Abstract

Perkembangan Teknologi pada dasarnya mempengaruhi perkembangan perekonomian, tidak terkecuali di Indonesia, dimana teknologi membuat meningkatnya bisnis e-commerce, salah satunya dibidang perdagangan kosmetik, dimana banyak perusahaan e-commerce maupun pelaku usaha yang menggunakan sarana e-commerce sebagai media perdagangan dengan sistem elektronik, memperdagangkan kosmetik melalui e-commerce, namun tidak jarang pula dalam praktiknya, pada perdagangan kosmetik ditemukan kosmetik palsu yang diperdagangkan di e-commerce, sebagaimana contoh terjadi pada perkara Putusan No.323/Pid.Sus/2019/ PN.Jkt.Tim., namun penanganannya sendiri oleh pemerintah belum dilakukan secara serius, hal ini terbukti dalam penggunaan pasal dan istilah yang dipergunakan untuk mempidana para pelakunya, dimana dimana terdakwa Fano Tandyo terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana “Perlindungan Konsumen” yang diatur dan diancam pidana menurut Pasal 197 Jo Pasal 106 ayat (1) Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan, masalah penanganan kasus ini sendiri tergolong cukup unik, karena pada dasarnya Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan tidak mengatur mengenai masalah perlindungan konsumen, namun masalah kesehatan masyarakat yaitu pasien, dimana penggunaan istilah konsumen sendiri merupakan istilah yang umum dipakai bagi pengguna barang dan jasa, sedangkan pasien adalah istilah khusus yang digunakan bagi masyarakat pengguna barang dan jasa kesehatan, sehingga penanganan perkara ini terkesan tidak secara serius ditangani. Penelitian ini menggunakan penelitian yuridis normatif dengan data sekunder berupa bahan hukum primer, sekunder, dan tersier. Adapun hasil penelitian menunjukkan pertanggungjawaban pelaku tindak pidana yang menjual kosmetik tanpa izin edar melalui e-commerce berdasarkan Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan pada dasarnya diatur pada ketentuan 105 ayat 2, dan tidak memiliki pengaturan pemidanaan, namun karena adanya bahaya dari peredaran kosmetik kepada wanita khususnya penegakan hukum dapat dilakukan dengan menerapkan ketentuan Pasal 197 jo Pasal 106 ayat 1 Undang-Undang Kesehatan. Kemudian hasil penelitian menunjukkan tinjauan dan pertimbangan hakim dalam memeriksa perkara pelaku tindak pidana yang menjual kosmetik tanpa izin edar melalui e-commerce pada dasarnya hanya menggunakan ketentuan Pasal 197 jo Pasal 106 ayat 1 Undang-Undang Kesehatan dan terdapat kesalahan dengan menyebutkan bahwa tindak pidana tersebut adalah tindak pidana perlindungan konsumen, seharusnya bila memang hendak menerapkan tindak pidana terhadap konsumen, maka majelis hakim menerapkan ketentuan Pasal 62 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen.

Abstract

This study aims to examine the theory and practice of mediation in Enggano customary law community as a form of non-litigation dispute resolution mechanism rooted in local cultural values. The Enggano customary law community, which inhabits Enggano Island in Bengkulu province, has a unique social and legal system and is passed down through generations through oral traditions and communal practices. Adat mediation in Enggano is an integral part of the customary law system run by adat elders or community leaders who have moral authority in resolving various social issues, such as family conflicts, land disputes, to violations of customary norms. This study uses a normative legal approach with the support of qualitative data from literature studies and relevant anthropological documents, as well as analyzing how the adat mediation process takes place and what are its basic principles. In Enggano society, customary mediation prioritizes the value of deliberation, peace, and social rapprochement rather than formal condemnation. Thus, adat mediation is not only a dispute resolution tool, but also a mechanism for maintaining social cohesion and preserving local culture. However, in practice, Adat Enggano mediation is often faced with obstacles, especially when it comes to interacting with a more legalistic and formal national legal system. This study also explores the form of intersection between customary law and Indonesian national law, as well as how the two can complement each other in an effort to create a dispute resolution system that is contextual and responsive to the reality of Indigenous Peoples. The findings in this study indicate that, despite modernization and external pressures, adat mediation in Enggano still exists and has important value in the plural legal system in Indonesia.

Abstract

Mediation is a dispute resolution instrument that emphasizes peace and time efficiency in the judicial process. Based on the regulation of the Supreme Court of the Republic of Indonesia (PERMA) Number 1 of 2016 concerning mediation procedures in court, every civil case must first be resolved through mediation before the examination of the subject matter is carried out. In practice, however, there is still debate as to whether the mediation obligation can be applied at the level of appellate and Cassation remedies. This paper aims to analyze the position and application of mediation obligations in the advanced stages of legal efforts, using normative legal research methods. The results showed that formal mediation is only required at the first examination level, but the spirit of peace on which mediation is based can still be pursued voluntarily at the appeal and Cassation levels. It is necessary to reformulate the regulation so that the opportunities for peace at all stages of the judiciary remain effectively open.

Abstract

The development of Information Technology has encouraged the emergence of various disputes in cyberspace (cyber disputes), which have different characteristics from conventional disputes. Cyber disputes require an efficient, fast, and effective resolution mechanism. Mediation as an Alternative Dispute Resolution (ADR) method is a relevant solution because it is flexible, private, and efficient. This paper aims to examine the urgency of the use of mediation in cyber dispute resolution as well as the challenges and opportunities of its application in Indonesia. By using normative-juridical methods and conceptual approaches, this paper outlines the potential of online mediation (Online Dispute Resolution) supported by Information Technology in providing equal justice and easy access for the parties

Abstract

Embezzlement in office is a corruption modus operandi that threatens the country's financial stability through abuse of authority by state officials. Objective: This study analyzes the legal construction of embezzlement in office as a crime of corruption as well as the consideration of judges in the Supreme Court Decision No. 2182 K/Pid.Sus/2019. Method: normative juridical approach is used by reviewing legislation and court decisions through literature studies, as well as descriptive qualitative analysis of primary and secondary legal materials. Result: the verdict proved that the defendant's actions meet the elements of embezzlement in office and corruption in the presence of substantial state financial losses due to abuse of authority. The judge takes into account the aspect of causality between office and state losses, as well as applies proportionate sanctions taking into account aggravating and mitigating factors.

Abstract

This study aims to examine the theory and practice of mediation in the Karo customary law community and see its relevance to the Indonesian national legal system. Karo people are known to have a strong social structure based on kinship and Customs, where mediation is the main mechanism in dispute resolution that emphasizes the value of deliberation and social harmony. This research uses normative juridical method with qualitative approach, supported by literature study and analysis of customary practices that are still in progress in the community. The results showed that mediation of adat Karo not only serves as an instrument of conflict resolution, but also as a means of maintaining social cohesion and strengthening community values. The role of indigenous figures such as kalimbubu, anak beru, and senina is dominant in this process. In the context of national law, customary mediation practices are aligned with restorative justice principles and have the potential to be integrated into formal legal systems. Despite challenges, such as lack of formal recognition and potential conflicts of jurisdiction, adat Karo mediation remains relevant and has strategic value in strengthening local wisdom-based laws.

Abstract

This paper discusses the theory and practice of mediation in the indigenous peoples of Aceh, which is known to have a dispute resolution system based on deliberation and kinship. This study uses a qualitative approach to the method of literature study and observation of mediation practices in several villages in Aceh. It was found that customary mediation practices in Aceh not only promote conflict resolution, but also restore social relations. This local wisdom has historically grown out of the social structure of Acehnese society and has a meeting point with the national legal system, especially in the settlement of civil and minor criminal cases. This article also examines the challenges of harmonization between customary law and national law.
