Abstract

Ecotourism is the empowerment of a sustainable tourism sector by utilizing the gifts of ecosystems and the existence of culture in natural habitats. Taking advantage of biodiversity. by paying attention to the concept of nature conservation and the surrounding environment. Ecotourism, as part of the tourism sector, is a leading sector globally which is used as a source of the nation's and state's economy which continues to be developed and needs to be improved. Considering the socio-economic aspect, the tourism sector is proven to be able to contribute to increasing income starting at the community level, opening and expanding employment opportunities, to increasing income for the government and increasing the country's foreign exchange, because through the tourism sector it has grown new businesses by encouraging regional economic development in the form of various kinds of entrepreneurship in the surrounding community. The research method carried out in scientific writing here uses normative juridical methods. Namely legal research through library study by examining predetermined library materials or sources accompanied by other secondary data, with an emphasis on problems related to the research topic. The research concluded that the concept of ecotourism development cannot be separated from the connection or relevance of local governments in managing and utilizing local communities. As stated in the regional autonomy policy. The obstacles are the lack of management and the lack of supporting capacity of the local community. Therefore, the successful use and management of ecotourism destinations is a collective responsibility, not only the burden of the government, but also local communities and managers. So that all these lines communicate with each other, facilitated by the regional or central government. Furthermore, it provides information on the importance of preserving natural resources, including the existence of diverse biodiversity, flora and fauna. So that the natural principles inherent in ecotourism can be sustainable and develop well.

Abstract

To reduce the number of traffic accidents which are felt to be very high, it is directed at a comprehensive response that includes efforts to develop,prevent, regulate and enforce the law.Legal certainty must be upheld, but justice and expediency are far more important to implement.The issues to be discussed are : (1) What are the sanctions for violations of Law Number 22 of 2009? and(2) How are the sanctions applied to perpetrators of violations of Law Number 22 of 2009?This writing uses a normative and empirical juridical approach, using primary data sources and secondary data sources.From the results of the writing it can be concluded that(1) sanctions for violations of Law Number 22 of 2009 are differentiated into sanctions for criminal acts of violation and sanctions for criminal acts, each of which has criminal provisions or fines, the types of crimes and the severity of crimes are determined in various ways, and(2) the application of sanctions against perpetrators of violations of Law Number 22 of 2009 concerning road traffic and transportation cannot be applied by law enforcement officials as formulated by Law Number 22 of 2009, this is caused by the existence of several existing policy factors, including( a) the existence of the police who allow reconciliation of traffic accident crimes on the highway, (b) the existence of reconciliation carried out by the perpetrators of traffic accident crimes, (c) the provision of compensation and compensation as a form of peace from the perpetrators of traffic accident crimes cross. Keywords: application of sanctions; perpetrators of law violations; road transport traffic

Abstract

Bantuan sosial merupakan instrumen penting dalam pengentasan kemiskinan, terutama di daerah perdesaan yang rentan secara ekonomi. Penelitian ini bertujuan menganalisis pemanfaatan bantuan sosial oleh keluarga penerima manfaat di Kalurahan Ngargosari, Kecamatan Samigaluh, Kabupaten Kulon Progo. Menggunakan metode mixed methods dengan Kalurahanin concurrent embedded, penelitian melibatkan 40 responden dan 10 informan. Mayoritas responden berusia produktif, berstatus menikah, bekerja sebagai ibu rumah tangga, berpendidikan SMA, menanggung 4 jiwa dan berpenghasilan rendah. Hasil menunjukkan, bahwa sebagian besar responden memanfaatkan bantuan sosial untuk memenuhi kebutuhan mendesak seperti pendidikan dan pangan, dan untuk menangani masalah finansial seperti hutang dan kebutuhan lainnya. Kontribusi bantuan sosial terhadap pendapatan keluarga berkisar antara 4%-58,9% dan terhadap pengeluaran 4,89%-47,18%. Bantuan sosial memainkan peran penting dalam mendukung kesejahteraan ekonomi keluarga, terutama dalam memenuhi kebutuhan dasar. Namun, 85% responden masih berada di bawah garis kemiskinan nasional. Meski membantu meringankan beban ekonomi, diperlukan peningkatan efektivitas program bantuan sosial melalui penargetan yang lebih tepat dan pemberdayaan ekonomi. Rekomendasi yang diajukan mencakup integrasi program bantuan sosial dengan literasi keuangan dan pemberdayaan untuk meningkatkan kemandirian penerima manfaat.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan hukum terkait pernikahan beda agama di Indonesia dalam kerangka hukum positif dan sanksi yang diberlakukan terhadap pasangan yang menikah beda agama. Penelitian menggunakan metode yuridis normatif melalui studi literatur dan analisis putusan pengadilan. Hukum pernikahan beda agama diatur dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan (UUP), yang mensyaratkan bahwa pernikahan sah jika dilakukan sesuai hukum agama masing-masing (Pasal 2 ayat 1). Larangan pernikahan antaragama tercantum dalam Pasal 8 huruf f UUP dan diperkuat oleh Pasal 35(a) UU Administrasi Kependudukan. Selain itu, Surat Edaran Mahkamah Agung (SEMA) Nomor 2 Tahun 2023 mengatur status hukum pernikahan antaragama yang belum dicatatkan secara resmi. Tanpa pencatatan di KUA atau Dukcapil, pasangan tidak mendapatkan akta nikah, yang berdampak pada status hukum anak dan akses terhadap hak administratif. Manipulasi data untuk mencatat pernikahan secara tidak sah dapat dikenakan sanksi pidana. Secara sosial, pasangan sering menghadapi stigma, pengucilan, dan tekanan dari keluarga atau masyarakat. Anak dari pernikahan beda agama juga berpotensi kehilangan hak waris jika berbeda agama dengan pewaris, menambah tantangan hukum dan emosional dalam keluarga.

Abstract

Komitmen Indonesia dalam mempercepat pembangunan iklim investasi yang kondusif ditunjukkan dengan diterbitkannya Keputusan Presiden (Keppres) pada tanggal 4 Mei 2021 yang tertuang dalam Nomor 11 Tahun 2021 tentang Gugus Tugas Percepatan Penanaman Modal. Untuk mewujudkan program tersebut, penanaman modal memerlukan peran aktif dengan pengawasan, termasuk penyelesaian kendala terkait dunia usaha dan pelaksanaan usaha oleh Satgas Percepatan Penanaman Modal yang telah dibentuk dan diluncurkan oleh pemerintah. Metode penelitian yuridis normatif digunakan dalam karya ilmiah ini. Penelitian hukum kepustakaan dilakukan dengan cara meneliti bahan pustaka atau data sekunder yang berkaitan dengan topik penelitian. Penelitian ini menghasilkan suatu rumusan dimana penyusunan peta proyek strategis yang dilakukan pemerintah dibarengi dengan kajian informatif yang komprehensif mengenai studi kelayakan yang membutuhkan biaya yang tidak sedikit. Sehingga investor akan mendapatkan sinyal baik (good news) atau sinyal buruk (bad news) dalam menjalankan usahanya. Lebih lanjut, pemerintah hendaknya memberikan peraturan atau kebijakan paten, mulai dari perizinan, serta ketersediaan lahan dan kepastian hukum, tanpa mengurangi keberpihakan pihak-pihak tertentu.

Abstract

The purpose of this study is to find legal protection for Non-Fungible Token (NFT) copyrighted works in digital business. In today's digital business, the NFT (Non-Fungible Token) phenomenon is no longer foreign to millennials. NFT is a digital token used to represent ownership or rights to a digital work in the blockchain chain. In the context of copyright protection, NFT can be used to provide proof of ownership and authentication of unique digital works in digital business. NFT covers several aspects and broad applications, namely in the fields of art, music, games, virtual property, etc. This study is limited to NFT in the field of digital art. This shows that the field of digital art in the NFT application has become an idol for millennials to get economic value in addition to its legal protection. This research is a legal research normative with approach qualitative, concept, legislation. Method data collection through secondary data by taking previous research related to NFT protection. The analysis method is carried out qualitatively. The results of the study indicate that the legal protection of NFT copyrighted works in digital businesses has not been specifically regulated in Article 40 of Law Number 28 of 2014 concerning Copyright, so that further regulations are needed to protect copyrighted works applied in NFT to anticipate digital businesses that do not detrimental to the parties.

Abstract

The rapid adoption of ride-hailing services in Indonesia is confronted by the problem of passenger safety vulnerability, stemming from normative regulatory insufficiency. The prevailing legal framework, comprising both the lex generalis (Law Number 22 of 2009) and the lex specialis (Ministerial Regulation Number 118 of 2018), is found to fail to provide a precise and operational mechanism for corporate liability. This failure creates a significant regulatory gap. This research aims to analyze the insufficiency of this legal framework, deconstruct the juridical implications of the “partnership” status, and construct an ideal, justice-based liability model. Employing a normative legal research (juridical-normative) method with statute, conceptual, and historical approaches, this study analyzes primary and secondary legal materials. The research findings indicate that this regulatory gap is exploited by application companies through the “partnership” construction. Substantively, this construction constitutes a legal fiction and a disguised employment relationship. This strategy is used to evade the doctrine of vicarious liability and systematically contributes to human error, which is the primary cause of accidents. This systematic contribution occurs through exploitative algorithmic management and the absence of fatigue management. Therefore, the novelty of this research is the proposition of a fundamental legal reconstruction. This reconstruction comprises two steps: imperatively affirming the legal status of application companies as “Transportation Service Providers,” and implementing four pillars of imperative liability mechanisms: comprehensive insurance, vehicle-worthiness standards, driver-welfare standards (including online-hour limits), and a rapid victim compensation mechanism.
