Abstract

Kehadiran KUHP Baru dalam beberapa aspeknya dinilai telah menyerap rumusan hukum Islam. Paper ini menelisik transformasi hukum Islam dalam KUHP Baru aspek pemidanaan dan sanksi pidana saja. Pendekatan yang dipakai adalah hukum dan perubahan sosial dan legisprudensi. Metode yang digunakan adalah yuridis, historis-dokumenter dengan pisau analisis deduksi-induksi, dan refleksi kritis. Paper ini menyimpulkan bahwa pada aspek pemidanaan hukum Islam telah mampu berkontribusi dalam rumusan tujuan pemidanaan dalam KUHP Baru. Kontribusi tersebut terlihat dari rumusan-rumusan yang sepadan secara filosofis. Sementara dari aspek sanksi pidana kontribusi tersebut juga tampak sekali dalam model transformasi matereil aspek ta’zir. Seperti konsep pemaafan, pidana ganti rugi dan lain sebagainya.  Ini menunjukkan hukum Islam telah menampilkan diri sebagai hukum tidak hanya bersifat ketuhanan (divine law), namun ia juga dapat menampilkan diri sebagai hukum manusia (made-man law)

Abstract

The evolution of criminal law in Indonesia reflects a complex interplay between indigenous legal traditions and external influences, including Islamic law. This article examines the contribution model of al-mas'ūliyyah al-jinā'iyyah (criminal liability in Islamic law) to formulating criminal liability in Indonesia’s New Criminal Code (KUHP Baru). The study adopts a qualitative research method, utilizing a comparative legal analysis framework to explore the dialectic between Islamic criminal law and the New Criminal Code. Data sources include classical legal texts, the book of Qur’anic exegesis and Hadith interpretations, legislative documents related to the New Criminal Code, academic literature, legal commentaries, and jurisprudential analyses. Through this method, the study identifies an elegant interplay between the principles of ḍarar (harm) and the fundamental criminal liability provisions in both systems. This study's findings reveal significant similarities and key differences, such as the role of intent, the typology of legal subjects, and the broader scope of liability for corporate crimes under the New Criminal Code (KUHP Baru). This article concludes that the contribution of al-mas'ūliyyah al-jinā'iyyah to the New Criminal Code lies primarily at the level of values while highlighting the potential for further alignment in specific areas.

Abstract

Inclusive education is a strategic policy to ensure the right to education for all children, including those with special needs. However, despite Indonesia’s strong normative framework supporting inclusive education, implementation remains uneven. This paper aims to examine the effectiveness of legal protection for children with special needs within the inclusive education system, using SMA Negeri 3 Pangkalpinang as a case study. The study employs an empirical juridical method, combining normative legal analysis with field observations and interviews involving educators, parents, and school administrators. The findings reveal a significant gap between the legal framework and the real conditions in schools. Key challenges include the absence of certified special assistant teachers, inadequate inclusive facilities, and limited awareness among stakeholders. The study concludes that while legal guarantees exist, systemic implementation barriers hinder their realization. Strengthening inclusive education requires harmonized policies, structural support, and a shift in legal culture within school communities.

Abstract

Eskalasi kejahatan siber berbasis Artificial Intelligence (AI) telah mendisrupsi tatanan hukum pidana nasional serta menciptakan disparitas tajam antara akselerasi teknologi dengan rigiditas regulasi. Paradigma hukum pidana Indonesia yang masih antroposentris gagal menjangkau entitas algoritma otonom sehingga memicu kekosongan norma (vacuum of norm) yang serius dan melahirkan impunitas struktural. Penelitian ini bertujuan untuk mendekonstruksi hambatan yuridis akibat karakteristik AI dan memformulasikan reformasi kebijakan pidana yang adaptif. Dengan menggunakan metode penelitian yuridis-normatif melalui pendekatan perundang-undangan, konseptual, dan perbandingan hukum, studi ini menemukan bahwa karakteristik Black Box dan otonomi AI secara fundamental memutus rantai kausalitas serta mengaburkan unsur kesalahan (mens rea) konvensional. Oleh karena itu, pendekatan positivisme yang kaku harus ditinggalkan demi Hukum Progresif. Penelitian ini merekomendasikan pergeseran paradigma menuju doktrin Strict Liability atau pertanggungjawaban mutlak bagi pengembang AI risiko tinggi dan mendesak penerbitan Peraturan Mahkamah Agung sebagai instrumen taktis untuk mengisi kekosongan hukum guna menjamin keadilan substantif.

Abstract

This research aims to analyze the reasoning of judges in the Ruling of the Pangkalpinang District Court Number 31/Pid.Sus-TPK/2024/PN PGP concerning fictitious financing cases in Islamic banking, positioning it within the spectrum between a formalistic approach and substantive justice. This research employs a normative legal research method with statutory, conceptual, and case approaches, analyzed qualitatively through tracing the ratio decidendi of the decisions and comparing them with doctrines of economic criminal law and banking law. The results indicate that the panel of judges has successfully proven the elements of corruption offenses normatively, particularly the abuse of authority and state financial losses; however, the reasoning applied remains predominantly formalistic. The main findings of this research reveal that judges have not deeply elaborated on the concepts of fiduciary duty, the trust of office, and substantive parameters for distinguishing between administrative errors and official crimes. The contribution of this research lies in the development of a more substantive judicial reasoning framework by integrating the principles of prudence, abuse of authority, and the specific characteristics of Islamic banking, thereby enabling criminal law to function proportionally as an instrument for protecting public interests and substantive justice.

Abstract

This community service activity aims to improve product packaging quality and enhance understanding of food safety among MSME actors and vocational high school students in Tukak Village, South Bangka Regency. The main problems faced by local MSMEs include the use of simple packaging that does not meet food safety standards and the limited understanding of hygienic production practices. The activity was carried out through lectures, interactive discussions, and hands-on practice involving 50 participants. The pre-test and post-test evaluations showed a significant increase in participants’ knowledge, rising from an average of 45% to 85%. In addition, technical skills such as selecting food-grade packaging materials, sealing techniques, sanitation and hygiene practices, and designing product labels also improved substantially. The attendance rate, participation, and enthusiasm of the participants demonstrated that the training methods implemented were effective and relevant to the needs of the MSMEs. This program contributed significantly to enhancing the competitiveness of local businesses while preparing vocational students as competent young entrepreneurs. The recommendations include the need for ongoing mentoring, improved access to quality packaging materials, and advanced training related to food product licensing.

Abstract

The enactment of New Criminal Code signifies a pivotal shift in Indonesia's criminal law, aiming to harmonize national identity with religious, customary, and Western legal principles. This study investigates the influences of Islamic law to the New Criminal Code, focusing on criminal acts. Understanding this interaction is essential to explain how Islamic legal principles contribute to shaping contemporary national criminal law reform in Indonesia. This study employs doctrinal legal research, which examines legal principles, statutory provisions, and legal doctrines related to Islamic criminal law and Indonesia’s New Criminal Code. The research relies primarily on legal documents, including legislation, scholarly literature, and authoritative legal texts. The collected data were analyzed qualitatively using the analytical model of Miles and Huberman, which consists of data reduction, data display, and conclusion drawing. The research identifies two key findings: (1) Islamic law significantly influences the provisions of the New Criminal Code, evident in material and formal legality aligning with societal values; and (2) Islamic principles exhibit greater responsiveness in addressing legality standards, the retroactive principle, and crime classification. These findings underscore the progressive and integrative potential of Islamic law in enriching national criminal law reforms. This study offers a novel contribution by mapping the substantive transformation of Islamic criminal law principles into Indonesia’s New Criminal Code, thereby highlighting the role of Islamic legal thought in contemporary national criminal law reform.

Abstract

The characteristics of fiqh with its local wisdom in the Pengajian Pitulasan are based on the charismatic authority approach of Sunan and Kiai figures who gave a philosophical view named Gusjigang. Gusjigang is a dialectic reflection between fiqh and local wisdom in Kudus city. This philosophy is applied in daily life which leads to being a completely human character. The form of responsiveness fiqh found in the Pengajian Pitulasan Yayasan Menara Kudus is to use the method and approach of qauli by involving dialogical elements that reflect the public mind even though it is still at a small level. This research is a type of field research based on literature review as know as library research with the documentary-historical method. The data also shows that the form of fiqh responsiveness in the Pengajian Pitulasan has absorbed various dimensions of life such as the economic, social, health, and other fields. Among the forms of fiqh that represent the dialectic between fiqh and its local wisdom in the Pengajian Pitulasan are: the role of the Kiai is clearly seem in preserving the local culture of Pengajian Pitulasan Yayasan Menara Kudus and avoiding sacrifices with the cow for the Kudus Kulon community.
