforceability of Article 16 and the Constitutional Court decision number 26/PUU-XI/2013 does not necessarily exempt advocates from alleged intervention in the enforcement process in carrying out their profession to defend clients, but that right can be lost said the lawyer committed a criminal act of Obstruction of Justice.Purposes of the Research: The purpose of this study is to explain the right of attorney immunity can be lost when committing a criminal act of Obstruction of Justice.Methods of the Research: The research method used is normative legal research with a statute legal approach and a conceptual approach.Results of the Research: Advocates in terms of exercising their profession require immunity rights, but the use of immunity rights has definitive conditions that must be considered as stipulated in Article 16 of law no. 18 of 2003. The act of an advocate should be suspected of committing a criminal act of obstruction of justice if the act is not related to his professional duties and is not based on good faith. The action taken by The Advocate in relation to his professional duties has the meaning that the action is carried out for the benefit of the client's defense. Good faith referred to in Article 16 is to carry out professional duties for the sake of establishing justice based on the law to defend the interests of its clients.

Abstract

Penelitian ini bertujuan untuk menganalisis implementasi Tanggung Jawab Sosial dan Lingkungan (TJSL) oleh perusahaan-perusahaan di Kota Bekasi berdasarkan Peraturan Daerah Nomor 6 Tahun 2015 dan Peraturan Daerah Nomor 12 Tahun 2019. Dalam konteks pembangunan berkelanjutan, TJSL menjadi instrumen strategis yang tidak hanya menuntut kontribusi perusahaan terhadap kesejahteraan masyarakat dan pelestarian lingkungan, tetapi juga mencerminkan sinergi antara sektor publik, swasta, dan masyarakat. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode analisis hukum normatif dan konseptual, serta mengkaji teori keadilan John Rawls, teori legitimasi, dan teori pemangku kepentingan sebagai landasan teoritis. Hasil penelitian menunjukkan bahwa meskipun terdapat dasar hukum yang kuat, implementasi TJSL di Kota Bekasi masih menghadapi berbagai kendala, termasuk lemahnya komitmen perusahaan, kurangnya koordinasi antar pemangku kepentingan, serta belum optimalnya mekanisme pengawasan dan pelaporan. Namun demikian, keberadaan regulasi lokal telah memberikan arah yang lebih jelas bagi perusahaan dalam menjalankan TJSL secara terstruktur dan bertanggung jawab. Penelitian ini merekomendasikan penguatan kelembagaan pengelola TJSL, peningkatan partisipasi masyarakat, serta pemberian insentif dan sanksi yang tegas guna meningkatkan efektivitas dan akuntabilitas pelaksanaan TJSL. Dengan implementasi TJSL yang optimal, diharapkan dapat tercapai keseimbangan antara pertumbuhan ekonomi dan keberlanjutan sosial-lingkungan di Kota Bekasi.

Abstract

This article analyzes the decision of the Denpasar District Court related to property rights disputes and the auction process of assets owned by PT. Primadaya Sakti. Through normative juridical approach and Case Studies, a study was conducted on mediation procedures, the enforceability of surety seizures, asset auction processes, and the legal implications of these decisions in the context of property rights protection and Procedural and Substantive justice principles. This study aims to provide a comprehensive overview of the application of criminal and civil procedural law in civil cases involving property assets and auction activities by state institutions.

Abstract

The Unitary State of Indonesia consists of diverse ethnic groups and customary laws, governed under a sovereign legal framework to ensure the proper enforcement of regulations. As stipulated in Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia (UUD 1945), “The State of Indonesia is a state based on law,” emphasizing that every individual who commits a criminal act must be held accountable according to applicable laws. However, various legal challenges continue to arise, especially amid rapid modernization and technological advancement, leading to new forms of criminal acts previously unknown, such as document forgery involving authentic deeds. An authentic deed is an official document prepared by or before a competent public official, serving as strong and binding evidence in legal proceedings as stated in Article 1870 of the Indonesian Civil Code (KUHPerdata). Given its probative value, authentic deeds hold a crucial role in legal certainty and public trust. Nevertheless, the increasing occurrence of forgery cases undermines the credibility of these documents and challenges the integrity of Indonesia’s legal system. Therefore, this study aims to analyze the legal implications and accountability mechanisms for the forgery of authentic deeds, emphasizing the need for stronger preventive regulations, stricter law enforcement, and enhanced oversight to uphold justice and protect the authenticity of legal instruments in Indonesia.

Abstract

The development of Information Technology has encouraged the emergence of various disputes in cyberspace (cyber disputes), which have different characteristics from conventional disputes. Cyber disputes require an efficient, fast, and effective resolution mechanism. Mediation as an Alternative Dispute Resolution (ADR) method is a relevant solution because it is flexible, private, and efficient. This paper aims to examine the urgency of the use of mediation in cyber dispute resolution as well as the challenges and opportunities of its application in Indonesia. By using normative-juridical methods and conceptual approaches, this paper outlines the potential of online mediation (Online Dispute Resolution) supported by Information Technology in providing equal justice and easy access for the parties

Abstract

Perkembangan Teknologi pada dasarnya mempengaruhi perkembangan perekonomian, tidak terkecuali di Indonesia, dimana teknologi membuat meningkatnya bisnis e-commerce, salah satunya dibidang perdagangan kosmetik, dimana banyak perusahaan e-commerce maupun pelaku usaha yang menggunakan sarana e-commerce sebagai media perdagangan dengan sistem elektronik, memperdagangkan kosmetik melalui e-commerce, namun tidak jarang pula dalam praktiknya, pada perdagangan kosmetik ditemukan kosmetik palsu yang diperdagangkan di e-commerce, sebagaimana contoh terjadi pada perkara Putusan No.323/Pid.Sus/2019/ PN.Jkt.Tim., namun penanganannya sendiri oleh pemerintah belum dilakukan secara serius, hal ini terbukti dalam penggunaan pasal dan istilah yang dipergunakan untuk mempidana para pelakunya, dimana dimana terdakwa Fano Tandyo terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana “Perlindungan Konsumen” yang diatur dan diancam pidana menurut Pasal 197 Jo Pasal 106 ayat (1) Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan, masalah penanganan kasus ini sendiri tergolong cukup unik, karena pada dasarnya Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan tidak mengatur mengenai masalah perlindungan konsumen, namun masalah kesehatan masyarakat yaitu pasien, dimana penggunaan istilah konsumen sendiri merupakan istilah yang umum dipakai bagi pengguna barang dan jasa, sedangkan pasien adalah istilah khusus yang digunakan bagi masyarakat pengguna barang dan jasa kesehatan, sehingga penanganan perkara ini terkesan tidak secara serius ditangani. Penelitian ini menggunakan penelitian yuridis normatif dengan data sekunder berupa bahan hukum primer, sekunder, dan tersier. Adapun hasil penelitian menunjukkan pertanggungjawaban pelaku tindak pidana yang menjual kosmetik tanpa izin edar melalui e-commerce berdasarkan Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan pada dasarnya diatur pada ketentuan 105 ayat 2, dan tidak memiliki pengaturan pemidanaan, namun karena adanya bahaya dari peredaran kosmetik kepada wanita khususnya penegakan hukum dapat dilakukan dengan menerapkan ketentuan Pasal 197 jo Pasal 106 ayat 1 Undang-Undang Kesehatan. Kemudian hasil penelitian menunjukkan tinjauan dan pertimbangan hakim dalam memeriksa perkara pelaku tindak pidana yang menjual kosmetik tanpa izin edar melalui e-commerce pada dasarnya hanya menggunakan ketentuan Pasal 197 jo Pasal 106 ayat 1 Undang-Undang Kesehatan dan terdapat kesalahan dengan menyebutkan bahwa tindak pidana tersebut adalah tindak pidana perlindungan konsumen, seharusnya bila memang hendak menerapkan tindak pidana terhadap konsumen, maka majelis hakim menerapkan ketentuan Pasal 62 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen.
