Abstract

The primary objective of this research is to assess the degree of legal assurance and protection accessible to investors involved in upstream oil and gas operations within the Republic of Indonesia's jurisdiction. The goal is to offer valuable insights to relevant decision-makers and stakeholders,  aiming to enhance the legal assurance and protection afforded to investors in this sector, thereby contributing to the nation's overall stability. The research methodology employed in this study is normative and qualitative juridical legal research, incorporating statutory and conceptual approaches. The research findings highlight the necessity for legislative enhancements, particularly implementing  the Job Creation Law. This legislation will  enhance the regulatory framework, ensuring legal assurance under Article 169, Section A of the Minerba Law. This provision stresses that holders of Mining Business Permits (KK) should not encounter premature contract terminations and advocates for rigorous law enforcement in cases of violations. Furthermore, the study acknowledges the significance of Law No. 25 of 2007, which safeguards legal and business assurance for investors, notably through the Omnibus Law.

Abstract

This thesis examines the role of state administration from a legal perspective in Indonesia, focusing on its dynamics, challenges, and practical implications. Through a comprehensive review of literature and data collection using methods such as legal document analysis, case studies, interviews, and surveys, this thesis explores the relationship between state administration and law within the framework of a legal state. The analysis highlights the complexity of the state administration's role in carrying out its duties by legal principles, including protecting human rights, enforcing justice, and sustainability of good governance. Furthermore, this thesis identifies the central challenges state administration faces and formulates policy recommendations to enhance its role in ensuring compliance with the law in Indonesia.

Abstract

This study is aimed at determining whether the implementation of the norm prohibiting money politics in Indonesia has been enforced in accordance with existing laws and regulations, and why they have not succeeded in curbing the practice of money politics. This study uses a normative legal research method or doctrinal legal research, supported by empirical research, with a statutory approach and case studies. The study uses secondary data obtained from the literature, including official documents, books, research results in the form of reports, and other forms of data. The results of this study reveal that the very limited time limit, namely 5 working days at Bawaslu to obtain two pieces of evidence and 14 days for the police to conduct an investigation, is the main factor in the low performance of law enforcement for money politics, and the failure of the application of administrative sanctions against candidates who are proven guilty of violating the prohibition on political money in a TSM manner.

Abstract

This research explores the values of Pancasila in three approaches: beliefs, knowledge and action dimension. Legal construction and deconstruction methods are used in this research. Some previous studies that distinguish this research, Nataliana, et.al (2022) discusses Pancasila within the scope of the Indonesian maritime state, Izzati and Muslikhah (2024) analyses Pancasila as the philosophy of the Indonesian nation, and Junia, et.al (2025) explores Pancasila in its level as an ideology and state philosophy. The striking difference from this research is the depth of discussion about Pancasila in this journal to find findings related to the foundation of Pancasila as the philosophy of the Indonesian state.  The values in Pancasila developed along with the formulation by the founding fathers, but remained at the root of Soekarno’s conception that Pancasila as Philosofische Grondslag and as Weltanschaung. In Pancasila there are values that contain cultural values (the first, second and third precepts), political values and mutual cooperation (fourth precept), and material values and justice (fifth precept). All of these values have not been the basis of work and the preparation of policy platforms in all lines and Indonesian state administration. The contribution of research to legal science can be seen from the position of Pancasila as a state ideology that is explored more deeply in this research in order to explore its values as the basis of the Indonesian nation and become a reflection for other countries in exploring the philosophical values of their state ideology.

Abstract

The imbalanced position of consumers compared to business actors has led to the potential for disputes between consumers and businesses, known as consumer disputes. These disputes arise when consumers demand compensation for damages, pollution, and losses incurred from consuming goods or utilizing services. According to Law Number 8 of 1999 concerning Consumer Protection, a consumer dispute can be resolved either through the Court or out of Court. Resolving consumer disputes outside of Court is the absolute competence of the Consumer Dispute Resolution Agency. (BPSK). Normatively, the presence of BPSK provides many benefits to consumers; however, in practice, this is not the case, and in many instances, it often fails to provide legal protection to consumers. This includes issues related to the distribution of BPSK, which is not easily accessible to consumers as it is not available in all districts/cities. There are several contradictory regulations in its management, including human resource constraints, that, in many ways, need an understanding of the legal aspects of dispute resolution, especially regarding its position as a quasi-judicial body. Therefore, as a form of legal protection for consumers, BPSK must be empowered in various aspects.

Abstract

The Resolution of Music and Song Copyright Disputes Through Arbitration in Providing Legal Protection for Owners in Indonesia is traditionally managed by the Commercial Court, which is often criticized for being slow, costly, and inefficient, thereby failing to offer optimal legal protection for creators. This situation highlights the need for alternative dispute resolution methods. This study analyzes the challenges of resolving copyright disputes through the Commercial Court and examines arbitration as a faster, more effective alternative for protecting music and song creators' rights in Indonesia. Using a normative legal research approach with legislative and conceptual methods, the research involved literature studies of primary and secondary legal materials. Data were analyzed qualitatively through descriptive analysis and deductive reasoning to assess legal synchronization, case studies, and a comparison between litigation and arbitration. Findings show that Commercial Court processes take 160 to 250 days on average, entail high costs, and involve complex bureaucracy, often resulting in inadequate protection for creators. In contrast, arbitration, especially through the Intellectual Property Arbitration and Mediation Agency (BAM HKI), provides a faster resolution (typically 90–180 days) and is conducted by intellectual property specialists, though its rulings require district court enforcement. The study concludes that arbitration is a viable and strategic alternative to litigation for music copyright disputes. It recommends raising awareness and encouraging the use of BAM HKI among creators and policymakers to improve accessible, efficient, and specialized legal protection, thereby strengthening Indonesia’s intellectual property landscape.

Abstract

Penelitian ini membahas peran pemerintah dalam memperkuat kepastian hukum e-commerce di Indonesia, yang telah menjadi fenomena global dengan pertumbuhan pesat. Penelitian ini bertujuan untuk menganalisis dampak perdagangan online e-commerce dalam pertumbuhan ekonomi dan mengkaji peran pemerintah untuk memperkuat kepastian hukum e-commerce untuk meningkatkan pertumbuhan ekonomi di Indonesia. Studi ini menggunakan pendekatan yuridis normatif yang didukung oleh data empiris, dengan menekankan pada data sekunder yang mencakup studi kepustakaan dan perbandingan hukum. Hasil penelitian menunjukan penguatan kepastian hukum ini juga berpotensi meningkatkan pertumbuhan ekonomi dengan mendorong kepercayaan bisnis, keamanan konsumen, dan minat investor. Pemerintah Indonesia telah mengambil tindakan dengan menetapkan beberapa undang-undang dan peraturan yang relevan, serta peraturan terkait uang elektronik dan pajak e-commerce. Penelitian ini menegaskan pentingnya kepastian hukum dalam e-commerce untuk membangun lingkungan bisnis yang stabil.

Abstract

Fokus utama penelitian ini adalah pada kejelasan peran dan tanggung jawab masing-masing pihak, serta pembagian keuntungan dan kerugian yang adil dalam CV. Tujuan penelitian ini adalah untuk menganalisis dan mengetahui bentuk pengaturan karakteristik Persekutuan Komanditer di Indonesia dalam mewujudkan keadilan serta untuk menganalisis dan mengkaji pendirian Persekutuan Komanditer di Indonesia pada masa yang akan dating. Penelitian ini menggunakan pendekatan undang-undang dan konseptual untuk menganalisis karakteristik badan usaha. Hasil penelitian menunjukkan bahwa perlu adanya mekanisme kontrol yang jelas untuk melindungi kepentingan sekutu komanditer dan memastikan pengelolaan modal yang optimal. Kesimpulan dari penelitian ini menunjukan karakteristik pembentukan CV di Indonesia memainkan peran penting dalam mewujudkan keadilan bagi semua pihak yang terlibat. Karakteristik ini mencakup penjelasan yang jelas mengenai peran dan tanggung jawab masing-masing sekutu, serta pembagian keuntungan dan kerugian yang adil.

Abstract

Kewirausahaan sosial merupakan model bisnis yang bertujuan tidak hanya untuk memperoleh keuntungan finansial, tetapi juga untuk memberikan dampak sosial yang positif dan berkelanjutan bagi masyarakat. Dalam praktiknya, kewirausahaan sosial sering kali menghadapi tantangan terkait kepastian hukum mengenai bentuk korporasi yang tepat untuk mendukung tujuan-tujuan sosial tersebut. Penelitian ini bertujuan ini untuk menganalisis kepastian hukum bentuk korporasi yang paling sesuai untuk mendukung kewirausahaan sosial dalam upaya pembangunan berkelanjutan. Metode penelitian ini menggunakan metode penelitian hukum yuridis normatif. Data primer dilakukan melalui studi wawancara dengan narasumber. Hasil penelitian menunjukan bahwa kewirausahaan sosial memainkan peran penting dalam memajukan pembangunan berkelanjutan di Indonesia. Oleh karena itu, penting untuk menciptakan ekosistem yang mendukung yang dapat mengatasi tantangan dan memanfaatkan faktor pendukung untuk memaksimalkan dampak kewirausahaan sosial dalam perjalanan Indonesia mencapai SDGs. Dengan menggabungkan wawasan dari penelitian ini, para pembuat kebijakan, investor, dan pemangku kepentingan dapat secara kolaboratif bekerja untuk membangun masa depan yang lebih inklusif, adil, dan berkelanjutan bagi Indonesia.

Abstract

Dalam ekosistem industry property, salah satu rantai pasok yang penting adalah perlindungan konsumen dan peran broker property adalah ketika memasarkan suatu poroduk property, bagi pengembang menjaga trust sangatlah penting. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi sertifikasi broker properti dalam perspektif Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Sertifikasi broker properti dianggap penting karena menjamin kompetensi dan profesionalisme para broker, serta memastikan kepatuhan terhadap standar hukum yang berlaku. Metode penelitian yang digunakan adalah pendekatan perundang-undangan, pendekatan konsep, dan pendekatan historis dengan analisis kualitatif terhadap peraturan perundang-undangan yang relevan. Hasil penelitian menunjukkan bahwa sertifikasi broker properti berperan signifikan dalam melindungi konsumen dari praktik-praktik tidak adil dan merugikan, serta meningkatkan transparansi dan keamanan dalam transaksi properti. Dengan demikian, keberadaan sertifikasi ini mendukung terciptanya lingkungan bisnis properti yang lebih adil dan dapat dipercaya, sesuai dengan tujuan utama Undang-Undang Perlindungan Konsumen.
