Abstract

Technological developments are increasing, one of which is marked by the existence of e-commerce and fintech to facilitate transactions for the public. In this modern era, people are more interested in online transactions such as buying and selling. TikTok Shop is one of the applications widely used by Indonesians. One of the payment methods on TikTok Shop is TikTok PayLater. This study uses an empirical juridical research method, which examines the applicable legal provisions and what actually happens in society. This study uses a qualitative approach based on a review of the PayLater contract, interest structure, administration fees, and late payment penalties. The data collection technique in this study was obtained through interviews with seven informants who are active users of TikTok PayLater. The results of the study show that the TikTok PayLater agreement is legally valid because it complies with Article 1320 of the Civil Code and is recognised by the ITE Law. The TikTok PayLater agreement includes a standard agreement, the content of which is still limited by the provisions of Article 18 of Law 1999. However, in practice, it still has the potential to cause disputes due to default as regulated in Article 1243 of the Civil Code. However, such collection practices violate Article 4 of the 1999 Consumer Protection Law as they infringe upon consumers' rights to comfort and security. Therefore, the use of TikTok PayLater requires responsibility from both parties.

Abstract

This study examines legal protection for consumers against unilateral price changes in hotel booking transactions conducted through the Traveloka digital platform and formulates a legal liability model between hotels and digital platforms. The research adopts a juridical-empirical (socio-legal) approach by combining normative analysis of the Consumer Protection Law, the Electronic Information and Transactions Law, the Civil Code, and Government Regulation Number 80 of 2019 on Electronic Commerce with field data obtained from interviews with consumers, hotel management, and platform representatives. The findings indicate that post-confirmation price changes violate consumer rights, the principle of good faith, and legal certainty, and constitute both breach of contract and unlawful acts. These practices are exacerbated by the absence of clear regulations defining the allocation of liability between hotels and digital platforms, resulting in a legal vacuum that weakens consumer protection. The novelty of this study lies in integrating a normative-empirical approach with global liability theories to develop a joint liability framework applicable to digital hotel transactions. This study recommends strengthening digital consumer protection through post-confirmation price-lock mechanisms, prohibition of unilateral clauses, and mandatory re-consent procedures to ensure fairness, transparency, and legal certainty in online hotel transactions.   Penelitian ini menganalisis bentuk perlindungan hukum bagi konsumen terhadap praktik perubahan harga sepihak dalam transaksi pemesanan hotel melalui platform digital Traveloka serta merumuskan model tanggung jawab hukum antara hotel dan platform digital. Penelitian menggunakan pendekatan yuridis empiris (socio-legal research) dengan memadukan analisis normatif terhadap Undang-Undang Perlindungan Konsumen, Undang-Undang Informasi dan Transaksi Elektronik, Kitab Undang-Undang Hukum Perdata, serta Peraturan Pemerintah Nomor 80 Tahun 2019 tentang Perdagangan Melalui Sistem Elektronik, dengan data lapangan berupa wawancara konsumen, pihak hotel, dan penyedia platform. Hasil penelitian menunjukkan bahwa perubahan harga setelah konfirmasi dan pembayaran merupakan pelanggaran terhadap hak konsumen, asas iktikad baik, dan kepastian hukum, serta dapat dikualifikasikan sebagai wanprestasi dan perbuatan melawan hukum. Praktik tersebut diperparah oleh ketiadaan pengaturan tegas mengenai pembagian tanggung jawab antara hotel dan platform digital, sehingga menciptakan kekosongan hukum dan melemahkan posisi konsumen. Kebaruan penelitian ini terletak pada integrasi pendekatan normatif-empiris dengan teori tanggung jawab hukum global untuk merumuskan konsep joint liability antara hotel dan platform digital. Penelitian ini merekomendasikan penguatan regulasi perlindungan konsumen digital melalui penerapan price-lock pascakonfirmasi, larangan klausul sepihak, dan mekanisme re-consent guna menjamin kepastian hukum dan keadilan dalam transaksi hotel daring.

Abstract

The phenomenon of illegal immigrants in Southeast Asia, particularly in the Indonesia-Malaysia corridor, poses serious challenges related to legal, security, and human rights issues. The complexity of this problem arises from differences in national regulations, weak cross-border surveillance, and high economic pressures that drive irregular migration. This study aims to analyze the extent to which bilateral cooperation between Indonesia and Malaysia in handling illegal immigrants is in accordance with international law and human rights protection principles. The method used is a normative juridical approach, examining international legal instruments such as the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (1990), ICCPR, ICESCR, and various bilateral Memoranda of Understanding (MoU) between the two countries. The results of the study show that, normatively, Indonesia-Malaysia cooperation has referred to international legal standards that emphasize humane treatment, the principle of non-refoulement, and the protection of the basic rights of migrants. However, operationally, its implementation still faces obstacles in the form of weak inter-agency coordination, limited resources, and a lack of independent oversight. These conditions have led to continued human rights violations, particularly in the form of arbitrary detention and limited access to basic services for undocumented migrants. Thus, strengthening monitoring mechanisms, training officers, and involving international organizations are necessary for this cooperation to be more effective, humane, and sustainable in accordance with the principles of international law.

Abstract

The implementation of Thematic Community Service Program (KKN-T) in Sadapaingan Village is directed to develop local potential while addressing priority village problems. This program is focused on the MSME sector. By involving students, village government, and the community, KKN-T is expected to create sustainable solutions and become a model for village development that can be replicated in other areas. MSMEs have not yet developed and local economic potential has not been optimized Digital marketing training, creation of Google Maps & QRIS accounts, as well as branding and digital marketing education for MSME actors. The objectives to be achieved through the KKN-T program in Sadapaingan Village are: Digitalization and Empowerment of MSMEs Through; 1. Increasing the capacity of MSME actors in Sadapaingan Village in utilizing digital platforms for product marketing and sales; 2. Expanding the reach of the MSME market, increasing product visibility, and encouraging village economic growth. The RUPA REKA UMKM program provides mentoring to local MSMEs, namely Gula Kawung Ma Didin and Ma Nonoh on July 21, 2022, and Rengginang Pak Ujang on July 22, 2022. UNMA Community Service Program (KKN-T) students assisted these MSMEs in creating product logos, banners, signposts for their production locations, and listing their locations on Google Maps. The goal was to increase sales volume and enhance business visibility.
