Abstract

The globalization of industrial animal agriculture including exportation of live animals has brought farm animals as the victims of global trade. Farm animals are still treated as commodities in most jurisdictions. They are the animals that suffer the most as they are mostly bred, kept and raised in intensive confinement just to be used or killed by humans. The farm animals are mostly treated inhumanely with no legal protection. Although global awareness regarding animal welfare has arisen, the development of animal law in national and international regulations has not changed much, especially regulation of farm animals. This journal will suggest a solution to the issues which arise regarding the farm animals’ welfare through the WTO laws and extraterritorial jurisdiction. Extraterritorial jurisdiction is introduced in this journal as it is believed to be a practical solution to fill the regulatory gaps regarding farm animals’ welfare that transported globally.

Abstract

When a Notary violates this article while doing his or her job duties, it qualifies as an act without authority. As a consequence of such an act without authority, someone who is harmed by a Notary who has declared his position without authority can sue for civil damages and compensation to the Notary Public. In carrying out these responsibilities, the notary is protected by the Notary Position Law (UUJN) and the UUJN-P. However, other forms of protection can be carried out and developed by the notary himself, namely by including the Self-Protection Clause in the deed made before the Notary Public. or when at the request of the parties making Legalization, Waarmerking, Adjustment / Matching of the Copy with the Original and Kovernot. Such a Notary Self-protection is very important for the notary so that no one quickly questions the notary's deed of Legalization, Waarmerking, Adjustment / Matching of Copies with the Original and Kovernot. So the notary is obliged to protect himself.

Abstract

Implementation of uterine rental agreement or surrogate mother is an agreement between a woman who binds herself through an agreement with another party (husband and wife) to become pregnant with the result of the fertilization of the husband and wife which is implanted into her womb, and after giving birth is required to hand over the baby to the husband and wife based on agreement made. The research method used is normative legal research, namely legal research conducted by researching library materials or secondary legal materials, while the problem approach is carried out using a legal approach and a conceptual approach. The results of the study indicate that the mother surrogate does not fulfill one of the conditions of the agreement. Then the Notary Deed is declared null and void if the deed does not meet the objective elements of the deed, namely a lawful cause. In such a case, legally without any request from the parties, thus the agreement is considered to have never existed and is not binding on anyone.

Abstract

The lease purchase agreement is a new type of agreement that arises in the community. As with the new type of agreement, leasing in Indonesia has not been regulated in the several definitions put forward by the legal experts above and also in the decree of the Minister of Trade and Cooperatives, there is no uniformity. However, if you pay attention, it can be concluded that the lease-purchase agreement is more likely to lead or lead to the form of a sale-purchase agreement, rather than a lease. Because in the lease purchase agreement, the transfer of property rights is the main point. So the purpose of leasing is to sell goods, not to rent or become tenants of goods. In the event that the tenant defaults in the lease purchase agreement, the tenant is fully responsible for the risk. This is in accordance with the contents of the lease-purchase agreement that has been agreed between the two parties. For the problem of resolving disputes in the motor vehicle rental agreement in practice, it can be reached in two ways, namely through deliberation and consensus and through a lawsuit in court. Court is the last resort taken by the dealer, if the tenant really does not want to be responsible for all his mistakes, namely with the intention of transferring the motor vehicle which is the object of the lease purchase agreement.
