Abstract

Child marriage mostly happens in rural societies with many circumstances. Education's less-access, poverty, isolated-area, jobless are many factors that influencing child-marriages. From socio-economic aspect, these kinds of marriages causing school-drop-out, less life-skill, less knowledge, less self-confidence, and less job participation. That problem is most consequential to women that involve on child-marriages. Those condition impact to family's poverty and economic-dependency. Women with child-marriage also have suffered with negative on their reproduction health. Most of child-marriage happens btj manipulation of ages and time of their birth, which is as important condition to be a legal marriage. This research found that this child-marriage is psychological and physical violence. Women as teenagers whom in child-marriages are forced to involve in adult life in most of them had emotional depression and faced many socialeconomy difficulties.

Abstract

Tulisan ini menganalisis pertimbangan hakim dalam Putusan Nomor 153/Pdt.G/2021/PN.Yyk yang memutus perkara perceraian, yang mencerminkan dinamika kompleks dalam konflik rumah tangga. Penggugat mengalami tekanan psikologis yang signifikan akibat tindakan tergugat, yang mencakup perbuatan tercela seperti perselingkuhan, alkoholisme, dan perjudian. Tindakan tersebut tidak hanya menyebabkan tergugat gagal memenuhi kewajiban nafkah, tetapi juga merusak kestabilan emosional dan ekonomi penggugat serta anak-anak mereka. Penelitian ini menekankan pentingnya alat bukti tertulis dalam proses litigasi, khususnya dalam pengajuan klaim nafkah anak dan biaya pendidikan, yang merupakan hak asasi fundamental bagi anak-anak. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan preskriptif, yang memungkinkan analisis mendalam terhadap ketentuan hukum yang relevan, termasuk undang-undang tentang perkawinan dan peraturan pelaksanaannya. Hasil penelitian menunjukkan bahwa keputusan hakim didasarkan pada ketentuan hukum yang mewajibkan penggugat untuk menyertakan bukti tertulis yang berkaitan dengan pendapatan tergugat sebagai dasar penetapan kewajiban finansial. Penelitian ini menggarisbawahi bahwa alat bukti tertulis memegang peranan sentral dalam pembuktian perkara perdata dan mengonfirmasi perlunya substansi serta legitimasi bukti dalam mencapai keadilan di pengadilan. Sehingga, dapat disimpulkan bahwa penguatan legitimasi dan keabsahan bukti dalam proses hukum sangat penting, demikian pula urgensi bagi para pihak dalam perkara perceraian untuk mempersiapkan bukti yang memadai demi mencapai putusan yang adil.

Abstract

The COVID-19 pandemic has posed significant challenges to legal systems and the protection of constitutional rights globally. Restrictions on fundamental rights, such as freedom of movement, assembly, and work, imposed by governments to protect public health, have sparked debates on the extent to which constitutional rights can be limited during a global health emergency. This study aims to analyze how different legal systems in various countries address the limitation of constitutional rights during the COVID-19 pandemic, with a focus on the principles of necessity, proportionality, and non-discrimination in the framework of international human rights law. Using a qualitative approach through literature study and library research, this article examines various constitutional legal frameworks, emergency laws, and the application of relevant international human rights principles. The findings show that although many countries have constitutional provisions allowing for the restriction of certain rights during emergencies, the application of the principles of proportionality and necessity varies. The study also highlights the critical role of judicial oversight to ensure that rights limitations are not excessive and are applied fairly, and the importance of aligning national laws with international human rights standards. The implications of this research suggest the need for long-term legal reforms to ensure just and non-discriminatory limitations of rights in future global health emergencies.

Abstract

This study examines the role of the Ministry of Law in harmonizing national legislation with international legal standards, focusing on the challenges and mechanisms involved in aligning domestic laws with global norms. With increasing globalization, countries are increasingly required to adjust their legal systems to comply with international treaties and agreements. This research aims to explore how the Ministry of Law facilitates this process, addressing the political, legal, and institutional challenges that arise in the harmonization process. A qualitative literature review was conducted, analyzing relevant academic sources, governmental reports, and case studies from various countries. The findings reveal that while the Ministry of Law plays a pivotal role in implementing international legal standards, its success is often contingent on institutional capacity, political will, and the ability to balance national interests with international obligations. The study concludes that a strategic, well-supported Ministry of Law is essential for effective legal harmonization. Strengthening the Ministry’s capacity and fostering intergovernmental cooperation are key to overcoming resistance and ensuring compliance with international legal standards, ultimately enhancing global legal cooperation and governance.

Abstract

Penelitian ini menganalisis penerapan due diligence dalam pembentukan Peraturan Daerah dengan meninjau aspek partisipasi publik, harmonisasi regulatif, dan kualitas naskah akademik serta memperkuatnya melalui studi empiris di Sumatera Selatan. Hasil penelitian menunjukkan bahwa inefektivitas legislasi daerah disebabkan oleh minimnya partisipasi bermakna, lemahnya harmonisasi, serta rendahnya kualitas naskah akademik yang diperparah oleh keterbatasan kapasitas dan koordinasi antar instansi. Penelitian ini merekomendasikan model due diligence terintegrasi yang meliputi pra‐screening wajib, harmonisasi komprehensif, penguatan partisipasi publik, dan pemanfaatan teknologi SPBE untuk meningkatkan kualitas dan akuntabilitas pembentukan Perda.

Abstract

The digitalization of the judiciary has significantly transformed criminal justice systems worldwide, introducing both efficiency and new legal challenges. This research explores the impact of judicial digitalization on criminal procedure law, specifically focusing on how digital technologies affect procedural practices, legal safeguards, and fundamental rights. The study aims to identify key areas where criminal procedure law must be reformed to accommodate digital practices without compromising fairness, transparency, and due process. Using a library-based research method, this study analyzes relevant literature, legal texts, and case studies to assess the implications of digital tools such as virtual hearings and digital evidence management. Findings indicate that while judicial digitalization enhances efficiency and access to justice, it also creates legal uncertainties, particularly concerning data privacy, digital evidence handling, and the protection of defendants' rights. The research concludes that comprehensive legal reform is necessary to align criminal procedure law with the realities of digital justice, ensuring that technological advancements contribute to, rather than undermine, fair and transparent criminal proceedings.

Abstract

The rise of digital crimes involving minors has become a significant challenge for law enforcement officers within the juvenile justice system. The complexity and rapid evolution of digital offenses, such as hacking and online fraud, have made it difficult for law enforcement to address these crimes effectively, especially with minors involved. This study aims to analyze law enforcement officers' perceptions of child offenders in digital crime cases and explore the challenges they face in handling such offenses. Using a qualitative library research approach, data were collected from books, academic journals, legal documents, and previous research on digital crimes, juvenile delinquency, and law enforcement practices. The findings indicate that law enforcement officers often feel inadequately trained and underprepared to handle digital crimes committed by minors, leading to inconsistent responses. While officers generally prefer rehabilitation over punishment for minors, the lack of specialized legal frameworks and technical knowledge complicates the handling of these cases. The study concludes that specialized training, updated legal frameworks, and an integrated approach between law enforcement, educational institutions, and social services are necessary to effectively address digital crimes involving minors.

Abstract

Land mafia has become a serious issue within Indonesia's agrarian system, threatening both justice and legal certainty in land affairs. Practices involving the manipulation of land certificates, illegal land occupation, and collusion between corrupt officials and certain parties have caused significant harm to the public and hindered national development. This study employs a normative legal approach with descriptive analysis to examine the role of agrarian reform as a strategic solution to combat land mafia practices. The findings indicate that agrarian reform through land redistribution, asset legalization, and institutional strengthening can foster a more just and transparent land administration system. A comprehensive implementation of agrarian reform can disrupt the chain of land mafia operations by simplifying administrative procedures, digitizing land information systems, and enhancing oversight mechanisms. Furthermore, agrarian reform contributes to improving farmers' welfare, reducing land ownership inequality, and strengthening national food security. This study recommends the need for strong political commitment, effective inter-agency coordination, and active public participation in implementing agrarian reform. Strict law enforcement against land mafia actors and the development of an integrated land information system are key to the success of agrarian reform in establishing clean and accountable land governance.
