Abstract

The main problem in this research focuses on how franchise businesses relate to problems that arise and often occur in franchise businesses. On this occasion the researcher explained the problems that emerged clearly. Based on normative juridical qualitative research, it was found that there are many problems in franchise businesses that always arise and the increasing number of franchise businesses appearing in society shows the importance of conducting studies related to legal protection for these businesses in Indonesia. Several ways to minimize the risk of legal problems in a franchise business include making a clear and complete franchise agreement, carrying out due diligence before entering into a franchise collaboration, understanding the laws and regulations related to franchise businesses, building good communication between franchisor and franchisee and providing training. and education for franchisees. By understanding the legal problems that often occur in franchise businesses and the steps to prevent them, franchisors and franchisees can minimize risks and build a successful franchise business

Abstract

This research investigates the factors contributing to global music copyright infringement in the digital era, the legal framework established by Indonesian Law Number 28 of 2014 on Copyright, and strategies for strengthening protection. Using a doctrinal legal research approach, the study incorporates statutory and comparative legal analyses to assess the effectiveness of Indonesia’s copyright laws and proposed strategies. The findings indicate that digital piracy globally is primarily driven by technological advances, the ease of sharing pirated content, and inconsistent international copyright laws. These issues have resulted in significant financial losses for creators and the rise of new forms of piracy. In Indonesia, while Law Number 28 of 2014 provides robust protections for creators, including economic and moral rights, enforcement remains problematic due to low public awareness and the rapid pace of technological advancements. Key institutions, such as the Directorate General of Intellectual Property (Direktorat Jenderal Kekayaan Intelektual/DJKI) and Collective Management Institutions (Lembaga Manajemen Kolektif Nasional/LMKN), play a critical role in enforcement but need further support. The study recommends strengthening legal frameworks, international harmonization, and leveraging technological solutions such as blockchain to improve copyright enforcement in Indonesia and ensure fair compensation for artists.

Abstract

This research discusses the juridical analysis of outsourced workers in light of Law No. 6 of 2023 on Job Creation Stipulating Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation into Law. This study aims to determine the regulation of outsourced workers after the issuance of the 2023 Job Creation Law and whether the regulation is able to protect and fulfil the rights of outsourced workers from the exploitation of employers that continues to occur in Indonesia today. This research uses qualitative research with normative legal research methods. The data sources used are primary data in the form of laws and government regulations of the Republic of Indonesia that are currently in force, and secondary data consisting of books, journals and websites. The results of this research can be concluded that in Law Number 13 of 2003 on Manpower, several provisions have been amended by Law Number 6 of 2023 on the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation into Law, including provisions relating to outsourced labour. Based on the old comparison between the Manpower Law and the Job Creation Law, it is worth noting that the Job Creation Law has also caused controversy, especially in relation to labour protection. Some provisions, such as those relating to the type of work, working time, and severance pay, are considered to reduce protection for outsourced labour. In addition, the Job Creation Law No. 6 of 2023 regulates the protection of workers from social security, working days and hours, time and holidays, wages and benefits, and provisions for termination of employment. However, in the event of discrepancies experienced by outsourced workers, they can take non-litigation legal action such as bipartite, mediation, conciliation, or arbitration

Abstract

This is where the financing company (leasing) manages the purchase of motor vehicles on credit. The financing company (leasing) is tasked with making a credit agreement containing payment provisions, interest, late fines, tenor, and default clauses. Also, each vehicle is registered as a fiduciary guarantee which is civilly a unit when the payment has not been paid in full by the debtor, the motorcycle unit is an object of fiduciary guarantee controlled by the creditor (leasing) The approach method used in this study uses a juridical-empirical approach. The juridical approach is used to analyze various laws and regulations governing credit. While the empirical approach is used to analyze law as a rule that is not merely normative, but law can see in the lives of people who always interact and relate to aspects of community life. The meeting of these two interests is what can make cession can be used as an alternative solution to solving problematic credit where each party will equally benefit whether from the debtor, creditor or cessionary side. The cessionary has a very important role where when the cessionary can bring together the interests of the old creditors and the debtor, the problematic credit can be resolved easily. As a new creditor, the cessionary can mediate with the debtor to find a middle ground for resolving the problem of bad credit.

Abstract

The fulfilment of medicines has become important in health development in Indonesia due to the increasing public awareness of health. Pharmacies are an important tool in the provision of medicines and health services. However, establishing a pharmacy business has high risks and requires a business licence and pharmacist practice permit. However, Law No. 11 of 2020 on Job Creation was rejected by the Constitutional Court, which resulted in the reissuance of the regulation in Law No. 6 of 2023. This has also impacted the regulations governing business licences, especially in the health sector such as pharmacies. Digital technology is also applied in implementing business licences with the OSS System. For the pharmacy business, business actors must understand the appropriate KBLI code and the correct licensing application procedure. Therefore, this research aims to analyse the impact of the reissuance of the rules in Law Number 6 of 2023 on the pharmacy business licensing rules. This research uses a form of normative juridical research that refers to developing legal norms, such as laws and court decisions. The approach methods used are statute approach and conceptual approach. The data to be used is secondary data from primary legal materials, secondary legal materials, and tertiary legal materials, such as laws, regulations, books, papers, journals, and other sources. The data collection technique that will be used is document study. The method of analysis that will be used is the qualitative analysis method to analyse the social aspects of the implications of Law Number 6 of 2023 on the Implementation of Risk-Based Business Licensing in the Health Sector for Pharmacies based on legal materials. After the issuance of Law Number 6 of 2023, there have been significant changes to the business licensing mechanism in Indonesia. Risk-based business licensing is enforced to support job creation and empowerment of micro, small and medium enterprises. The licensing process is based on the level of risk, with NIB as the legality to start and run a business. This concept regulates the function of NIB and other business licensing facilities from the government. Permenkes Number 14 of 2021 regulates the standards of business activities and products in the implementation of risk-based business licensing in the health sector, including pharmacies. So pharmacy business actors are encouraged to adjust to business licensing regulations and ensure legal certainty in pharmacy business licensing.

Abstract

The imbalanced position of consumers compared to business actors has led to the potential for disputes between consumers and businesses, known as consumer disputes. These disputes arise when consumers demand compensation for damages, pollution, and losses incurred from consuming goods or utilizing services. According to Law Number 8 of 1999 concerning Consumer Protection, a consumer dispute can be resolved either through the Court or out of Court. Resolving consumer disputes outside of Court is the absolute competence of the Consumer Dispute Resolution Agency. (BPSK). Normatively, the presence of BPSK provides many benefits to consumers; however, in practice, this is not the case, and in many instances, it often fails to provide legal protection to consumers. This includes issues related to the distribution of BPSK, which is not easily accessible to consumers as it is not available in all districts/cities. There are several contradictory regulations in its management, including human resource constraints, that, in many ways, need an understanding of the legal aspects of dispute resolution, especially regarding its position as a quasi-judicial body. Therefore, as a form of legal protection for consumers, BPSK must be empowered in various aspects.

Abstract

Penelitian ini membahas perlindungan hukum yang diberikan kepada konsumen terkait dengan pengambilan paksa objek jaminan fidusia oleh lembaga pembiayaan, dengan fokus pada analisis terhadap putusan Pengadilan Negeri Jakarta Selatan No. 345/PDT.G/2018/PN JKT.SEL juncto Putusan Kasasi No. 2945 K/PDT/2020. Metode penelitian yang digunakan adalah studi kasus dengan pendekatan yuridis normatif. Pentingnya perlindungan hukum bagi konsumen dalam pengambilan paksa objek jaminan fidusia oleh lembaga pembiayaan dapat dilihat dari kasus Putusan Pengadilan Negri Jakarta Selatan No. 345/PDT.G/2018/PN JKT.SEL. Pengadilan menghukum tergugat (lembaga pembiayaan) karena tindakan mengambil paksa Toyota Alphard milik penggugat (konsumen) dengan berbicara kasar dan masuk ke area rumah tanpa izin sehingga menyebabkan kerugian materiil dan immateriil. Putusan ini mencerminkan prinsip keadilan yang melindungi hak konsumen dari penyalahgunaan kekuasaan oleh lembaga pembiayaan. Namun, putusan ini kemudian dibatalkan oleh Putusan Kasasi No. 2945 K/PDT/2020 yang lebih menguntungkan pihak lembaga pembiayaan karena hanya melihat dari satu sisi bahwa konsumen lalai dalam membayar angsuran. Penulis menilai bahwa kasasi ini kurang memperhatikan dengan seksama aspek-aspek kunci dari perbuatan melawan hukum yang dilakukan oleh tergugat sejak awal gugatan diajukan di Pengadilan Negri. Hal ini menekankan perlunya implementasi dan penegakan hukum yang adil untuk melindungi hak-hak konsumen dalam sistem peradilan di Indonesia.

Abstract

Pasca berlakunya Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja maka dimunculkanlah Perseroan Perorangan.  Permasalahannya adalah inkonsistensi penerapan doktrin piercing the corporate veil yang memisahkan harta perseroan dengan pemiliknya. Doktrin ini sebelumnya hanya ada pada perseroan terbatas pada umumnya. Tujuan penelitian ini untuk menjelaskan implikasi Undang-Undang Cipta Kerja terhadap keberadaan perseroan perorangan di Indonesia. Metodologi yang digunakan dalam penelitian hukum yuridis normatif ialah pendekatan undang-undang, konseptual  dan historis. Data sekunder yang utama digunakan adalah Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentaang Cipta Kerja. Teknik Pengumpulan Data melalui studi kepustakaan. Hasil penelitian yang diperoleh ialah 1) Implikasi Undang-Undang Cipta Kerja terhadap keberadaan  perseroan perorangan di Indonesia adalah semakin banyak jumlah perseroan perorangan yang berasal dari Usaha Mikro dan Kecil (UMK) sebagaimana diatur dalam UU No. 6 Tahun 2023. 2) Konsep pemisahan harta  kekayaan pada perseroan  perorangan yang sudah terdaftar sebagai badan hukum di Indonesia ialah Limited Liability dan Separaate Legal Entity yang memisahkan harta perseroan dengan harta pemilik.

Abstract

Penelitian ini membahas perlindungan hukum dalam perdagangan ekspor produk pembersih di Indonesia, dengan fokus pada faktor pendukung dan penghambat, serta peran pemerintah dalam mendukung implementasi peraturan ekspor. Metode penelitian yuridis normatif digunakan untuk menganalisis regulasi perdagangan internasional, hukum bisnis, dan kebijakan nasional. Hasil penelitian menunjukkan bahwa faktor pendukung mencakup kebijakan pemerintah, infrastruktur logistik yang memadai, dan branding produk halal, sementara hambatan meliputi regulasi ekspor yang kompleks, persaingan global, dan fluktuasi nilai tukar. Pemerintah memainkan peran penting melalui pemberian insentif fiskal, penyederhanaan regulasi, pengembangan kawasan berikat, dan kerjasama internasional. Penelitian ini diharapkan dapat memberikan kontribusi bagi pengembangan hukum bisnis dan kebijakan perdagangan ekspor, serta menjadi referensi bagi pelaku usaha dan pemangku kepentingan terkait untuk meningkatkan daya saing produk pembersih Indonesia di pasar global.
