Abstract

This paper explores the intricate landscape of trademark protection within the realm of Intellectual Property Rights (IPRs). Trademarks, emblematic of brand identity and consumer trust, wield significant economic value and reputation. However, they are increasingly vulnerable to infringement, posing challenges to both proprietors and regulatory bodies. Against this backdrop, the efficacy of license agreements as a mechanism for mitigating trademark infringement is examined. Through a comprehensive analysis of contract law principles, including freedom of contract and good faith, this study elucidates strategies for bolstering trademark protection. Drawing upon legislative frameworks, contextual analysis, and case law, the paper proposes a nuanced approach to navigating trademark-related disputes. By fostering transparent and mutually beneficial relationships between brand owners and licensees, this framework seeks to uphold the integrity of trademarks while safeguarding market integrity. Ultimately, the paper advocates for a collaborative effort among stakeholders to ensure equitable practices and uphold the sanctity of trademarked goods and services in the global marketplace.

Abstract

Retraction notice: This article has been retracted at the request of the Editor-in-Chief due to concerns related to authorship issues.This work is aimed at reexamining the well-known mark protection, particularly in Indonesia. It is sparked by a substantive gap, covering theoretical and practical elements in protecting well-known mark. The case rooted at the Indonesian Supreme Court decision that refers to the constitutive systems in mark registration and refused the Pierre Cardin proposal to invalidate the Indonesian local that used mark Pierre Cardin for his convection products. Normatively, the court should analyze and consider the architecture of norms in protecting well-known mark by going further into the international conventions on mark, such as TRIPs agreement and Madrid Protocol that recognize and protect the well-known mark. To analyze this case, this work will apply normative legal research. In the discussion section, this work elaborates the basic concepts of well-known mark, fundamental and core elements as well as the indicators or criteria of well-known mark. In addition, this work will compare some jurisprudences concerning the well-known mark protection. At the end, this work offers some substantive and pragmatic approaches in strengthening well-known mark protection. The substantive approach will discuss and examine some theories, norms, and policies used by judges in handling well-known mark cases. Whereas, the pragmatic approach underlines the importance of institutional networking and legal awareness improvement, particularly key society groups, e.g., university and industry, to control violation of well-known marks.

Abstract

In the creative economy, technology significantly enhances human productivity and creativity, prominently through Artificial Intelligence (AI), which simulates human intelligence in computing. The rapid advancement of AI raises numerous debates, particularly in the art sector, where societal opinions vary from opposing the registration of AI-generated artwork to advocating for AI's recognition as a non-person legal entity entitled to moral rights. This discourse centers around granting legal status to AI regarding its artwork and relates to the broader concept of Intellectual Property as it pertains to creators and copyright holders. Currently, Indonesia's Copyright Law Number 8 of 2014 lacks specific provisions addressing these issues, resulting in a legal vacuum. This research aims to analyze the application of copyright legal theory to AI-generated art and the legal implications for its future development and protection. Employing normative legal research, the study utilizes both conceptual and legislative approaches, applying inductive logic to draw conclusions. Findings indicate that AI should be regarded as a legal object, with the rights to its artwork attributed to legal entities possessing natural legal authority. Additionally, the use of AI in creative works aligns with the "work made for hire" doctrine. Ultimately, the study underscores the necessity for responsive and progressive legal frameworks that adapt to the evolving landscape of copyright and AI.

Abstract

Indonesia needs technology for industrial infrastructure, but it is still controlled by developed countries. Patent licensing agreements can help facilitate this process. However, Indonesia's patent registrations are slow due to a lack of regulations and internal factors.This study aims to analyze the role of patent licensing in transferring technology from developed to developing countries. Patent license agreements play a crucial role as a mechanism for technological development. Therefore, it is essential to find solutions to ensure an effective transfer of technology.This research employs a statutory and conceptual approach. The analysis follows a deductive method by examining general laws and regulations before drawing conclusions.The results show that several regulations related to technology transfer serve as the main reference for understanding why technology transfer is difficult to achieve and identifying its underlying causes. Once these causes are identified, appropriate solutions can be proposed. The lack of regulations in Indonesia’s legal framework for technology transfer hinders its full potential. In conclusion, Indonesia's technology transfer laws have not been effective due to the absence of clear implementation guidelines and strict penalties. Therefore, a specific law regulating technology transfer is needed, emphasizing its importance and benefits while ensuring a strong commitment from all relevant parties.

Abstract

Objective: To enhance public literacy and awareness about registering new halal brands and logos in order to ensure the halal status of a product and increase added value for entrepreneurs in producing and selling halal products. Maximizing and registering new halal brands and logos officially issued by the government will help boost the economy of the community, especially MSMEs. Method: The first step involves conducting surveys and consultations with relevant stakeholders, then educating and informing the public about the new logo and its application, as well as providing tutorials on how to implement the new logo. Results Trademark rights are an important part of Intellectual Property Rights (IPR) in the world of commerce and serve as a tool to win competition in capturing the consumer market. Micro, small, and medium enterprises (MSMEs) hold the key to differentiating similar goods and services and obtaining legal protection. Legal protection for trademarks is urgent and serves an economic function. The registration of the trademark is carried out considering the constitutive system. Ijtihad is needed for changes in the social life of the community, whether sudden or gradual.ABSTRAKTujuan Pengabdian: Meningkatkan literasi dan kesadaran masyarakat untuk mendaftarkan merek dan logo halal baru dalam rangka untuk menjamin kehalalan suatu produk dan meningkatkan nilai tambah bagi pelaku usaha untuk memproduksi dan menjual produk halal. Memaksimalkan dan mendaftarkan merek dan logo halal baru yang resmi dikeluarkan oleh pemerintah akan membantu meningkatkan perekonomian masyarakat, khususnya UMKM Metode: Langkah pertama melibatkan melakukan survei dan konsultasi dengan pemangku kepentingan yang relevan, kemudian mendidik dan memahami tentang logo baru dan penerapannya kepada masyarakat, serta menyediakan tutorial tentang cara menerapkan logo baru tersebut. Hasil Hak merek adalah bagian Hak Kekayaan Intelektual (HKI) yang penting dalam dunia perdagangan dan berfungsi sebagai alat untuk memenangkan persaingan dalam merebut pasar konsumen. Usaha mikro kecil dan menengah (UMKM) megang untuk membedakan barang dan jasa sejenis dan mendapat perlindungan hukum. Perlindungan hukum terhadap merek adalah urgen, dan berfungsi ekonomis. Pendaftaran merek tersebut dilakukan mengingat sistem konstitutif. Ijtihad dibutuhkan perubahan kehidupan sosial masyarakat baik mendadak atau secara perlahan.

Abstract

Micro, small, and medium enterprises (MSMEs), including street vendors, contribute significantly to the national economy, both in terms of employment and local economic turnover. However, MSMEs often face various obstacles, particularly in terms of access to financing and sustainable business management. The COVID-19 pandemic has exacerbated this situation with a decline in people's purchasing power, disruption of supply chains, and reduced turnover, causing many businesses to struggle to meet their credit obligations. As a result, there has been an increase in non-performing loans (NPLs), which not only harm financial institutions but also threaten the survival of MSMEs themselves. In the context of resolving non-performing loans, the conventional approach of using physical collateral such as land and buildings is often inaccessible to MSMEs with minimal assets. Therefore, trademark certificates can be offered as an alternative solution. Legally registered trademarks have economic value as intellectual property that can be used as fiduciary collateral or credit restructuring instruments. By utilizing trademark certificates, MSMEs not only have the opportunity to strengthen their business identity and competitiveness, but also gain a new instrument for resolving non-performing loans. This approach opens up innovative space in inclusive financing while expanding recognition of intellectual property-based assets in the national financial system.ABSTRAKUsaha Mikro, Kecil, dan Menengah (UMKM) termasuk Pedagang Kaki Lima (PKL) memiliki kontribusi signifikan terhadap perekonomian nasional, baik dalam penyerapan tenaga kerja maupun perputaran ekonomi lokal. Namun, UMKM kerap menghadapi berbagai kendala, terutama dalam hal akses pembiayaan dan pengelolaan usaha yang berkelanjutan. Pandemi COVID-19 memperburuk kondisi ini dengan menurunnya daya beli masyarakat, terganggunya rantai pasok, serta berkurangnya omset yang menyebabkan banyak pelaku usaha kesulitan memenuhi kewajiban kreditnya. Akibatnya, muncul fenomena kredit bermasalah (non-performing loan/NPL) yang tidak hanya merugikan pihak lembaga keuangan, tetapi juga mengancam kelangsungan usaha UMKM itu sendiri. Dalam konteks penyelesaian kredit bermasalah, pendekatan konvensional melalui jaminan fisik seperti tanah dan bangunan sering kali tidak dapat diakses oleh UMKM yang minim aset. Oleh karena itu, sertifikat merek dapat ditawarkan sebagai alternatif solusi. Merek yang telah terdaftar secara hukum memiliki nilai ekonomi sebagai kekayaan intelektual yang dapat dijadikan jaminan fidusia atau instrumen restrukturisasi kredit. Dengan memanfaatkan sertifikat merek, UMKM tidak hanya memiliki peluang untuk memperkuat identitas usaha dan daya saing, tetapi juga memperoleh instrumen baru dalam penyelesaian kredit bermasalah. Pendekatan ini membuka ruang inovatif dalam pembiayaan inklusif sekaligus memperluas pengakuan terhadap aset berbasis kekayaan intelektual dalam sistem keuangan nasional.
