Abstract

Penelitian ini berfokus pada tinjauan yuridis terhadap pelaku penyertaan tindak pidana kekerasan terhadap anak yang mengakibatkan kematian, dengan studi kasus Studi Kasus. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai tindak pidana kekerasan terhadap anak menurut hukum positif di Indonesia serta penerapan hukum pidana materil oleh penegak hukum dalam kasus ini. Metode penelitian yang digunakan adalah penelitian normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pelaku penyertaan yang tidak melaporkan atau mencegah terjadinya kekerasan terhadap anak dijatuhi hukuman yang lebih besar dibandingkan pelaku utama. Dalam kasus ini, pengadilan menggunakan tuntutan alternatif dan mengedepankan asas lex specialis derogat legi generali, mengingat korban masih di bawah umur.

Abstract

Problematika penegakan hukum khususnya dalam perkara pidana yang dihadapi di Indonesia tidak hanya dalam penjatuhan pokok pidananya. Korban tindak pidana ialah pihak yang merasakan penderitaan terdalam dalam suatu kejahatan, justru lebih sulit mengakses perlindungan yang diberikan Undang-Undang dibandingkan pelaku kejahatan. Akibatnya, saat pelaku kejahatan telah dijatuhi sanksi pidana oleh pengadilan, keadaan dan kondisi korban kejahatan sering diabaikan dan kurang mendapatkan perhatian. Access to justice merupakan penyedia sarana (fasilitas) dalam pemberian arahan penegakan hukum. Pendekatan penelitian hukum yang digunakan pada artikel ilmiah hukum ini adalah pendekatan konseptual dan pendekatan perundang-undangan. Data yang digunakan didapat melalui studi kepustakaan dan bersifat kualitatif. Bantuan hukum sebagai awal Access to justice memfokuskan pada tujuan dari landasan adanya sistem hukum yang dapat mengakomodasi penggunaan dan pemberian akses bagi siapapun dan dari kalangan ekonomi apapun dan sistem hukum juga harus membentuk putusan atau aturan hukum yang berlandaskan keadilan bagi individual maupun kelompok.

Abstract

Proper disposal of medical waste is one of the most important things in dealing with the Covid 19 pandemic. Over the last two years, the large number of Covid-19 cases caused by Delta and Omnicron variants has also led to an increase in medical waste generated by the use of masks and other personal protective equipment. This leaves homework for all of us, not just the government. This medical waste is generated not only in medical facilities but also in communities and homes. The waste in this pandemic is classified as Hazardous Waste and Toxic Waste (B3) and may be classified as Infectious Waste. The purpose of this study is to study the management of medical waste related to Covid19 from an ecological point of view so that it can effectively reduce the accumulation of waste that may have a natural impact on health promotion. Is to do. This investigation is a doctrinal/normative legal investigation that uses a legal approach. The data was collected through literature reviews and qualitatively analyzed. As a result of this study, the management of COVID-19 medical waste is regulated, and the treatment of medical facility waste and household waste is different. The purpose of this regulation is to reduce the increase in the amount of waste that can affect the environment and public health.

Abstract

Human trafficking is a serious criminal offense involving the illegal recruitment, movement, or control of individuals for the purpose of exploitation, including forced labor, servitude, and sexual exploitation. Children working as domestic workers are particularly vulnerable to such practices, especially in countries where their legal status as workers is not explicitly recognized or adequately protected. In Indonesia, child domestic workers have not been formally acknowledged within labor or domestic worker protection laws, resulting in fragmented and limited legal safeguards against human trafficking. This situation contrasts with the Philippines, which provides explicit legal recognition and comprehensive protection for child domestic workers under Republic Act No. 10361 (the Domestic Workers Act).This study aims to comparatively analyze the legal frameworks of Indonesia and the Philippines in protecting child domestic workers from human trafficking. Employing normative legal research with statutory and comparative law approaches, the study finds significant differences between the two countries, particularly in terms of legal recognition, the construction of trafficking offenses, and the scope of criminal sanctions imposed on perpetrators. The findings highlight the urgency of strengthening Indonesia’s regulatory framework to ensure comprehensive and effective legal protection for child domestic workers against human trafficking.Keywords: Comparative Law; Child Domestic Workers; Human Trafficking
