Abstract

The development of fintech lending in Indonesia has increased quite significantly.The number of registered fintech lending is 136 and licensed 25, bringing the total to 161.The existence of fintech lending in addition to providing benefits, also has the potential to bring risks to lenders and borrowers. Potential risks regarding the security and confidentiality of fintech lending user data and potential risk of non-performing financing (wanprestasi). This study is a normative legal research / doctrinal legal research using the statute and conceptual approach. This study material was obtained through library research (library research), then analyzed analytically for prescriptive examination and discussion. The results of the analysis are interpreted using systematic, grammatical and teleological interpretation methods. The results of the study concluded that, legal protection to avoid potential risks for users (lenders or borrowers) fintech lending can be done through preventive, persuasive and repressive steps. To support this step, legal instruments formed by the OJK include legal substance, legal structure and legal culture.

Abstract

Law and technological development must go hand in hand. The speed of technological development must be balanced with a fast legal response. Laws that are not quick in responding to technological developments can certainly result in weak regulations and even a legal vacuum in the technology development sector. The technology industry in the fields of financial technology (fintech), online transportation services, and digital health services continues to develop. Without strong regulation, these sectors will have a weak legal basis. The impact faced can be in the form of misappropriation by irresponsible individuals and causing harm to the wider community. Given that sectors such as fintech, online transportation services, and digital health services are related to the interests of the wider community. The state must exist by making laws or regulations that can respond quickly to technological developments. Indonesia as a rule of law must make all aspects run according to the law, including technological developments that produce products. This paper examines the extent to which the speed of law in Indonesia in responding to technological developments.

Abstract

Formation of the Omnibus Law, There are at least two basic reasons for the name many overlapping regulations and many regulations that are allegedly hampering investment so that the establishment of the Omnibus Law is expected to be able to overcome these two problems. The purpose of writing the article is to explain Omnibus Law in the system in Indonesia, the strategy and model of Omnibus Law in structuring regulations in Indonesia, and the challenges of Omnibus Law in structuring regulations. This article can be categorized as a type of normative juridical research using a qualitative approach. The source of data in writing this article uses secondary data consisting of primary legal materials in the form of Omnibus Law, secondary legal materials in the form of journal articles, law books, magazines and so on, and tertiary legal materials in the form of legal dictionaries, legal encyclopedias and others. . The results of the study indicate that the regulatory structuring strategy through the Omnibus Law can be carried out by establishing the basic and legal politics of the Omnibus Law, absorbing aspirations, coordinating with the regions, acceleration, transparency and accountability. The regulatory arrangement model through the Omnibus Law can be done with the regulation formation model, namely IRR. Meanwhile, the challenges of the Omnibus Law in structuring regulations are in the form of current and future challenges. In the formation of the Omnibus Law, the community is expected to participate in conducting supervision.Pembentukan Omnibus Law saat ini setidaknya ada dua alasan mendasar yakni banyak regulasi yang tumpang tindih dan banyak regulasi yang disinyalir menghambat investasi, sehingga dengan dibentuknya Omnibus Law nantinya diharapkan dapat mengatasi kedua permasalahan tersebut. Tujuan penulisan artikel yaitu menjelaskan tentang strategi dan model Omnibus Law dalam penataan regulasi di Indonesia, dan tantangan Omnibus Law dalam penataan regulasi. Artikel ini dapat dikategorisasikan sebagai jenis penelitian yuridis normatif dengan menggunakan pendekatan kualitatif. Sumber data dalam penulisan artikel ini menggunakan data sekunder yang terdiri dari bahan hukum primer berupa Omnibus Law, bahan hukum sekunder berupa artikel jurnal, buku-buku hukum, majalah dan lain sebagainya, dan bahan hukum tersier berupa kamus hukum, ensiklopedi hukum dan lain-lain. Hasil penelitian menunjukkan bahwa Strategi penataan regulasi melalui Omnibus Law dapat dilakukan dengan pembentukan dasar dan politik hukum Omnibus Law, penyerapan aspirasi, koordinasi dengan daerah, akselerasi, transparansi dan akuntabilitas. Model penataan regulasi melalui Omnibus Law dapat dilakukan dengan model pembentukan regulasi yaitu IRR. Sedangkan tantangan Omnibus Law dalam penataan regulasi berupa tantangan saat ini dan masa mendatang. Dalam pembentukan Omnibus Law masyarakat diharapkan turut serta dalam melakukan pengawasan.

Abstract

The development of sharia fintech lending for three years has increased significantly. Starting from 2018 to 2020 there were twelve sharia fintech lending companies. The existence of sharia fintech lending is regulated by POJK Number: 77 / POJK.01 / 2016. This regulation has not yet developed the concept and operation of business activities, guarantees of certainty regarding the fulfillment of sharia principles, and legal protection of the implementation of sharia fintech lending, thus allowing risks that must be borne properly by the organizers and the fintech users themselves. This study is a normative legal research using a statutory approach and a conceptual approach. This study material was obtained from a literature study, then analyzed in a prescriptive analytical manner for examination and discussion. The results of the analysis are interpreted using systematic, grammatical and teleological interpretation methods. The results of the study concluded that: 1) the collaboration of the contract concept in the DSN-MUI Fatwa Number: 117 / DSN-MUI / II / 2018 and the implementation / operation of business activities in POJK Number: 77 / POJK.01 / 2016 is a benchmark for sharia supervision in the implementation sharia fintech lending; 2) the function of supervising and guaranteeing the fulfillment of sharia principles by the Sharia Supervisory Board; and 3) legal protection in the implementation of sharia fintech lending is still weak, because the POJK Number 77 / POJK.01 / 2016 does not regulate business activities and operations, guarantee compliance with sharia principles, and sharia fintech lending dispute resolution.

Abstract

The background of the article is the contents of Article 59 paragraph (3) and explanation of paragraph (1) of the Law on Judicial Power. The article authorizes the District Court to implement the decision of the Sharia arbitration body on the resolution of Islamic economic disputes. The article and explanation of the verse contradicts the absolute authority of the Religious Courts regulated in Article 49 letter (i) of the Law on Religious Courts. This shows that, the legislators are not consistent in making laws and regulations, so that it creates legal uncertainty. By applying the normative legal research method to the statute approach and case approach, this article seeks to describe the phenomenon of legal conflicts that occur. From the in-depth analysis it can be concluded that the legal provisions regarding the implementation of the decision of the National Sharia Arbitration Board are regulated in the Arbitration Law, the Judicial Power Act and the Religious Courts Act. Sedangkan tantangan Omnibus Law dalam penataan regulasi berupa tantangan saat ini dan masa mendatang. Dalam pembentukan Omnibus Law masyarakat diharapkan turut serta dalam melakukan pengawasan.

Abstract

AbstrakSejak tahun 1997, pasar modal syariah Indonesia terus tumbuh dan berkembang yang ditandai dengan semakin banyaknya produk syariah, terbitnya regulasi terkait pasar modal syariah, dan semakin bertambah­nya masyarakat yang mengenal dan peduli pasar modal syariah.  Peraturan terkait pasar modal syariah diterbitkan pertama kali pada tahun 2006, yaitu Peraturan No. IX.A.13 tentang Penerbitan Efek Syariah dan Peraturan No. IX.A.14 tentang Akad-akad yang Digunakan dalam Penerbitan Efek. Selanjutnya pada tahun 2007 diterbitkan Peraturan No. II.K.1 tentang Kriteria dan Penerbitan Daftar Efek Syariah. Seluruh peraturan tersebut memuat ketentuan khusus terkait dengan peme­nuhan prinsip syariah di pasar modal yang diadopsi dari fatwa Dewan Syariah Nasional (DSN). Kemudian pada tahun 2015, Otoritas Jasa Keuangan mengeluarkan Peraturan Nomor 15/POJK.04/2015 terkait dengan Penerapan Prinsip Syariah di Pasar Modal. Peraturan OJK tersebut mengarah kepada: 1) penguatan kerangka hukum untuk penerbitan efek syariah; 2) mengupayakan insentif untuk produk syariah; 3) memperkuat peran pelaku pasar di pasar modal syariah; dan 4) memperkuat landasan hukum bagi transaksi efek syariah. Pada saat Peraturan Otoritas Jasa Keuangan ini mulai berlaku, angka 1 Peraturan Nomor IX.A.13 tentang Penerbitan Efek Syariah, Lampiran Keputusan Ketua Badan Pengawas Pasar Modal dan Lembaga Keuangan Nomor: Kep-181/BL/2009 tanggal 30 Juni 2009 tentang Penerbitan Efek Syariah dicabut dan dinyatakan tidak berlaku.

Abstract

AbstrakTulisan ini akan memaparkan tentang sejauh mana kompe­ten­si Pengadilan Agama dalam menyelesaikan sengketa per­ban­kan syari’ah pasca lahirnya putusan Mahkamah Konstitusi No­mor 93/PUU-X/2012 mengenai judicial review atas pen­jelasan Pa­sal 55 ayat (2) dan (3) Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syari’ah. Sehingga tulisan ini lebih mem­fokuskan kepada pembahasan tentang kewenangan Pe­nga­dilan Agama dalam menyelesaikan sengketa perbankan sya­ri’ah tanpa ada lagi pilihan forum penyelesaian ke Pengadil­an Umum. Kemudian bagaimana kedudukan hu­kum pada pi­lih­an forum lain secara non-litigasi dalam pen­jelasan Pasal 55 ayat (2) ­Un­dang-Undang Nomor 21 Tahun 2008 tentang Per­ban­kan Syari’ah tersebut? Oleh karena itu, tulisan ini memuat pen­je­lasan kompetensi Pengadilan Agama dalam menye­lesai­kan seng­keta perbankan syari’ah pasca lahir­nya Undang-Un­dang Nomor 3 Tahun 2006, kewenangan Pengadilan Agama da­­lam me­nye­lesaikan sengketa perbankan syari’ah pasca lahirnya Un­dang-Undang Nomor 21 Tahun 2008, dan impli­kasi putusan Mah­kamah Konstitusi Nomor 93/PUU-X/2012 ter­hadap kom­­petensi absolut Pengadilan Agama dalam menyelesaikan seng­keta perbankan syari’ah.

Abstract

Since 2018 to July 2022, the Ministry of Communication and Information has cut off access to 534,138 gambling content on various digital platforms. This very high number will continue to grow. One of the reasons for the rise of online gambling content is the mode that is used, namely the "bodong" investment mode. Society is promised with unreasonable profits. Blocking efforts are actually one way to prevent and protect the public. Criminal law has regulated gambling in the Criminal Code, as well as if it is done using technology media, it is regulated in the Information and Electronic Transaction Law. This paper examines the regulation of criminal law regarding online gambling in the present, and in the future. This normative law research uses a statutory, comparative, and conceptual approach with prescriptive analysis. The results show that the regulation of gambling in the Criminal Code does not regulate online gambling, the ITE Law still has weak juridical problems in juridical consequences. While in the Draft Criminal Code, it is actually regulated more comprehensively, namely by regulating criminal acts committed with technology in general provisions, but regarding gambling, the 2019 Criminal Code Concept with 2022, has a significant difference, namely in the 2022 Criminal Code concept there are exceptions to permit arrangements taking into account laws that apply in society. Gambling, which has been licensed by the government, has a negative impact on people's lives. The word “without permission” has a meaning that tends to be ambiguous and less relevant.

Abstract

KSPPS (Sharia Savings and Loans and Financing Cooperative) is an independent business unit in which it develops productive businesses to improve the economic quality of small entrepreneurs by encouraging saving activities, and supporting the financing of economic activities. The financing contracts used include mudharabah, musyarakah, murabahah and ijarah. One of the contract products at KSPPS Ankasa which is in great demand by the public is ijarah. This research is an empirical juridical research using a qualitative approach which aims to analyze the fatwa of DSN No. 09/DSN-MUI/IV/2000 on the practice of financing venture capital through an ijarah agreement at KSPPS Ankasa Karangdowo, and to explain the legal consequences of the practice of financing business capital through an ijarah agreement at KSPPS Ankasa Karangdowo.The results showed that the application of the ijarah contract at KSPPS Ankasa, namely when viewed from Islamic law refers to the DSN Fatwa No. 09/DSN-MUI/IV/2000 is not in accordance with the terms of the pillars and terms of the ijarah because there is no object of ijarah. KSPPS as a lessor does not provide goods, but only provides funds that cannot be taken advantage of except by spending. Meanwhile, if you look at the system from ujrah, KSPPS Ankasa uses a profit-sharing system, not the ujrah system. This is not in accordance with the DSN Fatwa No. 09/DSN-MUI/IV/2000 that the ijarah contract does not use profit sharing but ujrah/fee in exchange for the benefits received by the customer.
